Mayor Johnson called the meetingfo order. Present were Mayor Johnson Councilmembers Busse, Se!h'e ch, Scott, Thorkelson, City Manager McGuire, City Planner Graser and City Attorney Kessel. Mayor Johnson asked everyone to ple epe rise for the pledge of allegiance. The minutes of March 5, 1984 were : :ev.iewed. The following corrections are to be made`to the minutes of March 5, 1984. ' Page 2, Paragraph.10 -' INSERT 5)Only 1 single family home. will b,e allowed on', Lots 5 &6, Block 5 and only l single family home will be allowed on Lots '7 &8, Page 2, Para ra h' 10 Block 5. g P . The next item on the agenda was to consider the Burger King Prelimi- nary Plat.. City Planner Graser reviewed this for the Council. -, 111 He stated that the Planning Commission held a Public Hearing on this onj Feb ruary 16,1984 at which time this application was consid- ered. . 'r� The ecommendation of the Rlanning�_Commission was to approve the subdivision with 7-contingencies. (The tape is the legal record of the meeting and will be kept on file in the City Managers Office). He then reviewed Staff's memo dated February 13, 1984. He stated that it would be Staff's recommendation to approve the preliminary plat. i The representative for Burger King was present and commented. ; There was discussion by•Council_and Staff. R After further discussion, motion by Thorkelson to approve the ,it Conditional Use Request: for burger King contingent upon the comp- i liance of the Planning Commission's contingencies, seconded by Scott and upon a vote taken it was duly passed. Mayor Johnson then called the Road Vacation Public Hearing to , E a order. City Planner Graser reviewed this for the Council. hlr. Bryce Huemoeller was representing Mr.`jim Dunn.' 'He commented to the Council regarding the vacation. � w City Planner Graser stated that the applicant is req�iesting a road and alley vacation for Eighth Street north of Center toad and all of the alley in Block 22. lie further stated that if Eighth Street was vacated, Lot l owned by the County could be landlocked. He stated that a few years ago the City' adopted _a policy not to vacate any streets intersecting with Prior and SpringI Lakes. , He stated that it would be Staff's zecoatmendation to ego ahead and vacate the alley, but keep Eighth Street as a public right- of-way. Council was concerned over the possibili•cy or' landlocicing the lots. Council reiterated the Council's policy that was set a q few years, ago.,, After further discussion by Council, Staff and Mr. Huemoeller, Dzfi motion by Busse to deny the request because of the potential of the Scott County lots being landlocked and Council's policy on i{ not vacating any streets intersecting with Prior and „Spring Laces, seconded by Thorkelson and upon a vote taken it was uly. passed.' City Manager McGuire read for the record the legal notice that was published in the Prior Lake American. _I Motion by Thorkelson to adjourn the Public He ring seconded by Schweich and upon a vote taken this Public Hearing, as adjourned at 8:54 PM. Mayor Johnson then called the Road Vacation Public Nearing for Burger Xing to order. The published notice was read for the record. City Planner Graser reviewed this for the Council. He stated that Burger ' King Corporation has petitioned for' / the vacation of 33 feet of'roadway acquired through use located!'adjacent to the westerly property line of the parcel being subdivided. The .roadway easement Baas acquired through use dating back many years. State law.established a 4 rod road easement over a traveled or used road. Many County road easements were acquired this way. Motion by Thorkelson to approve the Road Vacation by adopting Res. 4-05 - Resolution 84 -05, contingent upon the property owners grant to BMWKiV9 the City the 20 foot utility easement and that the property owners Road Vacatic rl be responsible for the maintenance and replacement of the easemer seconded by Busse and upon a vote taken it was duly passed. Motion by Busse to adjourn this Public Hearing, seconded by Scott and upon a vote taken this Public Hearing was adjourned at 9:05 PM. The next item on agenda was to consider the option agreement for the Industrial Park. City Manager McGuire reviewed th�_s for the Council. He stated that this would be a portion of the old Kopp Farm. He made further comments on this'. r x There was discussion by ;Council and Staff. The next item discussed was Resolution 84 -04, Government Aid Form i. Mayor Johnson read this for the record. City Manager McGuire reviewed the purpose of the resolution. - There was general discussr;on by Council and Staff. RW- Motion by Busse go adopt Resolution 84 -04 recommending that the GWti Aid FbnR State of M nnesota -Lpca1 Government Aid Formula be frozen for Fiscal fear 1985, seconded by Scott and upon a vote taken it was dulw-passed. f _ y ,t r Johnson asked if there was Any other business that needed t / to) be d -i us'sed. City At'corney Kessel commented on the letter that was received i' regarding the placing of the "Plain Truth Magazine" newstands throughout the City of Prior Lake. It was the consensus of the Council to find out more about where they would like to place the newstands. Mayor Johnson asked that City.Attorney Kesse.l return the letter'' ',. and Staff would handle it. j City Manager McGuire reviewed an amendment to Ordinance 83 -05, Signs. He read the area of ;the ordinance that "would need the amending. The amendment stated that the Council ' and /or Staff would set the fees for the Sign Permits. r There was discussion by .Council and Staff. ord_ " A■md Ord. Motion by Scott to adopt Ordinance- 84 -04 , an ordinance amending 83-05 Ordinance 83 -OS, seconded by Busse and upon a vote taken it was duly p assed.
