December 12 , 1983 . The Common Council of the City of Prior Lake met in regular session on Monday, December 12, 1983 at 7, :30 PH in the City Council Chambers. Mayor Stock called the meeting to order. Present were Mayor Stock, Councilmembers Busse, Schweich, Scott, Thorkelson, City Manager McGuire, City Planner Graser, Parks do Recreation Director Mangan, Police Chief Powell and City Attorney Kessel. Mayor Stock asked everyone to please rise for the pledge of! allegiance. The minutes of December 5, 1983 were reviewed. Minutes' Motion by Busse to approve the minutes of December 5, 1983 as submitted, seconded by Thorkelson and upon a vote taken it was duly passed. The next item on the agenda was to conisder the request from Tim`And Janine - Millettefor an Ori-Sale Intoxicating Liquor License for a new establishment•in the Woodland's Edge location. Mayor Stock asked City Manager McGuire to review ' the Liquor Committee's recommendations. y City Manager McGuire reviewed the recommendations made by the Liquor Committee. It was the recommendation of the Committee that the license be approved effect- ' ive January 1, 1984. There was discussion by Council and Staff. Tim and Janine Millette were present for comments. Liquor Lic. Motion by Thorkelson to approve the request of "Tim Janine Millette for an approval for On -Sale Intoxicating Liquor License. for "7.J. Hooligan's" effective January 1, T.J.- Hoolig fis 1984, seconded by Scott and•u on a vote taken,1. was dul P duly passed,' Mr. Millette thanked the Council for considering their application and for granting the license. . The Council then reviewed the request from Mrs._JoAnn Pehrson for!an On -Sale' Liquor.;License' for "Fredd,es on the Lake. Mayor Stock asked City Manager r "cQuire'to comment on the Liquor Committee's recommendations. ` City Manager McGuire stated that this would be a transfer for Freddies on.the } Lake. , The Liquor 'Committee• recommends approval of the ,license Ito Mrs. John Pehrson and rather than requiring that she pay a new amount, the present license be transferred from Jeannie Schweich to Mrs. John Pehrson as the new manager on the license. Councilmember Busse asked if :the investigation fee had been paid. City'Managei - 44ire stated that on,,both'.licenses all :-fees' will have to be F paid before the license would be issued, ,. " -rte Aid Approval of Motion `by Busse to approve the transfer of the Lin- -Sale Intoxicating Liquor transfer to License to OoAnn Pehrson for Freddie% on the Lake, seconded by Scott, . JOAim fthrson - immediately. " Freddies. Mayor Stock stated for'- ,the record that his license would be' effective ' Police Chief Powell reaffirmed that it would be effective after the fee was received. Mayor Stock called the question on the moton.and upon a vote taken it was duly passed. '. Mayor Stock 'then took item.s`out,of sequence on the agenda. The next item reviewed by the Council was to consider the final ,contract payment n far Watzl sPoint Improvements. Parks'& Recreation'Director•Mangan reviewed this for the Council. He stated that this a formality in the grant process. The Watzl's bathhouse, shelter building was funded under the LAWCON and State Grants and part of the require - ments of that is that each of the State and federal Governments must receive = .,Council approval,for`final payment. 4 ' Page 1 z� ,.. Everything has been completed satisfactorily and Staff would recommend releasing inal g payment .and the 10% retainer. The amount comes to $7,826.79 plus the retainer fee of $3,362.32 for a total -' amount due of $11,1$9.11 payable to John. Klingelhutz. �} Final payment Motion by Thorkelson to authorize the final payment for the Watzl'spoint for Watzl''s Imrpovements and the 10% retainer fee for a total amount of $11,189.11, Point, seconded by Busse and upon a vote taken it was duly passed. f Mayor Stock then expressed -his, and on behalf of the 'Council the appreciation and commendation to the Park Director and the Park and Recreation Personnel for the work on Watzl', point and building the steps to the shelters and for ' cleaning up the pathways and the parking areas. Parks & Recreation Director Mangan then commented on the $108,000.00 - grant for Watzl +s Point that expires on December 31, 1983. He stated that we should be open for business next year. The next item was'.to consider the quote-for the Revenue Sharing Audit. Mayor Stock reviewed this for the Council. Mayor Stock stated that this is required by the State. The Office of Revenue Sharing require the City:,to have an audit of the Revenue Sharing Program every three years. The last audit of the City!s program was done )` in 1980, therefore an audit will be required for 1983. He further stated that the George M. Hansen Company has submitted their proposal of a not -to- exceed $6SO.Pal figure. Mayor Stock asked City Manager McGuire if he had any r 'cofteents further' . , ' City Manager' McGuire stated that the only comment he would have is that staff` would recommend approval'. ' , There was general discussion by Council and Staff. [ Audit, approval Motion by Scott for authorize the George M. Hansen Company for the audit of the Revenue Sharing received by the ,City of Prior Lake for the last 3 years for the sum not -to- exceed $650.00, seconded by Busse and upon a vote taken it e a was duly passed. . e� The next item was to consider authorizing submittal of the'Final Park Grant'1 ? ,Application. Mayor Stock asked Parks &'Recreation Director Mangan to rev M& �! ast council action and to bring =the Council up -to -date on the request her z this evening. Parks, &.Recreation Director Mangan stated that as a part of the o n process, � this grant project originated on March 15., 1982 and at that time the Parks I ' t & Recreation Department staff in conjunction with the,;DNR_ brought to the Council a. proposal for a DNR public access on the north end of the lake at the end of Crest Avenue. The City of Prior Lake received priority ranking for a,grant application to acquire the Zvirbulis Property