HomeMy WebLinkAbout12 09 1974a MINUTIS of the Proceedings of the Village Council of the Village of Prior lab in the County of Scott and State of Miaeosota, including ail accounts audited by sold, Council y December 9, 1974 The Common Council of the City of Prior Lake met in regular session at 7:30 P.M. December 9, 1974 in the City Council Chambers. Mayor Stock called the meeting to order. Present were Mayor Stock, Councilmen Busse, Oakes, Watkins, Wdliams, ,- Administrator McGuire, and Engineer Israelson, The following corrections v4re noted in the Minutes for December 2, 1974: Page two, paragraph five, should recd) - Motion was made by Oakes for the City to accept Al 'Stainers internal saniMry sewer and water in Oakridge Court as recommended by rthe City Engineer, seconded by Watkins and upon a vote taken it was duly passed. Page two,,paragraph ten, second sentence, Contract should read Contractor. Page three,, r paragraph five, $200,00 should read $250.00. Motion was made by Oakes to approve the Minutes as corrected, seconded b Busse and u Y upon , o vote taken ifwvas duly passed. Y Ma ayor Stock asked Engineer Israelson specifics on 'letter from Peter Lo metti Construction Company on the Harold Gustafson matter. 4 Engineer Isroelson stated that the water main and the. leads from the water mains should be located where they are on the as-Wilt drawing of the sewer and water system that he displayed, Councilman Watkins stated that three quite detailed letters were received, plus a letter from the. Contractor, with none giving any" lateral' location, by reference. Mr. Gustafson stated that there was work done ill the crea on the gas ,line previous to his work. Mayor Stock recommended to the Council to reimburse Mr. Gustafson $260,00 based on the fact that the utility company. was in there and �- probabl y did make. this disturbance :Mayor Stock. also added 'that he. found it difficult to make the lustification "on whether or not the. City of Prior Lake should stand behind a utility such as Minnesota Gas and wondered 'if they "are not part of, the cause throu -ckout this area. Motion was made by Watkins, to reimburse Mr. Gustafson $260,00 and the City to contact the gas utility company for questioning on what activity they had after the sewer, lines and stubs were placed, and for reimbursement to the City,. `Seconded b Stock and upon pen a .vote taken the following voted in favor: Mayor Stock, Councilmen Watkins and Oakes. Councilmen Busse and Williams voted against.. ;Marion . carried. - Councilman Oakes recommended the .Council' find out where water and sewer. locations, really are, if .they are where the Contractor and Engineer says they. are. Mr. Gustafson is,to submit duplicate. bills, so one :copy, may be forwarded to M'innewta Gas Company, Mr. Gustafson wanted it known that he did not say that Minnesota Gas Company destroyed the service, all he said was that they were digging in-the area. Mr. Steiner was present in regard to domage,to two of his:l ots in Oakridge Court. s City work was done on Oak Street and dirt was removed L from; part of Lot-3, all of Lot 4, andz part of Lot 5. Mayor Stock i! requested. Engineer Israelson and Councilman. Busse to check on this a reportrta the Council at next meeting. Mr. Stainer also wanted to know when he was going' to get back the S2, 500.00 that he ,paid out for park, and w he has to pay $100.00 every time he takes out a building permit` if he, *s already paid the $2,500,00. Mayor Stock stated that in addition to the Park Dedication that is called for in the zoning ordinance -the City has another ordinance that specifies that ai $100,00 per lot be charged. Oakes recommended that this matter'bexeferred to Councilman Williams and Bill, Schmokel, because Mr. Schmokel was the surveyor of the original` plat of Ookridge- Court. r. Dunwoody of Red Oaks Road was. present, in regard to hardship on sewer and wa r. Motion was made by Oakes that the Planning Commission should,after the fact, approve a variance to permit construction or if they do�nota grant the variance the building permit beheld .. in abeyance. _Seconded by Watkins and upon a vote, taken the4ollowing voted in favor: Councilmen•Oakes,, Watkins and Williams. Mayor Stock and Councilman Busse abstained. Motion . carried.; Mayorl§,,tock' stated ; that the public parking lot cannot be considered as any one ixlividuals satisfaction of parking requirements. Councilman Watkins polled=the..Planning Commissioncand the #Planning "Comriission J members wish to stand by their decision of last Thursday night with or without counting what is declared a municipal lot. =Mr.. Bill Bissonett stated his interpretation of the ` Pianning Commission decision. The Planning Commission Chairman stated that the Planning Commission after being polled will grant the building permit subject to the variance. Motion was made by'Oakes °that Mullenmaster be hired to audit the City books for the year 1974 and That the City Administrator request a quotation to understand the reasonableness of the charges'pr,ior to awarding the job, Seconded by Busse and upon a vote taken it was duly passed.
