May 5, 1980 at 7:30 PM. Present were Mayor Stock, Councilmen Bissonett, Busse, Thorkelson, Watkins, City Manager McGuire, Parks Director Mangan, City Planner - Graser and City Attorney Sullivan. Mayor Stock called the meeting to order. The minutes of April 28, 1980 were reviewed. One correction is to be made on Page 2, paragraph 2, sentence 2, change immediately to investigate. a MINUTES - Motion by Watkins to approve the minutes of April 28, 1980 as amended, seconded by Thorkelson and upon a vote taken it was duly passed. LAKESIDE The first item on `the agenda was Lakeside Marina. Mayor Stock read Memo C MARINA from the City Manager regarding the recommended uses that can be considered as for guidelines the non - conforming use. r �'. Council discussed the policy statement and added other conditions such as municipal utilitites be connected and landscaping be done to act as a buffer. ; GRAINWOOD Nan Miller, Attorney for the Grainwood Townsite Association and Bryce ASSN,. b Huemoeller, Attorne y for Jim Dunn were present and commented on this issue. LAKESIDE MARINA Nan Miller requested the Council to table this matter for one week. A motion was made and seconded. Council discussed the matter further. A vote ,., was then taken and the Council unanimously voted nay. The motion failed. ' Motion b Bissonett to adopt the Y P policy statement as presented by Staff for Lakeside Marina and the modifications that have been added, sewer and water ' s= connection and landscaping to buffer,,seconded -by Thorkelson and upon a vote taken it was duly :passed, 8:00 PM The public hearing was called to order. Mayor Stock read the published 'REZONING FOR notice that appeared in the paper. The purpose of this hearin . 9 was to con - OFFICES b Sider amending the zoning ordinance allowing "offices and banks" as permit-,, BANKS ted uses in the B -3 zone. City Planner Graser Y presented the : information. _ Motion by Bissonett to approve the amendment to the zoning ordinance allow - ing offices and banks a's permitted uses in the B - zone and direct the City Attorney to draft the ordinance, seconded by Busse and upon .a vote taken At t was duly passed. _ Motion by Watkins to adjourn the public hearing, seconded by Thorkelson and upon a vote taken this hearing was adjourned at 8 :28 PM. ' LAKESIDE The meeting continued with the Lakeside Marina issue. City Manager McGuire MARINA reported on the inspection:that.was.made last week by - himself, Horst Graser, and Bill Mangan. Attorney's for both parties made comments and the Council discussed this matter. Mr. Ed Martini requested that the soi.i on the lot adjacent to the Marina property be removed_ because it is getting on hit property and his neighbors. Motion by Thorkelson to direct -the 'Zoning Officer to issue a zoning certifi- '' cate delineating the uses.of this property.on the basis of.the policy gu'ide - lines that were established this evening, seconded by Busse and upon a vote taken it was duly passed. Motion by Bissonett that Mr. Dunn comply wit hthe conditions established with the policy statement by: , f 1) Site line "s along the county road, r 2) Storage ofJ'eq(jipment on,the lot adi,'acto the marina must comply with - in 5 days, 3) Site blockage that may be occuring on.Cty. Rd. 21 be removed within 5 days, 4) Sixty days be granted for major work, seconded by Thorkelson and upon .a vote taken it was duly passed. MINUM of the Proceedings of the Vilhago. LAKESIDE Motion by Busse that Mr. Dunn deal with the erosion problem occuring on the MARINA lot adjacent to the non - conforming use caused by the stock piling of earth within 5 days with approval of the City Engineer, seconded by Watkins and , upon a vote taker }'it was duly passed. ` Motion by Watkins that all signs be brought in compliance with the sign ordinance, seconded by Busse and upon a -vote taken it was duly passed.' The Council reviewed Mr. Dunn's- application for a gas service dock. Motion b Watkins that action be tabled on approving pproving a dock permit- ;u, {til specific delineation be submitted by Mr. Dunn, seconded by,!Busse: Discussion was held and. ,upon the agreement of Councilmen Watkins and Busse this motion was amended and the following action was taken: d Motion by Watkins to grant a temporary permit for the purpose of installing ` a gas service dock immediately, with Fire Marshall approval and that Mr. Dunn submit to the staff formal, drawings illustrating the number of slips and the locations, seconded.,by Busse and upon a vote taken it was duly passed. Mayor Stock scheduled that the formal drawings be submi the Council for review on Monday, May 19, 1980 at 7:35 PM. City Manager McGuire stated' 3 that the drawings shouJA be in his office prior to the Council meeting. Motion by Watkins that s1.ip will equal one boat and one boat will equal 25 ft. in length, seconded by B'issonett and upon a vote taken it was duly passed. /f , - -r'r ,A � Motion by Busse to adopt the map for the purpose of illustrating'parking, ,3 and service display area for the Marina and mark the,..map Exhibit dated 5/5/80, ,seconded by Thorkelson and ,upon a -vote taken.1 t was duty passed. Motion by Thorkelson to adopt Memo D'as an addendum to llemo C, seconded by =' Busse and upon a vote taken it was duly passed." JIM LUDOWESE The Jim Ludowese assessment was discussed. This item was tabled =from last ASSESSMENT week for Staff to research. Staff found no memo regarding Mr. Ludowese's property and recommends a reduction in assessments. l Motion by Busse to approve the reduction in assessments for Jim Ludowese of .016 acres ($40.00) and 10' of frontage ($756.10) from the current assessment,_-, roll, seconded by Bissonett and upon a vote taken it was duly passed._ '!J RESOLUTION Resolution 80 -09, Data Privacy ''Act was reviewed. City Manager McGuire. read i 80 -,09 the letter received from Attorney Wells Anderson. Motion by Thorkelson to approve Resolution 80 -09f Data�F i.vacy Act, removing ! Item #3 seconded'by Mayor Stock and ,upon a vote taken it Mias duly passed. f' x ; SPORTS ARENA The indoor sports arena was discussed next. City Manager McGuirebriefly read the memo from Staff answering questions raised by the Council at the last meeting. Council also discussed waiving, the park dedication fee.' ( Motion by Busse to approve the indoor sports arena with preliminary commit - ; ft men.t of the City installing sewer and water to the property line. The ap- proximate cost would be $35,000.00 (connection fees would reduce the City's cost to approximately $20,000.00). Contingent upon: 1) the City Engineer be in close contact with the people working on the design of the building and final elevation meeting our purposes for sewer & water, ' 2) hpon the fund raising committee reaching 65% of their total goal, they con- tact the City Council so they can put into motion final efforts for funding the sewer and water, 3) that an operations advisory committee with a representative from the school, City and two or three members of the community be appointed, seconded by Watkins and upon a vote taken it was duly passed. i -;2_ � a
