The Common Council of the 'City of Prior Lake met in regular session on
October 22, =197.9 at 7:30 PM. Present were Mayor Stock, Councilmen 'Bisson-

ett, Busse, Thorkelson, City Engineer,Anderson, City Planner Graser,'Parks >

Mayor Stock called the °meeting to order. The following correction's:` are to
be made to the minutes of October 15, 1979:
Page 2, paragraph 4;, Association for a fee of $150 that the circle

southwest corner of intersection County Road 42 and Highway 11. The
zoning request is for B -2 and B -1. Planner Graser reviewed the history
of the parcel_ The City of "Savage and,,the City of Prior LakeL conducted a
study -for land adjacent to the intersection and came up with Resolution

77 Mr: Graser reviewed a few of the guidelines' that would a" l.,;ly to
this intersection. This area was once considered for R -3 zoning. At that '
time, a neighborhood organization requested the Council. not consider it as
a high density area. °

The area under consideration is approximately lO+.acres. The request is
for - B -1 limited commercial for the area west of Country lane or the land x
abutting single family residential and the remainder is 'requested for B -2

community business. There are two options available to the Council to
decide'what character that intersection is going to take, -B -1 or 8 -2.
In opini'on, - the shopping - facil-ity invisioned for this intersection
is -

drawbacks to B -1` and B -2 zoning, B -1 has a limited number of permitted

uses. It does not include. retail use. The only uses. under that ordinances
are clinics, offices, banks and mortuarFes., B -2 is a community business
district. The lot size is very small, 5000 sq. ft minimum and includes -
11 permitted uses. If the area is zoned B -1, the protection of the area is
.' i
in the ordinance. I,f` there is any retail request, it can be handled`
through conditional uses. Under B -2, this protection is- not there. It
would hav Ato be handled by some kind of covenant and would have to be
drawn up with the developer and the City Council. The covenants would have
to be approved'by the Council with, the hardsheii or final plat and recorded
at the county. The Planning Commission held a hearing on this and they
found that the uses in this area be neighborhood orientated and.,they_ should
not compete with the downtown district. The Planning Commission made a
motion to give preliminary approval to the B -1 area, as shown on Exhibit. 1`
and instead of B -2, they recommended a B -I district with blanket conditional
uses.

The Common Council of the City of Prior Lake met it regular session on
October 22, 1979 at 7 :30 PM Present were Mayor Stock, Councilmen Bisson- "'

and City Manager McGuire,
Mayor Stock called.the meeting to order. The following corrections are to
be made to the minutes of October 15 1979'
Page 2, paragraph, 4; Association for,a fee of $150 that the circle

JAMES REFRIG- Mayor Stock called the James Refrigeration rezoning hearing to order'.

ZONING City Planner Graser gave the presentation, The parcel is located in the
southwest corner of intersection County Road 42 and Highway 13. The
zoning request is for B -2 and;1-1. Planner Graser reviewed the history
of the parcel. The City of Savage and the City of Prior Lake conducted a

study for land adjacent, to the intersection and came up with Rec. lution �'

77 Mr. Graser reviewed a few of the guidelines that would a`�My to`'
this intersection.. This area was once considered for'11 zoning. At that
time, a neighborhood organization requested the Counc7l_notonsder i a"�

a high density area.
The area under consideration is approximately 10+ acres. The request is
for B -1 limited commercial for the area west of Country Lane or the Xand
,abutting single fari residential and the remainder is requested' =$ -2 ;

community business. There are two options available to the Council to
,
decide what character that intersection is going to take,.B -1 or'B -2.

In Staff's opinion, thejshopping facility envisioned for this intersection
is a convenience center for the people north of the lake. There are certain
drawbacks to B -1 and B zoning, B -1 has a limited number of permitted
uses. It does not inclLde retail use. The only uses -under that ordinance
are clinics, offices, banks and mortuaries. B -2 is a` community business
district. The lot size is very small, -5000 sq. ft.'minimum and includes
11 permitted uses. If the area is " zoned 'B -1, the protection of the area is

in the ordinance. If there is, any retail request, it can be handled

through conditional uses. Under B -2, this protection is not there. It
would have to be handled by some kind of covenant and would have to be
i
drawn up with the-developer and the City Council. The covenants would have

to be .a
approved by the Council -with the hardshel1 or final plat and recorded
at the county. The Planning. Comm ss ion held ,a hear on this and they
found that the uses in this area be neighborhood orientated and they should
not compete with the.downtown district. The Planning Commission made a
motion to give preliminary approval to the B-1 area as shown on Exhibit i
and instead of B -2; they recommended a B -1 district with blanket conditional
uses,,

Councilman Busse voted nay.
Mr. Aslanidis made additional comments on the.Council's motion. The Council
and Mr. Aslanidis d%scussed this further,
Mayor Stock closed the hearing on the zoning issue and called the sub-
division hearing to order.

Planner Graser presented the subdivision. Since there is a B -1 zoning,
ERATION SUB- the minimum lot size is 20,,000 sq, ft, for each lot. First, Country Lane
DIVISION should be Country Avenue. As far as the overall design of the plan, l
�-- ;i think it is very well designed for this site.
Planner Grayer read over the development covenants and restrictions.
There are a few, additions that were made. Under A. 5. .lamas Refrigeration
Company will post a $6,000 bond immediately upon final plat approval.
Buffer will be constructed at the time of side grading.
B. All lighting should be directed away from the residential area.
C. 2, c, parking shall not be permitted close- than the building set
back in the adjoining residential uses
Mr. Aslani`dis, requested that this item 'be tabled until he has had time to
l talk,�ilh his client.
Mayor Stock stated that this, would not be a problem, however, discussion on
the subdivision will continue to give the James Reffigeration'some idea or
guidance on how the people present and the Council feel about the. matter.
Don Williams - People on Timothy submitted nine points of recommendation at
the time the c plan tan was discussed. 1 would like to see that in I
the minutes.

Mayor Stock - I` will have this information available at the next meeting
this item is being discussed.

Another question asked is what are the alternatives that are going to be
t offered that we think will be best for Timothy? (The access to 42)
Mayor Stock stated that this will not'be decided by the Council.
Some of the residents of that area were concerned that they wiT'l not be
notified when a decision is made about -this,

regarding the access, in a unified manner rather than one person having

SCOTT COUNTY County Commissioner Doug Hafermann was present`to discuss with the Council

pace. The Commissioner explained the plan of adding an-
other story to the exis ing court house. We are now renting from St. Franci's
and when the give us a 30 day eviction notice, we need to have somewhere to
go. We decided the best way to go is to add a floor onto the existing
building. We have funds available now that we can use; we are expecting
to use revenue sharing.funds, bui "Iding fund revenue for 1980 and rent reim
bursement from the government. The County revenue availability is about ,
