July 6, 1982
The Common Counci - I of the City of Prior Lake met in regular session on
Tuesday, July 6, 1982 at 7:30 PM. Mayor Stock called the meeting to order.
Present were Mayor Stock, Councilmen Busse, Watkins, Thorkelson, Schweich,

City Manager McGuire, and City Planner Graser.
Mayor Stock asked everyone to rise for the Pledge of Allegiance

The minutes of June 28, 1982 were reviewed.
MINUTES
Motion was made by Watkins to approve the minutes of .iune 28, 1982 as presented,
seconded by Busse and upon a vote taken it was duly passed.
PRIOR PLACE
LI.�WR LICENSE
The first item on the agenda was the Prior Place 'request for Liquor License.
Manager McGuire reviewed the item. The Liquor License Committee recommended

unanimously to the City Council that the liquor license for the Prior Place will
be .renewed to Terry Masters. Terry Masters will be the owner and manager of the
Prior Place immediately. The liquor license has been suspended since July 1,"
1912
and will not go back into operation'unt`il the liquor license is completly
processed.

Motion by Busse to grant the liquor license to Terry Masters, seconded by Schweich

JAMES TANOBERG
VARIANCE APPEAL
The next item on the agenda was the James Tandberg °Variance Appeal. City Planner
Graser
reviewed the variance. Pam Tandber was
g present for questions and also .

she presented the Council pictures of the lot.

There was general discussion on the variance by the Council, Graser and Tandberg,.
taff and the Planning Commission recommended denial of the Tandberg for
he :reason of not being able to determine uniqueness with respect to other
roperties in the
neighborhood and the ,Zoning Ordinance 'does not result in undue
ardship.

Mayor -Stock asked :Tandberg,for comments relative,,to her position and appeal.
Tandberg stated that the lot does sf6pe up and (f they were to attach the garage
they will have to 'dI the
up ground to lay blocks. And with the variance they
could get by without the block `baying.

Graser also commented and stated that a letter from the ° 'abutting property owner

Mayor Stock entertained a'motion that the variance be denied on the basis that

no severe hardship and topography restraints involved.

APPEALING REZONING
The next item on the agenda was Jim Space Appeal Rezoning
There wis discussion on the-Rezoning Denial. by Graser, C
Space. ounci'I and Mr`.
Staff recommended to 'deny the Rezoning and investigate this issue at the time the
zoning map is to implement the comprehensive plan.

The next item on the agenda was Mr. Robert Varner request to sell tools from a van.

TOOLS
Manager McGuire commented on this item, and Mr. Varner was present to answer
questions.
There was general discussion on the Location of the sale of the tools that would take
place by the Milk Store and due to previous parking problems, it would be very
congested.

Motion by Watkins not to grant the.: request to sell to61s from the van, seconded by

Thorkelson and upon a vote taken it was dULy,passed.
At this time Councilmen. Busse asked to be - excused on the next item.

CHUCK ARHOLI
I The next item on the agenda was Chuck Arnold Variance Appeal.
VARIANCE
- APPEAL
There was general discussion with the Council, Graser and Arnold regarding the Variance'i
appeal. i
Staff recommended to approve the variance request because would not be detrimental to
the general health and welfare of the City. _ ..,.

Mr. Arnold submitted a letter from'the neighbor to the south of him to the Counc
supporting the request.

At this time Councilman Busse returned to hi's seat at the Council table.

The nett item on the agenda was to review rates for parking fines.

Manager McGuire reviewed the different fees for parking violations. The first item
is for an unexpired meter, A $6:00 fine would not be apprapiate ,due.to Prior Lake
does not I have parking meters. The second item would be.a $TO.00,fine for a no parking.j
zone. The th i rd i tem wou l d be a $20.00 f i ne for b, l ock -i ng a roadway and' the ;fourth" item
Is a $25.00 f i ne for bI ock i ng; a, f 1 re zone which would include .blocking fire hydrants and
any posted fire zones. ` Manager McGuire recommends that the three fees be adopted:
1. $10.00 for w parking zone
2. ,$20.00 for blocking ;a roadway
3.. $25.00 for blocking a fire zone,
Discussion amoung the Council was made over this item to discuss with the City En sneer
about posting no parking signs where there are narrow roads for emergency vehicles to
get through. Staff also will, review the use of Fire Lane signs.;

1. Gene Newstrom inspected Wes Hukriedes building and it does have the federal
seal for mobile homes, on the UBC seal therefor it has been den led for moving into
the community.

TKorkelson commented on the Bicyc path along Duluth.Ave. to Highway 13.
Schweich was concerned about the garbage behind the Red Owl Store.

Manager McGuire replied he has been prosecuted and he already went to court.
City planner Graser commented on Mike Benadicts property on Breezy Point Rd.,
stating that a problem has surfaced concerning tha status of an easment `
given by Mike Benadict to Esther Dose in 1974. Mr. Benadict claims that
the status of the easement is temporary and desires the City to find an
alternative route to the parcel adjacent to the Benadicts residents.
Council reveiwed some of the facts presentedby City Planner Graser including
`
letters, minutes, and conversations. Staff was directed to look into the
matter and report back in one week with their findings.

A comment from the audiance was brought to the Councils attention regarding

the signs posting on cars and vans advertising that Viking Liquor, Norling
Liquor and the B ii D Bottle Shop was open for business on Monday, July 5,
1982.
Another comment was made from the audiance regarding the ordinace for utility
sheds by IakesFie`. Questions' will be addressed to City Planner Graser.
A'member of the audi ance suggested that the Council look into prohibition
'bottles.

TREASURERS
REPORT
Motion by Watkins to approve the Treasures Report for the Month of June
was made, seconded by Busse, and upon a vote taken it was'duly passed.

Watkins motioned to adjourn the.meeting, seconded by Thorkelson and upon a
vote taken this meeting was adjourned at 9:30 PM..
