' November 20,1978 Y regular The Common Council of the City of Prior Lake met in session in the City Council Chambers on November 20, 1978 at 7:3OPM. Mayor Stock called the meeting to order.- Present were Mayor Stock, Councilmen Bissonett Busse, Hafermann and Watkins, City Manager McGuire, City Engineer Anderson, City Planner Graser, Planner Tooker and Attorney Sullivan. ; MINUTES Motion was made by Watkins D adopt the minutes of November 13, 1978 seconded by Busse and upon -a vote taken it was duly passed., PRIOR HIGH- Mr. William Mullin from the law firm of Mullin, Weinberg and Daly was LANDS VISION - present as council of Visions III "representing the development of Prior `t "VIII Highlands. Mr. Mullin presented .a letter dated November 70, 1978 to r Attorney Sullivan from his law firm regarding an easement opinion. _1 Attorney Sullivan stated he has read the o resented,.. and to o y P P g back a bit, at the time that this matter was first considered there was a question raised as to whether the property was contiguous. At that time they claimed an easement, the City asked to have this casement fur - nished to them, he has never seen an easement, he has seen documents �. that refer to an,easement, but he still has not seen an easement. It would.be his feeling that if there is such an easement that connects these two parcels that the property probably would be considered contiguous. It may be that they have a prescriptive right to an easement across phis property.. that is a matter that he thinks should be determined by our district court rather than by the City Council, therefore, it,is his feeling' that the property is not contiguous. He has not seen an easement and it may very well be that the testimony at some hearing will establish that there is an easement, but he thinks that should be a matter for the court. Therefore, his opinion remains the same, the property is not contiguous, he has not seen an easement. i Mr,. Mike Magnuson was present regarding this matter. Mr. Dick Booth #' presented a petition from residents of Grainwood, Maple Park and Martinson Island requesting that the City Council not allow the inclusion of boat dockage facilities in the proposed Prior Highland development. Mayor ,y Stock accepted the petition. y d lK Motion was made by Bissonett.to deny the request of the developer of `- Prior Highlands"for one dwelling for every ten feet of Lakeshore used to have deeded lake access because as of this date it is not in compliance with the zoning ordinance, seconded by Busse and upon a vote taken it was duly passed. COMPREHENSIVE Mayor -Stock called to order a joint meeting with the Planning Commission PLAN regarding pr--liminary Com'prehensive_Plan discussion. City Planner Graser and Planner Tooker presented information regarding Jand use: 'and thoroughfares. Q Mayor Stock expressed the Council's appreciation for the job that -has been - done =pn'the Comprehensive Plan and expressed their thanks to the Planning Commii °sion and the staff 'for the job and the efforts that they have put forth and urged them to continue moving'forvard and to take into considers -. ^ flan the �;osments that ;were. made this evenin g. DOG CATCHERS Motion was made by Watkins to accept the Dog Catchers report for October, 1978 seconded by Hafermann aad upon a vote takenit was duly passed. TREASURERS Motion was made by Busse to accept the Treasurer's Report for October, 1978, seconded Watkins and upon a vote taken it was duly passed._ SNOW PLOWING City Manager McGuire presented ,a snow plowing agreement for Inguadona Beach' INGUADONA BC Attorney has reviewed and ap the Ing rcle. y pp gu Beach Circle j snow plowing Motion was made by Watkins to adopt the snowplowing, and sanding agreement for Inguadona Beach Circle, seconded by .Busse and upon a vote taken it was duly passed. The November 27, 1978,.Councii, meeting has been cancelled. PROJ. 7773 Motion was made by Hafermann to authorize the City Manager and the City Engineer to negotiate with Fischer Construction.on Project 77-3;, Phase I and. if an acceptable agreement can be reached on Northwood Road repairs that the retainage fee be reduced to St, seconded by Watkins and upon a vote taken it was duly passed.
