J n RESOLUTION *77 -5 J f -, Motion By: Bissonett Seconded By: Busse` A RESOLUTION OPPOSING THE, LOCATION OF A HAZARDOUS WASTE DISPOSAL FACILITY ^yam : . l" IN SCOTT COUNTY; WHEREAS, the Minnesota Pollution Control Agency has received a, grant from the Environmental Protection Agency to locate a demonstration project in the State of Minnesota for the temporary and final disposal of hazardous „ waste chemicals, and WHEREAS, the Minnesota Pollution Control Agency has contracted with the; Metropolitan Waste Control Commission who has the authority under State' Statute 473317 to own and ,operate a hazardous waste disposal facility- within the Metropolitan area,, WHEREAS, this site would be the receipient of thou "sands of tons of chemicals wastes generated not only within the Metropolitan area but also from through- out the entire state, and--- WHEREAS, State Statutes do not prohibit this site from accepting wastes from outside the boundaries of the State, and WHEREAS, considering the grant has been provided, from the Minnesota Pollution Control Agency from the Federal Environmental. Protection Agency, the ' operators of the site could be required \to accept materials from any location outside the s State of Minnesota if ordered by the Environmental Protection Agency, and WHEREAS, State Statute 473.19 requires the'MetroRolitan Council to prepare and adopt a long range policy plan for the collection and processing of solid iky and hazardous wastes in the Metropolitan area, and. i` - F , WHEREAS,-the Metropolitan Council has neither prepared nor adopted a long range solidd and hazardous waste plan, and 8' WHEREAS, the final site selection could potentially be in conflict with the, guidelines adopted at a future date by the Metropolitan Council in'the areas of general location, capacity, operation, processing techniques, environmental impacts and economic viability, and WHEREAS, the Metropolitan Waste Control Commission has selected one primary and three secondary sites in Scott County, and WHEREAS, a11'four sites pr ovide.poor access points due to a lack of major roads to the area'or the requiring of transportation trucks going through, or near- 1 y; by existing municipalities or small,residential areas, and r i THE CENTER OF LAKE COUNTRY I i� WHEREAS, the'Scott County Comprehensive Plan shows these sites, are within an agricultural area and should remain as agricultural and therefore imcompatible,` with a,facility proposed, and ` WHEREAS, the residents of these, areas have steadily maintained that they want:"; agricultural uses to remain as the major land use, and � WHEREAS, the ,location of'an industrial, site of this size could jeopardize - future zoning decisions if the Townships and County attempted to locate future industrial requests to proper sites, and` WHEREAS, Scott County Zoning Ordinance No. 3, Chapter 5, Section 5,01S.'states; ' "No structures, building or tract of land shall be devote to any useother than.;a use permitted hereinafter in the Zoning District in whicl >such structure br tract of land shall be located, with the following exceptions; 10 Conditional uses, allowed in accordance with the provisions of Section 5.014, and ry WHEREAS the location of a hazardous waste disposal site is neither a permitted use - or'a conditional use in Scott County's Agricultural Districts. 1% f WHEREAS, the proposed landfill is a,demanstration project which would be using' � P. methods, of disposal that have never been put into practical use, and WHEREAS these methods could prove unworkable and cause a severe contamination -to the local groundwater of the site-and the major groundwater - recharge,,area- from which ajar area of. the Metropol,i.tan,Area draws its water supplies, and WHEREAS, leachate at any of the proposed sites would also pollute the lakes ' and streams of the County which provide large breeding areas for water f6ii ' and marine life and disrupt natural migratory'patte'rns, all of which provide major recreational opportunities for the citizens of the area, =and WHEREAS,'the.Metropolitan Waste Control Commission plans on building a`� rainwater containment structure which would allow for the collection and, . monitoring of any above- ground water flow, and u WHEREAS, Scott County h4s been the recipient of major rainstorms w :ch produce eig 8 inches to twelve 12 inches of rain within a twd.L -four -. hour period, and WHEREAS, the water containment structures could not be constructed" in a .•.: technological or economically feasible manner to possibly collect and retain Aj this size rainfall, and, WHEREAS, the landfilling and storing of these chemicals could not be done so as to completely prevent odors from affecting nearby land owners and` residential areas, and" WHEREAS, Scott'County could not adequately supply proper security protection for any of the proposed sites nor respond in a sufficiently large force of fire and rescue personnel should a njaj.or catastrophe occur on thef-site. , {, - 2 - ,.
