Mayor Johnson called the meeting to order. Present were Mayor Johnson, Councilmembers Busse,` Schweich, Scott, Thorkelson, City Manager McGuire, City Engineer Anderson, City: Planner Grater, Parks d Recreation Director Mangan, Building Inspector Staber, Finance, Director Teschner and City Attorney Kessel, Mayor Johnson asked everyone to rise for the pledge of allegiance, The minutes of April 8, 1985 were reviewed by Council, Councilmember Scott commented on the minutes. She asked that a paragraph be reworded. "The DNR will only approve $31,750.00, which- is 25% of their appraisal ". Mimbes& M otion by Busse to approve the minutes of April 8, 1985 as corrected and the IellOdoES list of 'invoices scheduled for payment on Tuesday, April 18, 1985, seconded by Scott and upon a vote taken it was duly passed. The minutes of a; Special Meeting held on March 27, 1985 were reviewed by the Council. inib s of Spec. Motion by Schweich to approve the minutes of March 27, 1985 as submitted, 1� seconded by Busse and upon a vote taken it was duly passed. 1 The next item on the - agenda was to review the requirements for a "Certified Survey ". City Graser and Building Inspector Gary Staber commented on this item. 6 . City Planner Graser stated that he understood that Mr. Lawrence Schweich came_ before the,, Council last Monday and objected to the recently instituted survey requi ements for building permit applications. Mr. Grater stated that he felt that these requirements save the consumer' dollars in the long run and consequently result in ; a better product. He then stated' that the new requirements were implemented shortly after Gary Staber, the Building Inspector started, Prior to the new! >equirements builders could stake their own home and draw 'it� on the survey. As a- result the city was not furnished with lot elevations, finished floor elevations, drainage indications, and many times out of scale home locations on the'survey. He then reviewed three typical "surveys that have been submitted for building permits_. Two of the surveys were prior to _the new r gulations and one is after, He further commented. There was a lengthy disci by Council, Staff, Mr. Lawrence Schweich, and the d. ;people in the audience, s� � T t u Mayor Johnson stated that there is a public hearing scheduled for 8 :00 PM and that this item would have to be continued after the public hearing. i Mayor Johnson then called the Revenue Bond Request Public Hearing for Priordale Shopping center to order, Finance Director Teschner commented -on this, t Finance, Director Teschner stated that the ur ose of this p p pul< ;lie hearing was to i consider Revenue Bond Financing for the Priordale Shopping Center. He stated that the purpose of the financing would be for renovation work done to the shopping center, He then reviewed the application., Dick Riley the representative from the Priordale Shoppingi Center commented at this time, y' c , f Mayor Johnson asked if there were any comments from the audience, There was a general discussion by Council, Staff and the audience. Rev' farTkIardaU Motion by Thorkelson to issue preliminary approval on the Commercial Revenue Financing for the Priordale Shopping, Center in the amount of (500,000.00 cam= ,contingent upon staff and the developer working out a traffic plan for the entire area,, seconded by Busse and upon a vote taken it was duly passed. Motion by Busse to adjourn the public hearing, seconded by Scott and upon a vote { taken this public hearing was adjourned. Council, Staff and the audience then continued the discussion on the required t �3urveys for building permits. I Cjeriied SzvWs After a lengthy discussion, motion by Scott to support staff's policy requiring - fpr certified surveys for building permits, seconded by Busse. Counciimember r Rxtuts ' FAXpdXMWOr&Schweich_ abstained from voting, and upon a vote taken the motion passed. The next item discussed was the amendment to B -1 Zone regarding auto repair, City Planner Grazer commented on this item, r l City Planner Graser reviewed a memorandum that was sent to the Planning f° Commission regarding the definition of auto sales, service and repair. He stated that several weeks ago the Planning Commission held a public herring on a zoning amendment that would introduce aut!p sales, service and repai! as a conditional use,in the B -1 limited business district. He stated that there are two recommended definitions to be considered /added to the Zoning Code, they l were; 1) -- 1ri<g�gDl_ERpaiEr - shall mean general repair, all body work, painting, framework, replacement of engines and transmission on cars and trucks, ' 2) �1ptQg►q�j ;j<, l�lII3� - shall mean the replacement of any part or ' repair of any part which does not require the removal of the engine, engine head or pan, transmission or differential; upholstering service, glass replacement, lubrication when said service as stated above is G applied t passenger automobiles and trucks not in excess of a Q ' three - quarter ton