the - procedure used to determine the assessments and the three options available
for payment of the assessment.

Discussion was then opened to the audience regarding construction questions.
0oncern was expressed thae because of the Latter road conditions, traffic speeds
have increased causing a safety hazard. Mayor Johnson indicated 30 MPH speed
limit signs would 'be: posted off-Lakeside Avenue,

The public hearing = Project No. 85-11, Street Overlay, was called to order by
Mayor Johnson at 8 %5'7, pm. ;Mayor Johnson explained the procedure to be followed,
during the public &;snag and then read the public notice °for the record as it
appearead in the August 12, 1985 prior Lake American.

Mayor Johnson then read a letter from the legal counsel of Richard J.`Menke

imli his objection to his assessment for the record.
Discussion by the Council followed.
Finance Director Teschner recommended the following amendments to the roll:

Motion was made by Thorkelson, seconded by Scott, to adjourn the public hearing,

and upon a vote taken was duly passed.
Discussion was then opened to the audience for questions regarding construction
of the project. Several comments were made about the independent contractor
regarding - damage to curbing, unsatisfactory work, early morning disturbances,
and slowness in completing the project. City Engineer Anderson indicated that
the contractor has to make repairs for all damages and do the work to the City's
`
satisfaction. Residents needing repair work done or having work done
unsatisfactorily are to contact City Engineer Anderson.

A fifteen minute recess was then called.
Mayor Johnson called the meeting back to order at 10:55 p.m.
The next item on the agenda was to continue the discussion on the Willow :Beach
Storm Sewer. City Engineer Anderson indicated that he met with a group of
neighbors in the area on August 22, 1985 and that they would report on the
results of the meeting. Charles Garetz, acting as spokesman for the
neighborhood group, indicated that Richard Menke and his legal counsel were
invited to ;attend the meeting, but neither one was present. Mr. Gare -0 read a
statement from the group for the record indicating they felt the problem could
be solved internally by Mr. Menke or if the Council chose Alternate 3 (running
tkm pipe to Sycamore Trail to County Road 12) then Mr. Menke should be assessed
a substantial portion of the cost of the project.
Mr. Rod brass, legal counsel for Mr. Menke, then addressed the Council. He
indicated that Alternate 1 2 or 3 would be acceptable to his client and that
this problem should be resolved by the Council and not by a neighborhood group.
Discussion was opened to the audience and comments were made. Discussion by the
Council followed.
Motion was wade by Thorkelscn that no action be taken on this request because it
is the opinion of the Council that the property can be developed without a storm
Willow
sewer being put in place,, that the costs of a storm -sewer are not justified,
Beach
that easements are not available without oond -m ation.proceedings on the desired
storm
route for a storm' sewer, that the City is not responsible for any existing
sewer
conditions because the property was 'platted by Spring Lake Tv&Ahip prior to
a
annexation and the property owner was fully aware of the situation when the
property was purchased. Motion was seconded by Busse and upon a vote taken, was
duly passed.
The next item on the agenda was Other Business. Discussion was opened to the
audience. Comments and discussion followed by the audience and the Council
regarding a water treatment system for Prior Lake and citizen/Council
co�mcation.
