The Common Council of the City of Prior take met in regular session on Monday,

April 11, 1983 at 7:30 PM in the Council Chambers. Mayor Stock called the
meeting to order. Present were Mayor Stock, Councilmembers Busse, Schweich,
Scott, Thorkelson, City Manager McGuire, City Planner Graser, Planning Con -
sultant Tooker and City Attorney Kessel.
Mayor Stock asked everyone to please rise for the pledge of allegiance.

The minutes of April 4, 1983 were then reviewed.

The next item on the agenda was to consider the Liquor Committee recommendations

from the April 6, 1983 meeting. The first item discussed was the suspension of
the V.F.W.'s Gambling and Club License. 7`
Motion by Busse to suspend the Y.F.W.'s Gambling License for 7 days starting
April 11 -17, 1983 and the Club License for l day being April 13, 1983, seconded
by Thorkelson and upon a vote taken it was duly passed.

City Manager McGuire then stated that further action would be taken on the Prior

The last item discussed was the On -Sale Intoxicating Liquor License be increased

There was discussion by Council.
Motion by Thorkelson to authorize the increase for the On -Sale Intoxicating Liquor -...
Licenseoto $1 as recommend by the Liquor Committee, seconded by Busse and
upon a vote,taken it was duly passed.
The.next item on the agenda was to consider the "NO WAKE" amendment to the lake
ordinance. Mayor Stock stated that,-Ahis amendment was for some control over
wakes during the periods of high water. A new section would be added to the
NO WAKE'ORDIN
present ordinance. Mayor Stock then read the proposed section.
Mayor Stock then opened this item for discussion.

Gordie Gelhaye was present for comments. He stated that with the amendment to the'
ordinance. and being able to set the buoys out an additional '150 feet, could help
with the -wake problem.
It was asked if it would be possible for skiers to take off from their docks.
There was discussion by Council and Staff.
It,was requested that the City designate certain tires for skiing only.
Mayor Stock then stated that on the basis of the discussion of the draft ordinance
it was suggested that there would be three changes in the proposed amendment. l)
In section "B" include the phrase about recommendation of the appropriate law ;
enforcemgnt officer and the approval of the City Manager. 2)The area of public-
ation in the local newspaper be clarified and that it be a news item rather than

a legal notice, 3)T,hat a, provision be provided for skiing from one's own dock
to the lake be approved or in compliance with this ordinance as long as they

Mayor Stock then asked: Mr. Gelhaye for prices on the two different types
of buoys. 1)The orange bouys that will be anchored at 300 feet from the
shoreline and 2)The "NO WAKE" buoys that are anchored in the channels.
Mr. Gelhaye stated that the orange buoys come in 7x2Ox9 blocks, then then

cuts them and anchors them himself, and run about $52.50 per block. The
buoys that are in the channels run about $60.00 each. These costs are:.
for the buoys only, rope and anchors would be an additional charge.

Notion by Thorkelson to approve $150.00 out of the City's contingency
fund for the purchase of the styrofoam 7x2Ox9 blocks, seconded by Busse
and upon a vote taken it was duly passed.{'
The next item on the agenda was to continue the review of the sign ordinance.
SIGN ORDINANCE
Mayor Stock asked Planning Consultant Tooker to review this for the Council.
Planning Consultant Tooker reviewed the agreement that was signed by the
City Planner and 'a representative from Sage Corporation with regards to the
signing of Brooksville Shopping Center. He then reviewed the suggested
ordinance revisions that the Sign Committee had discussed.
One change was made to the revisions, that being deleting the word VALUE
and replacing it with "COST under section "Non- conforming Signs" 5 -7 -6 0"

Motion by Busse to direct the City Attorney to prepare the final draft

amending the City's Sign Ordinance as submitted by the Sign Committee

and approved by the City Council, seconded by Scott and upon a vote taken
it was duly passed`.
Mayor Stock thanked the Sign Committee for preparing the changes to the
ordinance.

The next item on the agenda was the continuation of the Cable TV Public
CONTINUATION
Hearing. Mayor Stock called the public hearing to order. He then asked

the Chairman of the Cable TV Committee Barry Meyer, to comment. on the

committee's recommendations.
He stated that both applicants were excellent candidates and that the
committee did have a` recommendation. Either could provide the City with

a good quality system. He then stated that the committee came to their
recommendation by comparing all facts in the memorandum from the last
meeting. After reviewing the facts, the committee felt that "NORTH AMERIC'
COMMUNICATIONS" could provide a better quality service for the money.
Mayor Stock asked the;. wo applicants to make a short debate on the
committee's recommendation.
There.was discussion by Council and Staff.
Motion by Busse to direct the City Manager and the Cable TV Committee to
draft the ordinance for Cable TV around the bid of NORTH AMERICAN COMMUNI-
CATIONS'!, seconded by Thorkelson and upon a vote taken it was duly, passed.

Motion by Thorkelson to adjourn: this public hearing, seconded by Busse and
upon a vote taken this public hearing was adfdurned.

Mayor Stock thanked both Cable companies for their time and effort spent on
this project. He also thanked the Cable TV Committee for the work they had
done. H
The.next item discussed was the density transfer in Agricultural area. City

Planner Graser reviewed this for the Council. He referred to a memorandum

quarter - quarter sections. He stated that Mr. Don McKush was requestinc-�"
to do this procedure with an area on the Country Hills Golf Course.h

Mr. McKush then presented to the Council what his intentions were.
There was general discussion by Council and Staff.

Mayor Stock asked Mr. McKush to see if he could come up with something better
than transfer of density or to have some other proposal, Council was here
to listen -to it and is open to any suggestions.
RESERVATION
ANNEXIATION
The next item discussed was the annexation of"lands to the reservation. City
Attorney Kessel reviewed an article which was a case of the City of Sault
Ste. Marie, Michigan verses Andrus. The article was regarding the City and
three Individual taxpayers seeking declaratory judgment that taking of a46
acre tract which was acquired by a group of Indians and then transferred in
trust to the United States, was an abuse of discretion,. The City ended up
losing this case. s
There was discussion by Council and Staff.
3yor Stock directed City Attorney Kessel to research the "280 State" policy,
and get back to the Council. He also asked City Attorney Kessel to suggest

to the Council a type of language for proposed federal Legislation amending -
the 1934 Act to give the City an opportunity to express the City's feelings
on this.
With no other items of',business,_ motion by Thorkelson to adjourn, seconded by
Busse and upon a vote taken this meeting was adjourned at 10:20 PM
