September 1.0, 1984 The Common Council of the City of Prior Lake net in regular, session on Noonday, September 10, 1984 at '7:30 PM in the City Council Chambers. Mayor Johnsen called the meeting to order. Present were Mayor Johnson, Council- members Busse, Schweich, Scotia, Thorkelson, City Manager McGuire, City Planner Graser and City Attorney Kessel. Mayon Johnson asked everyone to rise for the pledge of allegiance. Council reviewed the minutes of September 4, 1984. Wmutes Motion by Busse to approve the minutes of September 4, 1984 as presented, seconded by ;Scott and upon a vote taken it was duly passed. The first itern of the agenda was a variance appeal by Craig Woodson. Planner i Graser reviewed this for the Council. I) City Planner Graser stated that Mr. Woodson appeared before the Planning Conudssion on 8/2/84 requesting an eight foot side yard variance. The „ reason for the variance is to construct a walkway at the garage roof elevation to continue to have easy access to the rear of the dome hone on Sunset Trail.: The proposed addition. on top of his existing garage will eliminate his rear yard access (lakeside) unless an additional walkway is constructed; " Mr-. Woodson returned to the Planning Commission on 8/16/84 with a revised plan requesting a five foot side yard variance. City Planner Graser stated that the Planning Commission continued the variance request from the August 2nd meeting to the August 16th meeting and took the following action. "To deny the five foot side yard variance J for 17164 Sunset Trail SK since no hardship can be found and the property is not unique with respect to similar lots in the area ". Commissioner w Loftus 'voted nay. City Planner Graser then stated that it would be Staff's reccumendation _ to deny this application since no hardship can be found and the property ' is not unique with respect to similar lots in the area. Mayor Johnson asked Mr. Woodson if he had any comments. Mr. Woodson stated that City Planner Graser had covered the request,. very : well. - He further stated that the request is for „a variance to provide an ease of walkway for individuals to go from front' to back once they have ,reached the main entry-. To require them to descend the steps and r walk around the back at ground level would be hazardous because the elderly , would be required to walk dam an excessive flight = of „steps when they could conveniently remain at one level. In addition, he stated that he Believed this' variance would 'aesthetically improve the property versus any, negative effect 'to the neighborhood. Mayor Johnson asked Council for their comments. { There was a general discussion by Council and Staff, Craid WOOd After further discussion, motion by Schweich to approve the 3 foot variance ` Variance and that the portion of the walkway be cantilever, seconded by Busse'. f There was further,discussion. Mayor Johnson called' the question on the notion and upon a vote taken it Was duly passed. Vt The next item on agenda was _a variance appeal by James Cates.,. City Pl,inner Graser revecuea this item for the Council. City Planner Graser,stated that the applicant is proposing a 20 x 26 foot . garage five feet frJu his rear property line. He stated that Mr. Cates , has ' "i3 15,000 squarer foot R -1 zoned lot with an existing hone and single car attached garage The subject site is well maintained and landscaped with a;, garden and several fruit trees towards the rear patio. >. 1 Y }} .y ry .. The applicant has stated that if the garage is located in the center of the rear yard it would destroy the open space and existing plant material.: The adjacent lot to the west or rear of the subject site is also zoned R -1 but fronts on Pleasant Avenue and is extremely deep. To the west of that is R -3 and R -2 property. The subject site has no topographical restrictions or other natural impediments restricting development. It does not appear a hardship is involved in this case. There is nothing unique about this property with respect to the other lots on Albany Avenue. City Planner Graser then stated that the Planning Commission took the -` following action on this request. "TO deny the variance as requested but approve a 7 foot rear yard variance for James Cates at 16390 Albany due to drainage, terrain, and limited design alternatives ". He further 'does stated that it would be Staff's recommendation that this situation `'not warrant a variance. The hardship in this case was caused by the applicant and is not a result of unique circanstances with the property ; - "He further stated that this application should be denied. ✓' Mayor Johnson asked Mr. Cates if he had comments. 1 , Mr. Cates felt that he did have a hardship and commented. to the Council. J rear yard set- backs. Mr. Cates commented to the Council on this. Mr. Cates felt that the City's set -backs are too strict and that the Planning Commission `and City Council should be more lenient with °the granting of should variances /set back requirements. He also felt that the public be made more aware of the restrictions. He thought that the City should hold - -a public meeting informing the residents of all the requirements. There was a general discussion by Council, Staff and Mr. Cates. It was the consensus of th "Council that this 'should be scheduled through the Planning Carzn ssion, making the necessary amendments /additions to the'Zoning Code and then bring it back before the Council. : There was further discussion by Council and Staff. Mayor Johnson directed City Planner Graser to schedule a public meeting -at which possible changes :and resident input to the Zoning code (set -back requirements /variances) could be reviewed. =- "The next item on`the agenda was to review Ordinance 84 -14 regarding Livestock. Intern Marty Schmitz reviewed this for the Council. Intern Schmitz stated that essentially what the Livestock Ordinance says is that in order to .keep livestock in the City, the owner must have a minimum of 10 contiguous acres, or for commercial horse boarding, training U38 Ord. or breeding facilities the minimum acreage requirement would be 20 contiguous kdml acres. Right now the ply ordinance governing the keeping of livestock , in the City states only that the livestock must be suitably fenced. Until now it has not been a problem but with the race track, the increased interest -in horses makes this ordinance necessary. This ordinance is in no way designed to affect the larger farms, it only sets minimum acreage require - ments. This would benefit they people living around these small hobby , farms and also improve the overall appearance of -Prior Lake. `? x ;, There were comments by concerned residents in the audience. r Council and Staff also commented on this draft of the ordinance. The next item on the agenda was the review the Woodview'2nd Addition Hardshell'., for Len Grassini. City Planner,Graser reviewed this for the Council. i City Planner Graser sated that Staff has examined this plat and has deter - r mined it to be in substantial campliance with the preliminary plat. Counclmesber Scott stated that the Chamber of Ccmnerce is considering " placing approximately 4 °Welcane to Prior Lake" signs with the City.
