The Common Council of the City of Prior Lake met in regular session on,Mon-
day, December 8, 1980
at 7:30 PM. Present were Mayor Stock, Councilmen
Busse, Watkins, Thorkelson, City Manager McGuire,_ City Planner Graser, Fi-

name Director Teschner and City Attorney Sullivan. Councilman Bissonett
was absent.
Mayor Stock called the meeting to order. The minutes of December 1, 1980
were reviewed.
MINUTES
Motion by Watkins to approve the minutes of December 1' 1980 as Presented,
seconded by Busse and upon a vote taken it was duly passed.
NORTHWESTERN
BELL CONDITION
Northwestern Bell Conditional Use Appeal, which was continued from 2 weeks
ago, when Northwestern Bell discussed several locations for a, -small out

equipment. Mayor Stock asked Mr.. Dokken, representative
from Northwestern Bell, if they have found
a location.
Mr. Dokken stated that he discussed with Denny McWilliams'the' °possibility

of getting property -other than the NW corner of,Sand Pointe. Mr... McWiJ
liams talked about 'a western,
eastern and southern portion of property of
Sand Pointe. The telephone company can't se'e anything to gain by these

lots, it isn't any more acceptable to the neighborhood than the corner of
Lot 4

and more difficult to use. The entire Lot of 3 and 4 is 'feasible;

Lot 1, Block 11 is workable. Mr. Dokken stated that he talked with the

highway engineer on using land on Cty. -Rd. 42 and Mullhullen Road. ' The
engineer did not see any problem with this area. Mr. Dokken.asked'if
the City could use some of the land for a permanent water tower location
and share the cost:
The City Manager responded he has talked with Mr. William Marshall,
land owner of the parcel on 42 and Mullhullen, and he i willing to dis-
cuss with the City the possible acquisition of this site. The City man-
ager stated that..six weeks would be needed for Mr. Marshall to,decide if

he wishes to sell the land.
Motion by Thorkelson to continue -the conditional use appeal from North-
western Bell to February 2, 1981 at 7:35 PM, seconded by Busse and'upon a
vote taken it was duly passed.
Mot4,6n by Busse to authorize the City Manager to negotiate with Mr. Mar -
shall the purchasing of the land he owns; the NE quadrant of Mullhullen
Road and Cty. Rd. 42, seconded by 'Thorkelson and upon a vote `taken it %gas
duly passed.
Mayor Stock also directed the City Manager to discuss with Northwestern
Bell the site location and arrangements that could be made with the City
for sharing
this parcel.
RECIPROCAL 3I;
FIRE AGREE14EN
The Reciprocal Fire Agreement with New Market was reviewed . The City

(NEW MARKET
Attorney's opinion was that this agreement is the >same as with other
communities.

Motion by Watkins to authorize the Mayor and'City Manager to.enter into
a Reciprocal Fire Agreement with the municipality of New Market, seconded
by Busse and upon a vote,taken it,.was duj passed.
RESOLUTION
80-26
Mayon Stock read Resolution 80 -26, requested by the Fire Chief and Fire
FIRE AID
Dept., opposing the reallocation of fire aid for an y purpose other than
,
presently mandated.
Motion by Watkins to adopt Resolution 80 -26 opposing the reallocation
of
fire aid for any purpose other than presently mandated, seconded by Busse

and-upon a vote taken it was dul y passed.

ORDINANCE
Ordinance 80 -4 and ;80 -5 were reviewed.

and Delinquency, seconded
by Thorkelson and upon 'a vote taken it was duly
passed.
Motion by Busse to adopt Ordinance 80 -5, Sewer Use Rates, Delinquency, second'-
ed by Watkins and

ORDINANCE 80 -6
Ordinance 80 -6, Sign Ordinance, and the letter from Rick Lind was reviewed,,
Mr. Lind's letter answered last week's questions forsi= =variance; on the sign
ordinance. If
an individual wishes to appeal for a variance, they may go '-''
before the Planning Commission. If the Planning Commission
denies the <re -
quest, the individual may appeal to the Council.
Motion by Busse to adopt Ordinance 80 -6, Sign Ordinance,--seconded ' by- Watkins
upon
and a vote(:taken it was duly passed.
Mayor Stock requested a copy of the Jett er'fram Rick Lind to be filed with
the Sign Ordinance.
Sanding of

Mayor stated that he received a complaint from a resident regarding
sanding of the city streets. The

residented stated that the flat streets do
not need to be sanded.-

Mayor'Stock directed -the City Manager to discuss this with the Maintenance Crew.
