The Common Council of the City of Prior Lake met in regular session
on Monday, November 1, 1982 at 7

Mayor Stock called the meeting to order. Present were `Mayor `Stock, -
is
Councilman Busse, Watkins, Schweich, Thorkelson, City Manager Meru. re,
City Planner Graser and City Engineer
Anderson.

Mayor Stock asked everyone to please rise for the pledge of allegiance.
The minutes of October 25, 1982 were reviewed.
Motion by Thorkelson to approve.,the minutes of October 25, 1982 as
presented, seconded by Busse and,,upon a vote taken it iwas duly passed.`,

The next item on the agenda was the review of the Lakeside Marina
y paving'of the Parking Lot.

Jim Dunn ;stated to the Council that the grading has been done and
weather permitting the paving should be done this year.`
There was general discussion by the Council.
Motion by Thorkelson to extend for one week t he condition f r'�`,l
o the
blacktopping for.the driveway, seconded
by,Schweich and upon a vote
taken it was duly passed.

The next item on'the agenda was to consider the condemnation for
the access road to,the Athletic Complex.
City Manager reviewed the condemnation procedures for the Council.,
He

stated that for 4 ite some time now the City` ,, has tried.to nego -'
mate
an access roadtt \ on either side of the 'Prior Place, but the
City has not been successful, therefore he recommends
condemnation.',
The condemnation would be 50 foot strip along „ the west property
line Lot
` N,
,of 2 abutting Lot h, Block 3 Brooksville Center 1st Addn.
The length is approximately 320 feet. He further stated that the

City has made a promise ta'\the people in the Pr:"ior South neighbor- '
hood this spring when the City opened the

temporary access road,
stating that the City would have an alternative route' by the end
of this year or for sure by next spring when"the softball season,
starts. And in order to accomplish that and to carry dut
that promise
the `City must proceed at this point.

There was general discussion by Council and. Staff.
Motion by Watkins to authorize the condemnation for the access road ”
to the Athletic Complex through Brooksville Center``lst Addition
abutting Lot 1, Block 3 for the length of 380 feet,, seconded by
Watkins and vote

The next item on the agenda was to review the Bids received on the
Maintenance Building Addition.

City Engineer Anderson stated that on.November`1 1982 at 10:00 AM `

the City received tM,o bids on the Maintenance Building Addition,'
He
stated that the reason the City received two bids. was - because the
City specified that 6e addition had
to be -out of' the same material
that the existing building was so that it could match thcs- color

and shape. Two - `firms have the same t ype of material that the exist -
ing building does Lester's Inc. "R.A.

", and R.A. Nadeau Company. ;
Nade.au�Company was the Company who,built the building on ginilly.
'
Lester s Inc. was the low "bidder of $16,422.00 and R.A. Nadeau Company
of $16,935:00, Engineers estimate was $16,500.00.

awarding the bid to Lester' ', Inc.

Motion by Thorkelson to award to Lester's Inc. for the amount of $16,422.00,
seconded by Busse and upon a vote taken it was duly passed.

The next item on the agenda was the review of the Wes Green P.UA.
Mayor Stock read a letter from the City Attorney dated October 28, 1982.
Wes Green was present for comments and questions.
There was general discussion by Council and Staff.
Motion by Thorkelson to modify Mr. Greens request and to waive the park dedication
fee -until such time the first lot is gold and before the building permit i
issued; and that it applies to this subdivision because of the small size and
because of the high value of the property and it is not necessarily an exception
for all future developments, seconded by Watkins and upon a vote taken it was
duly passed.
Mayor Stock then directed Staff to review with other cities in the Metropblitan
Area the mechanisms which would help offset the cost of the developer at the time
of the hardshell on the basis of the developers agreement and see if there afire
alternatives and to report back to the Council in two or three weeks. g

The next item on the agenda was the continuation of discussion on 8 -1 -4 C and

D of the City Code referring to Dumpsters.
City. Planner Graser reviewed his discussion with the Prior Lake Refuse Haulers
with the Council.. He stated that he recommends screening of refuse containers.
Charles Henkels from Prior Lake Sanitation commented on City Planner Grasers
comments, and stated, that all refuse containers should be placed on a hard "
surface.
City 'Planner Graser reviewed the staff requests for screeening refuse containers
for the Council, they are as follows:
a. Located ' conveniently in relationship to residence.
b. The.container be placed on an elevated concrete base, a ramp of a 1% slope
or less,be constructed adjacent to the pad to allow the container to be rolled
out.
c. The container shall be surrounded by a fence or structure whereby concealing'
it from public view.
'
d. The fence or structure shall be kept,in a state of good repair.
e. If the enclosed structure has a gate that an opening shall provide in the
enclosing structure to allow ,people "to pass through and deposit refuse
directly into the containers``
f. The enclosing structure shall have a level floor.
Then City Planner Graser further statedlthe specifications for the containers:
1. At least one cubic yard in capacity
2. Watertight
3. Rodent Proof
4. Have lids
5. Must be kept, in good repair
6.° Contents of containers shall not be accessible to at least three feet above
the base floor.
7. Refuse and garbage pick -up be mandatory.
8. Refuse shall not accumulate near or adjacent to containers.
There was general discussion by Council and Staff.` It was the Council's
opinion ' that existing, well maintained blacktop would be acceptable for the base.
Motion by-,Watkins to direct Staff to submit these recommendations to the City
Attorney for drafting into an.Ordiriance_as•.an amendment to Section 8 -1 -4,
seconded by Schweich and upon a vote taken it was duly passed. }
The next item on the agenda was the review of the September's Treasurer's Report.
Motion by Watkins to approve the September's Treasurer's Report as submitted,
seconded by Busse and upon a vote taken it was duly passed.

1, Martinson's Point.

City Planner Graser reviewed the Subdivision for the Council
stating that the Subdivision meets all the City requirements

and recommended approval. ;

There was general discussion by Council and Staff.
Motion by Watkins to approve the simple Subdivision as submitted,
waiving the 80 foot requirement at the =street setback line and
contingent that the street and utility deferred assesgments would
become current and that the utilities would extend at the developers
;
expense seconded by Schweich and upon a vote taken it was duly
passed.
With no further comments, Motion by Watkins to adjourn, seconded
bbyMBusse and upon a vote taken this meeting was adjourned at 9