adjacent °to Sand Point Beach., This application is in cooperation with the MR and the Council's request to try to acquire the Zvirbulis Property. The grant funding is cont`in- "gent ,on the City acquiring 30 foot strip adjacent tothe ±land acquired by the. , DNR for access purposes. Staff is asking for direction from the Council ' ¢ because the grant application is due on January 6, 1984. He then referred to the chart that showed the ranking of the various cities and the amounts they.are requesting and a map showing the location of the access areas. There was discussion by Council and`Staff. Mayor Stock reaff rmed, that the stipulations of our previous meeting will re- main in tact. He then asked that Director Mangan pursue swapping the 30 "strip of land as a'b,�ff,.er between lot 19 and the public access. Councilmember Thorkelson- asked, if we are directing the City Manager to pursue the,acquisi.tion of the 30 feet along with 'the submittal of the authorizing, final Grant Application`or would they be.two separate motions. City Manager McGuire stated that by applying for the grant, through final submission, we are going ahead and negotiating for the 30 feet. Resolution Motion by Thorkelson to authorize through Resolution 83 -37 the submittal of 83- 37;0inal the final Park Grant Application for the Zvirbulis Property at Sand Point f Park Grant Beach, seconded by Busse. " Application. ° Parks & Recreation Director stated that the grant proposal is a 3 year proposal, it would be effevice until early in 1984 to 1987. Mayor Stock called the question on the motion and upon a vote takers "it was a fiI duly passed. Mayor Stock then introduced and welcomed the Mayor of Shakopee Eldon Reinke and the City Administrator John Anderson. He stated that they have requested some. time on the agenda to discuss some of the potential interest we have since our City_Borders, are overlapping to Shakopee Mayor Reinke `thanked the Council; for letting them come over and speak, with the Council. He thanked the Council for the action that they took on supporting the race track proposal in Shakopee. He then spoke in regards to the Indian Reservations and. the activities that are going on and what they are proposing. J` . City Administrator Anderson also spoke to the Council regarding the reservations. 9 9 There were.comments and questions by Council and Staff. City Attorney Kessel commented to the Mayor and City Administrator<of'Shakopee. There was further discussion by Council and Staff. ' Mayor Stock thanked the Shakopee City officials for coming out and speaking �...,` } with the Council. ` The next item on the agenda was to review the status of the Bart Porter House f' Mdve . Mayor Stock City Planner Graser to review his observations in regards to the compliance to,the permit and the conditions that were set by the City Council. „ a City Planner..Graser stated that on November 22,'1983 „Council` gave an extension to'*.'Porter for the completion.of`the house move, the extenslon came in a 3 phase approval. He was to complete all exterior clean up = grading, backfilT and have the basement poured by December 9, 1983. The interior was to be completed by April 15, 1984 and.any' additional exterior work such as black - topping, sod, etc. was to be completed by June 15, 1984. He further stated 'that he made an inspection this afternoon and the exterior work'was'not� completed. '- The house was not•`bac*filled but the situation is that the winter caught up with Mr. Porter. 'Anyone -would be in the same predictiment. It is not the.fact,that J he does not want to complete,it, it is the elements that are working. against Mr. Porter or anyone else trying to complete the house. Mr. Porter is trying `. to.get the frost out of basement, trying to pou* house,.trying to back - _° fill and get the exterior completed so that he can work on the inside and complete the interior work. He,further'comnented on'the conditions of the house and the elements that are keeping, him from complying "with the contingencies. He then stated that it would'be his recommendation at this time to give Mr. Porter =the extension as the conditions and the weather allows. Mayor Stock commented to Mr. Porter. Mr. Porter was present to respond. There was general discussion by Council, Staff and Mr. Porter. Exte for Motion by Thorkelson toauthorize the extens ion "of the exterior work on the Bart Porter basis of City Planner.Graser s recommendation and that it be completed by April 15, 1984 on all items that were due on December 9, 1983, seconded by Busse. CityAttorney Kessel stated that he was concerned witha. potential, liability situation to the City if we grant this extension if It is dangerous to children, and the backfill does not occur until April 15, 1984. Councilmember Busse asked Mr. "Porter when the floor would be poured. ; ;l Mr. Porter stated that they hoped It would be done by Wednesday v J : Councilmember Busse stated that a new condition should be given, Mr. Porter would be given one to two weeks to complete that portion of the exterior work. Councilmember Thorkelson accepted the following as an .amendment to the motion. "The extension for the laying of the floor and the backfilling be ~i granted - a , 2,we'ek'extension from today ". Councilmember Busse also accepted this amendment to his second. ' Mayor Stock called the question on the motion'and upon 'a Vote taken it "was duly passed. r Mayor Stock if there was any other business needed to be taken care 'of. Councilmember Thorkelson asked about the condition of th6,streets and wha#O is going to be done to improve them. i CityiManager McGuire commented on this. ` It was asked:.that the snow be removed from the major intersections. Councilmember Schweich commented on the number of liquor licenses that the City of Prior Lake is authorized to give out.' r City Manager McGuire :stated that the'State regulates the amount of licenses although the City could pass a referendum allowing for more if the right type' of business was to come,into the City. d „ a.
