The Cammon Council of the City o Prior Lake met in
y regular session on Monday,.

October 15, 1984 at 7:30 PM in the City Council Chambers. Mayor Johnson
called the meeting to order, Present were Mayor Johnson, Councilmembers
Busse, Schweich, Scott, Thorkelson, City Manager McGu City Engineer Ander-
son, City Planner Graser, Finance Director Teschner and City Attorney Kassel.
Mayor Johnson asked everyone to rise for the pledge of allegiance.
Council then .,reviewed the minutes of October 9, 1984. Mayor Johnson asked if
there were any corrections that needed to be made to the minutes of October 9th,

Motion by Scott to approve the minutes of October 9, 1984 as presented,

seconded by Busse and upon a vote taken it was duly passed.
The first item on the agenda was to consider the removal of three structures.
City Planner Graser reviewed this for the Council.
City P-lanner Graser stated that there are three ''structures' located in Prior
Lake that he is requesting be removed. The three structures are as follows:
Cabin Richard & Eileen Schmitz : Lots 14 -16 Point Beautiful
Single Family Hone Mr. & Mrs. Iowan Farnum 5210 Credit River Goad
Mobile Home Mr. Richard Miller Lot 9, Seven acres

After further discussion by Council and Staff, motion by Thorkelson to direct

City Attorney Kassel to notify each property _owner , of the various State /City
Health, Safety and Fire Codes and to give them a reasonable time' frame `to have
the structures removed from the precise or the City will tike legal' action to
have ahem removed, seconded by Busse and upon a vote taken it °was duly passed.

Mayor Johnson then asked that items rnmber 4 a 5 tie delayed on the agenda so

that the Public Hearing that was scheduled at, 8:00 PM. could be taken at this
time.

Ma}wor Johnson then called the Industrial Revenue Bonds -° Bank/Medical Center
Public Hearing to order. He asked Finance Director`Teschne: to camnent on this:

facility., He reviewed the size of 'the proposed building and the various' uses
of the space. He further stated that the City's financial consultant, Steve
Mattson reviewed_this;opplication and recarmended the support of the City.., He
stated that, one key consideration for Council concern. is that the City of
Prior Lake must participate in a very ccgxtitive� pail: Approximately $40

million dollars > in - I.D.B.'s are available for all non - entitlement` cities in
the State of Minnesota. This pool is distributed )lased upon a numerical
ranking of 19 points. He further stated that Mr. Bob 1arsness was present for

any additional questions /comments.

Mr. Barsness camnented to the Council regarding the tT dated site plan that he
handed out. He further camiented.
Mayor Johnson asked if there were any further questions or camients fran the

It was the consensus of the Council that this was a good project and a muc
needed one at the proposed location.

After further discussion, motion by Thorkelson to approve Resolution 84 -25, a

resolution giving preliminary approval to a project under the Municipal

Development Act; referring the proposal to the Energy and Economic
Development Authority for approval and authorizing preparation of necessary
documents, seconded by Busse and upon a vote taken it was duly passed.

Motion by Scott to adjourn the public hearing, seconded_ by Thrkelson and upon ,
a vote taken this public hearing was adjourned at 1-20 PM.
Mayor Johnson then asked City Engineer Anderson 'n' to comment on Item #4,
considering the amending of Council Policy on Plastic Pipes.
City Engineer Anderson stated that he has received requests to ,consider

allowing the use of plastic sewer pipe in ,lieu of cast iron for house
services. He further stated that the City has been using P.V.C. for sanitary
sewer mains since 1982. At that time the Council adopted a policy that all
services should be cast iron to prevent holes from being. cut in the pipe by
companies using cleaning tools. He stated that other municipalities have not
experienced this to be a problem, with most allowing the use of plastic pipe
for services.. He further stated that it would be staff's opinion that plastic
piping would be better than cast iron becuase plastic would tend to bend with
out, breaking more so than cast iron when improper foundations are used. -

Motion by Busse to amend Council's policy allowing the use of plastic pipe in

conjunction with the State Plumbing code, seconded by Schweich and upon a vote
taken it was duly passed,

The next item on the agenda was to consider request for a change of a platted

street name. City Planner Graser reviewed this for the Council.

City Planner Graser stated that he had received a request to change the name'
of., a segment of Conroy Street NE to Greenway Avenue NE.- This segment would be
from e0ounty Road 42 South to a point where the street is zpredcminantly east`
andx` west. He further stated that no existing- addresses would have to be
changed if this was _allowed and that staff would have no objections to this
proposal since it would not affect any existing addresses and is ronsistant
with the Cities system.

Mr. Wes Green was present,for comments.
After a general discussion by Council and staff, motion by 1 orkelson to

to Greenway Avenue NE, seconded by Busse and upon a'vote taken it, was duly
passed.
The next item on the agenda was to =nsider a concurrent agreement on the:
change of the Watershed District Boundaries. City Manager McGuire and Mr. Don'

Benson cammented on this.
Don Benson from the Prior Lake /Spring Lake Watershed District stated that.the
request was -to change the boundaries of the Watershed District. He reviewed

the areas that would've added to the boundaries and the section that would be
deleted.'
There was a general discussion by Council, Staff and Mr. Henson.

After a discussion, motion by Scott to authorize the Mayor and City Manager to

enter into the concurrent agreement„ with the Prior Lake /Spring" Lake Watershed
District
District amending the District Boundaries, seconded by Busse and upon a votE°

The next item on the agenda was to consider a variance appeal from Jeff White,
City Planner Graser reviewed this for the Council.

City Planner Graser stated that this was presented before the Planning

Commission on 9/20/84 with the following recommendation.

After a lengthy discussion by Council, Staff and the affected property owners,
Council continued this item until November 12, 1984 and drect: City Attorney
Kessel to draw up a possible agreement.
The next item on the agenda was to consider Resolution 84 -24, Regarding the
Scott /Carver Economic Council. , City Manager McGuire reviewed the resolution.

City Manager McGuire stated that before the Council was a resolution requesting

the Counc to cons ider' s upporting the "GIVE WHERE YOU LIVE" C ampaign and
encouraged local residents and businesses to donate to this cause that
provides needed,services to our community.
