March tj 1985, at 7:30 PM in the Ci y Council Chambers. Mayor Johnson called the &#eking to order. Present were Mayor Johnson, Councilm#mbers Busse, Schweich, Scott, Thorkelson, City Manager McGuire, City Engineer Anderson, City a Planner'Oraser and City Attorney Kessel. zt Mayor &ohnson asked everyone to rise for the pledge of allegiance. The minutes of March 4, 1985 were reviewed by Council: b Motion by Thorkelson to approve the minutes as presented, seconded by Busse and upon a vote taken it was duly passed. The first item 'on the agenda was to review the Park Avenue Townhomes P.U.D. k 'l Counciimember Schweich loft the Council table at this time, �A i Ci y'Pl ;Hoer Grazer comen.ted on the P.U.D. He stated that he had not with COT Properties to negotiate on the Landscaping Plan and the Play Aroa issues that were talked about at last week's meeting. He reviewed a memorandum from Staff suggesting the various types of trees that should be considered for screening r .' and also the play area /equipment. 'Schweich Mayor Johnson asked Mr. it he had any comments. Ted Schweich commented on the recommendations made by Staff regarding the type of trots that were specified for screening and also the play ground area. Cy Schweich further commented on Ted's comments. Thor* was a lengthy_ discussion ey Council, Staff and COT Properties. City Planner Oraser reviewed this for the ' Council. z 4 (3 xry - City Planner Graser stated that the applicant is requesting a varianct from the Sign Ordinance to allow him to use 2 window boxes as a location for signs f advertising specials and other current price promotions. He stated" that Mr. Casey feels that it is a hardship on him not to be able to advertise special prices for liquor products on his east facing wall, Liquor stores are forbidden by State lair to advertise their prices in papers ; or other periodicals, City Planner Graser fur +,,her stated that according to ,Mr. Casey this would advertising to the ' public that his store is open and would inform the public of special. liquor p,'rices - Mr, Casey feels that his liquor store has no window space and that hid existing shadow boxes are attractive and closely resembles windows. City Planner Graser then stated that it would be Staff's recomm*ndati -in to deny tht re,ques't since it would be establishing a dangerous precedent whi'oh would set an i_rkovrrsiblt trend that would not only apply To liquor stores but to other rttaiV businesses as well, G Mr, Casey then commented on why he felt that this request should be granted., r There was a 9, neral discussion by Council, Staff and Mr. Casey. Aeque�t After a lengilh,y discussion, it was the consensus of the Council that this item should be brought back on April 1, 1985 at 7:33 PM and that Staff should look IF Di& ON" into the ordinance to see if the ordinance is to,restrictivt`or not restrietivo enough, { " Mayor Johnt;'on then called a recess. The motting was called back to order at 9:40 PM. The next item on the agenda was to consider the Developers Agreement for, Sand Pointe 4thuAddition. City Enginter Anderson commented on this. +` City Engineer Anderson stated that Sand Po me 4th Addition was given hard sholi approval on June 20, 1983. He stag *d that Phase One of this development' which was the northern portion of the plat was completed last year_ The dtvolopor is proceeding to Phase Two which is the remaining lots north of CarriaSt Hill load. He then showed the Council copies of the plans and specifications. 'DwaU I S Motion by Thorkelson to approve and enter into the Developers- Agreement for Sand 1 I Addition 4 Pointe 4th seconded -b Schwli h y c and upon a vote taken it was duly A„ 'c PAM== ,t passed: M1sl The next item on the agenda was to conjsider the extension of the completion date for Cully's,on Prior Lake., City Plannitr Grazer commented on this, Mr. Dick'Busse asked that Councilmei`ber - Schweich excuse' himself from the Council. �Y Councilmembcr Schweich staged that he would° abstain ��from any discussion - or decisions made on this item but would stay at the Council - table. City Plan Jmer Graser stated that Mr. Fred Schweich purchased Cully's. Restaurant from John Schumacher who obtained a conditional usit permit on 614/84. The permit allowed the expansion of the restaurant in p,hase,s; in accordance -with - specified other on -site improvements. Several of the sJ'Apulated items have not boon complotkd and Mr. Schweich is requosting an extension until 8/31185. The }' lst phase expansion added 700 square foot of bar spa "ce in the basement and ground levol' :'dock which was completed in the summer of 1984` The lower level expansion tri`.ggered the following required on -site improvements: 1) Improve upper ,parking lot to include landscaping, b;,lacktopping, curbing r: and r more than 8 parking spaces, 2} Screening of trash containers. 3) Landspaping and retaining walls adjacent to east side of building:" 4) Lowrr, tovel parking )ot must be graded and improved to a dust frog surfaf4c. He further stated that Items 1,2, and 4 have not been completed by the Council ` stipulated date of November 31, 1984. According to the Prior, lake City Code, if the improvements have not been completod, the Conditional Use Permit shall' be rovoked and the lower bar closed to the public. He then stated that it would br Staff's recommendation that a reasonable extension be g�.ranted due to the circumstances r Mr. Dick Busse commented against the extension of time on this' item. Mr. Fred Schweich commented on h(is intentions for the improvemei'its.
