Present were Mayor Stock, Councilmen Bissonett, Hafermann and Watkins,. City Manager McGuire, City Engineer Anderson,` City Planner Graser, Financial Director Maw, and Attorney Sullivan. # j_ Councilman Busse was absent. ' The minutes of August 21, 1978 were reviewed.. Page 2, paragraph 2 line 2 should read, "'.,,stated " that the Plague Committee.., ", Page 2, paragraph 9, line 1 should read, "..,Attorney to proceed with the condemnation proceedings to secure a..., ". MINUTES Notion was made by Watkins to approve the minutes of August 21, 1978 as Y amended,_ seconded by Xafermann and upon a vote taken it was duly passed'.. LAKESIDE The first item on the agenda was to review the Lakeside Marina ordinance MARINA violation. Mr. Jim Dunn and Attorney Bryce Xuemoeller were present. Both of them questioned the Council, along with Mr. Rollie Thieling concerning this violation. L Notion was made by to grant a variance to the Lakeside marina for a deck constructed on the structure, seconded by Bissonett and upon r= a vote taken it was duly passed. Notion was made by Watkins to levy a $100 fine against the Lakeside marina ' for the violation of the building permit ordinance, seconded by.'Mayor Stock and upon a vote taken it was duly passed. CONDITIONAL motion was made by Watkins to direct the Planning Commission and staff to USE R1 b R2 prepare the conditions needed for the Conditional Use request under the R-2 and R -2 zones, seconded by Xafermann and upon a vote taken it was duly passed. I { mayor Stock directed; staff to contact the abutting property owners around Lakeside marina for their comments. M1DNR - -L2 B29 Spring Lake Townsite -- objected to the assessments. Council decided to let the assessments stand as stated. - ,Q Mrs. Dorn - -L10 B34 -- wanted the culvert to be replaced. Engineering staff to look at it. Mrs. Dorn - -L53 & - asked on how it was assessed. Council decided to take the narrowest and widest length and divide by 2. 130' for L53 and 130' for L54. m/X Boltz - -134 & 35-- concerned about the buildability f the lot. Council dec, to let the.assessments stand as recorded. _ Wangerin - - L35 & 36 -- wanted their assessments deferred. Boeck-- L3,4,9,10 Fairview lea ch: - Lots 3 &4 need stubs and easements, lots 9 &10 - had a private electrical service destroyed. Engineering will look into it. Sullivan-- L100', 101', 102 Northwood - -There were 2 - stubs put in one lot and none in the other- Engineering to check on it. ti Sweeney-- y - -L 87-- ob'ected to the acreag amount. Stated that he would bringr.in a survey and will consider at,a suture Council hearing. Notion was made by Bissonett to continue the Project 76 -1 Assessment hearing until next week, Sept. 5, 1978 at 9 :ooFX, r sec it was duly passed. onded'by Watkins and.upon a vote taken FLOOD PLAIN ORD. The Council considered the Flood Plain „Ordinance. - A letter dated Au gust 18, 1978 from HUD was received by the Council, Mayor Stock directed the staff and Attorney Sullivan to include more "defined” language for the Flood Plain Ordinance before any Council action was to be taken. : Mr. Bryce Huemoeller was present to request the City of Prior Lake to release the subdivision bond being held by Prior F� • Lake Blacktop Company. Mr. Huemoeller stated that the Company should have been lssued a performance bond and not a subdivision for the ; paving of Eau Claire Trail when it was considered. The Council stated 'that Xr., Huemoeller should get a copy of the bond and minutes from that time.; Councilman Watkins stated that he would contact former` Councilman Oakes to see if he still might have the notes concerning this. RESOLUTION 78-27 Notion was made by Watkins to adopt Resolution 78 -27; a resolution for the installation of traffic signals 13 at Hwy. and CSAH'42, and a copy of that r is to be sent to the Savage City Council., Scott County and Phi /Dot, seconded by Hafermann,and upon a vote taken it was duly passed. FAIALAWII ,.. SNORES TRL. Mr. Jim Norton of OSN presented the Council with the preliminary plans and specifications of the •- ' paving of Fairlawn Shores Trail.. Council tabled the item until next week, which will give the City Engineer time to review the plans. { 1976. PLYMOUT I Two bids were received for the 1976 Plymouth; $300 from David Nordr $651 from Phillip Ti ka ru ?' i . P p Notion was made by Bissonett to award the 1976 Plymouth bid to Xr. Phillip Tipka for $651, E k seconded by Watkins and upon a vote taken it was duly passed., E GATEWAY CENTER Bill Bissonett abstained from the Gateway Center conversation. The Council'\ was to establish a date for the Public hearing for improvements to roads abutting Gateway Center. °A petition was received by the Council for a waiver of public hearing concerning this. Notion was made by Watkins to authorize OSX to re p pare the plans and specifications for the extension of Jordan Avenue and to present them to the Council an Sept. 18, 1978, seconded by Hafermann and ' upon a vote taken it was duly passed. JIM MASON Mayor Stock stated that he and Councilman Hafermann met with Jim Mason STORM SEWER concerning his storm sewer.
