The Common Council of the City of Prior Lake`met.in reg0 ar session on Monday,

Janaury 4 1982 at 7 :30 PM in the Council Chambers, Mayor Stock called the
meeting to order. Present were Mayor Stock, Counpi`lmen Busse, Watkins,
?
Thorkelson, City Manager McGuire,, Ci +y Planner'Graser, Finance Director Teschner,
City Engineer Anderson and Parks $ Ri creation Director Mangan.
Upon a request of an interested citizen.the suggestion of paying respect to the
'lag of the United States of America, Mayor Stock asked that everyone please
rise and Pledge Allegiance to the flag.
City Manager McGuire swore in Mayor, Walter Stock. Mayor Stock then swore in
Keith Thorkelson and Ted Schweich as Councilmen.
The Minutes of December 21, 1981- were reviewed.

Motion by Watkins to award the gas and diesel fuel purchased for 1982 To
Muelken 0 11 Company with prices as of 1/1/82 being, Gas - $1:12 9 plus,;
130 State Tax; Unleaded Gas - $1.1749 plus 13C State Tax; Premier Disel Fuel -
$1.17.9; and #1 Diesel Fuel - $1.18.9, seconded by Thorkelson upon a �ote

Motion by Busse to appoint -Bob Mertens as Fire Marshal and LyleyAnderson as

Motion by Busse to reappoint the firm Lommen, Nelson, Sullivan & Cole at the
previous rates.as consulting Attorneys for 1982, seconded by Watkins and upon
a vote taken it was duly passed.

Motion by Thorkelson to reappoint Charles Tooker as the Consulting Planner a,

the same rate as 1981, seconded by Watkins and upon a v\�te taken it was duly
passed.
Public
Mayor Stock called the Public Hearing for the Gateway Storm Sewer Project 81 -2
Hearing
to order. The published notice was read. City Engineer''nderson, Finance
Gateway
Director Teschner and Jim Norton were present to discuss �he project and answer
81 -2
any questions or comments. �?
Jim iJorton want over the Preliminary Report and Estimate of Cost for the Storm
Sewer and Appurtenant work for Project 81 -2. The cost estimate for the proposed
project, including 30% indirect cost, is $46,424.50.
Several residents were present with questions for Council an�d'Staff.

Council and Staff gave their views and answers to their ques ions.
The main concern was what areas were to 6.9 assessed. City En'ineer Anderson

stated that if onl a portion of the property was within the ()utlined area for
the project, only that portion would be assessed, not the entire p <iece of
Property.

Mayor Stock discussed the issue of credit for the owners of the property that
were assessed when a portion of the Storm Sewer,was assessed in 1972,, he stated
that the law does not specify that any kind of credit has to be ,given in a case
such as this, where a portion of a Storm Sewer was assessed.`;

Motion by Watkins to approve Project 81 -2, Gateway Street Storm Sewer Extension
Gateway
on the basis`of the stipulation that the area of 'Ralph Blake.borough be delineated

as to specifically the water run off and the direction there of,.and also the
property of Dr. Olson as it relates to the upper portion of, the NE ,quadrant of
the proposed assessment area and that the Staff 'review the proposal of a zone
differential and assessment calculations and present it to the Council prior to'

the time of the actual assessment hear=ing for this project for the Council review,

reviewed at the original Public 'Hearing of December 21, 1981 and the continuation
at this meeting on January 4, 1982, seconded by. Busse and upon a votrataken it way

City Planner Graser presented the Fitzgerald - Tupa Prelinimary(Plat to the
Council. The plat map that City Planner Graser was using for his presentation
ti
was marked as "Exhibit A", per Mayor Stock's request.
John Fitzgerald and Leonard Tupa were present to comment. Both Were concerned

on tla assessing of the total land area for the Park Dedication fee, Mr. Tupa t

felt that the price of the land was grossly over estimated. 1�He stated that
the price was taken after the land was improved. He told the" Council that
when he purchased the lot it was a swamp, he filled it and dredged the lake'
out. He also states that there is an easement that he has gi`ien to the City
on.,the west side for a Storm Sewer which is 10 feet wide and 182 feet deep,
dnd that he has also given the roadway easement to the City.

Next on the 'agenda was the acknowledgement to Tony Anderson for the donation to
Fish Point :Park. Parks $ Recreation Director Mangan was present to report on
this.

Councilman Watkins complimented the Prior Lake American for the excel.lent'job
on the issues that were published in the paper regarding snowmobiles, the i

C.I.P. report and the financial situation.
