Present were Mayor Stock, Councilman Bissonett, Busse; Thorkelson, Watkins, City Manager McGuire, City Engineer Anderson,. City Planner Graser,, Parks Director Mangan, Finance Director Teschner and Attorney Wells Anderson. Mayor Stock called the meeting to order. The following corrections are to be made to the minutes of August. 20, 1979: Page 3, paragraph 8 . Gordon Hennen property assessment be changed to reflect additional) 150 ft. of sewer along Cty. LIQ, LICENSE MEETING xCity.Manager McGuire reported on the liquor license committee meeting, Their meeting was to discuss the suspension of 3 S D Bar's liquor li;cense:, for day, Tuesday, September 4, 1979, The reason being, "of sale liquor to a minor. The individual was drinking beer in the B s D Bar, but_ was not served by the owners; another patron purchased it and gave it to the minor: There was a bouncer on'.duty that night, the minor got past him, The Council' all agreed that the B b D Bar has a'good record,since they have been in business. It is a fine organization aid' living uP to the. City's expo: ations. Motion by Watkins to suspend the liquor license for the B b D Bar for 1 day; September 4, 1979, seconded by Busse and u . duly passed. The highest bid was received from Jerry Haferman for $401.50, Motion by Watkins to accept and award the bid to Jerry Haferman for the city jeep in the amount of $401,50, seconded' "by Thorkelson and upon a vote.taken it was duly passed. LAKESIDE ESTATES _City Planner Graser presented Lakeside Estates and their request for hardsheli approval on the amended' reliminar fee of $6,660.00 has been paid, p y plan" The park_dedicaton City Engineer Anderson reported that the performance bond',for sewer and water installation has been received with the insurance for the project. The developers agreement for S /W /P has been signed. Before the paving))is started a performance bond must be obtained. The developers agreement is $102.321,00;. The City fee for the project cost is $5,543.55. Motion by Bissonett to approve the developers agreement and make part of the record that the engineering and inspection fees are the obligation of the developer and the developer must get the performance bond pavan for g prior 'to the construction, seconded by Thorkelson and e, upon a vote taken it was ,,duly passed'. Mayor Stock recommended that the agreement be extended j until September 30,' 1979. Motion by Bissonett to,give the Watzl's a 30 day extension until September 30, 1979 contingent upon their insurance policy being extended to that date, seconded by Thorkelson and upon 'a vote: taken it was duly passed. OSM CONTRACT City Manager McGuire presented the OSM contract agreement. The.engineering fee as of a % of construction cost is as follows: Con struction cost Engineering fee. ° e 0 500,000 7. 5% # 500,001: 1,500;000 5 Over 1,500,000° 5.8% This new contract is effective immediately and includes all projects starti with the 1979 projects. n g 0 p, Motion by Busse to approve the updated contract for OSM, seconded by'Watkins and upon a vote taken it was duly passed. ROADWAY City Planner Graser requested that the ,date for VACATION public hearing of vacat.i.ort of o a roadway be postponed until next week. Staff would like to review the road WILLOWS" IST easement and utilities_ Mayor Stock stated that the date for the pubi'ic hearing for the'vacation of the roadway in the Willows lst' will. be at*the next regular council meeting. GATEWAY Gateway Avenue and Resolution 79 -30 was presented,by Cou�ic loran Watkins. It does'not serve the ; { owners best interests and their property can be developed without the ;,Gateway Ave. Councilman Busse stated the roadway has planned for and is a necessity to that property. Councilman Watkins replied to Mr. Lavine's statement that the City has done a.lot of work trying to get this piece of land to be useful. A_ If you are not interested in the resolution, please -let us know and we will withdraw it._ 'Councilman Thorkelson stated he. doesn't see that the parcel is adequately served unless an alternate appcoach'is presented, and them is no evidence of that here this evening, Mayor Stock conct4ded that the only_. other method 3s the process of condemnation.. Condemnation proceedings should be initiated and the City Attorney and City Engineer prepare the legal documents. Motion by Busse to authorize the City Attorney and City Engineer to prepare the necessary legal documents.to prepare condeidnation for the property of the Happy Hollow Corporation of a 25:ft. easement roadway, seconded, by Watkins and upon a vote taken it was Passed. Residents of the area that are present may say a few words, if they wish. L. SCHWElcH Lawrence: Schweich was present regarding a property owner in that area, WES- _HUKRIEDE Mr. Wes'Hukriede bought some property from,ne in the Green Q'-*s area. Mr. Hukriede wa told and showed on a map 'in my off ce :that :tht property was private. Mr. Mukriede sal he thought it was public when he purchased it and so was the: road, 1100, Mr. Hukrleft ° wants to subdivide the lot. Ail the other lots in the area are large like the one he has. The lot cannot be subdivided the way h3 wants to 'do it. if it. could have been divided, 1 would;have. done it myself, Wes Hukriede was present and stated that he was not shown a map. The lot line went to the center of the road and was:an easement when 1-bought it. 1 had it surveyed and to date it is the same. The flags go to the middle of the road and extend to the side of the drainage easement. Lawrence Schweich stated that the Property was surveyed,by Harry Johnson and the corner posts were put in and are still there. It was not surveyed to my knowledge after that. If he had it surveyed, i want to'see bill. The surveyors don't do it for nothing. When he came to me to ask to purchase _.the property I told him that 1 lot and the corner lot were being saved for building a large house. He brought his plan into my office to build 3,level house for $62,000. That is why 1 sold it to him, to keep the lot one large lot. ` Me, since then has built a completely different house then the lan he s ale.. BONDING IN Mayor Stock directed staff to review the '7NER CITIES tabling as far as hardsheiis policies, procedures and time does not follow their Rrellminary s and final's, and if the.developer c policy, the hardshell will become null and void. No extensions will be granted. SHADY BEACH TR Mayor Stock re ported that 'some residents on Shady Beach Trail: have seen the developer using a pump to'get water out of the area and is P+ti t across the road, The City Engineer should check it out:. Also, the cit , e connection to Shady Beach for sewer and water lines that were_extendeo, to the park. This should be c �pleted immediately, sodded and the rest of the project be left up to the developer. PLEASANT AVE, he City Engineer reported that the Resolution for Pleasant Avenue and TH 13 EXTENSI 13 extension has been sent to Mn /Dot. Mn /Dot replied that they could e p out.,with the project if the City would construct the turn lanes and y- passes.