rating. T 4 He then stated that both major and minor repair should be permitted in the` B -2 k and B -3 Districts. The B -1- District should be limited to minor repair as a i conditional use and the B -1, B -'2 and B -3 zones should include fuel stations and convenience stores as _a permitted use. Mayor Johnson asked if there were any comments regarding this item. n l After a Lengthy discussion by Council, Staff and people in the audience, Mayor i Johnson directed Staff to look more into the amendment/ordinance and bring it back before the Council at a Eater meeting, t _ Mayor Johnson then called a recess. The meeting was calked back to order at 10 :05 PM. s t The next item discussed was the buildability of Lots l and 2, North Gzainwood. Ci'y Planner Graser commented on this item. City Planner Graser stated that he had. received a letter from Loren Gross, Attorney in behalf of John Johnson and Rhoda Beckon, owners of Lots 1 d 2 North I Grainwood. He stated that they requested an opinion from the City Council as to the prospective development,' x 'City Planner Graser stated that he had discussed this issue with Mr. Johnson and felt that both parcels should be combined to farm one buildable 1 - ot. Mr. t om' Johnson related to City Planner Graser that combining the tots was not possible f because his purchase price was predicated on the two buildable "lots. City - Planner Graser then stated that that it is quite obvious that whether the lots are combined or developed individually they will require substantial variances. Mr, Johnson does not at this time have a development proposal but would like an opinion from the Council that a building envelope and development will be ; considered for each lot, if each proposal recognizes and addresses the 1 constraints of the lots and is consistent with previously approved developments on small lots. He then stated that he believes there are two questions that I" must be addressed First, what obligation do we as a City have to permit reasonable development for each lot, and second, what is the minimum lot site that can be developed and still maintain the general health and welfare of the City: t , , City Attorney Xessel commented on the two questions that City Planner Graser had s brought up for discussion. He made further comments regarding this issue.I Mr. Loren Gross commented on behalf of Jon Johnson, and Mrs. Beckon. Mayor Johnson then asked Council for their comments. Council and Staff further covmented. The next item discussed was the feasibility report for the extension of Erie Avenue, City Engineer ..Anderson commented on this. City Engineer Anderson stated that Klingbergs have requested a building pezmit - for lot 2, block 8. He stated that Klingbergs were told that since this roadway was unimproved, he would be responsible for improving it. He then reviewed the r feasibility report-, The estimated cost of the project would be $46,433.88 :based Y on 1986 costs. The cost would then be assessed`onto three parcels at .a equal cost of $15,377.96 per parcel. He then stated that all property owners are not in favor of this improvemeni. It was the ;consensus of the Council' to accept the 'report as submitted with no vt action taken. There were frther comments by Mrs. Klingbezg and Council. # F The next item on the agenda was to'consider the Preliminary Plat for Hidden Oaks 2nd Addition. City Planner Graser commented on this,. Finance Director Teschner commented on this item. City Manager McGuire commented on this, Cit'y_Manager McGuire stated that Staff has already received numFrous calls for a } place to dispose of lawn rakings, tree limbs and other debris. He stated that as in" t'h, past Staff is recommending that a disposal site be established to fanilitat.e "Clean Up Meek" for the residents of the Prior Lake, He stated�� that this year Staff is proposing that the upper parking lot at Lakefront Park be the site. The site would faciliate Staff cleaning it up when the time is r E' over, He then stated that Staff would recommend t h &A the Council establish April 27 through May 12 as "Clean Up Meek" and - encourage the residents to use t, the temporary disposal site at Lakefront Park to dispose o- their debris. There was a discussion by Council and Staff not having a burn site at,all. (DID Motion by Thorkelson to establish April 27th - May 12th. 1985 as Crean -Up week; without a burn sight, seconded by Busse and upo., a vote taken it was duly r QenvVp Va& passe City Manager McGuire then commented on Arbor Day. He stated that Arbor Day is approaching fast.for this year and Staff would recommend that the same prograe be made available as last year. He stated that on Arbor Day, April 26, a_member of the Parks'Department wilt' be: at Memorial Pfrk and have shovels available'for ? anyone who may want , , a to plant a tree as a memorial There will, areas de3ignated with stakes that} people would be able to plant a trot. By next year, i a the City should be able to `sell trees to the residents for planting.
