Address The State law is as follows: MINNESOTA LAW REGULATING DRAINAGE WORK ) >< :S 1 160.20 DRAINAGE Subdivision 1. Connecting drains to highway drains. When the course of natural drainage of land runs to a highway, the owner of the land shall have the right to enter upon the highway for the purpose of connecting his drain or ditch with any drain or ditch constructed along or across the highway, but before making the connections he shall fust obtain a written permit for the connections from the road authority having jurisdiction. The connections shall be made in accordance with specifications set forth in the permits. The road authority shall have power to prescribe and enforce reasonable rules and regulations with reference to the connections. The highway shall be left in as good condition in every way as it was before the connection was made. PERMIT REQUIREMENTS 1. If drainage work to be done lies within the limits of any city, vi~e or watershed district, permission must be obtained from the local governing authority involved. If drainage work to be done invo[ves county, judicial, or group drainage systems, permission must also be obtained from the authority involved. 2. The applicant shall comply with all rules and regulations of the Minnesota Environmental Quality Council and any other affected governmental agencies. 3. After work on a project is completed (the applicant) must notify the Area Maintenance Engineer that such work has been completed and is ready for final inspection and acceptance. 4. 5. No equipment will be permitted to operate on or cross the roadway which will damage the roadway or shoulder surface. 6. Highway right of way shall be restored to its original condition after work is completed. If the Transportation Department shall make any improvements or change on all or any part of its Right of Way upon, over, under or along the trunk highway, then and in every case the applicant herein named shall, after notice from the Commissioner of Transportation or his authorized agents, proceed to alter, change, vacate or remove from trunk highway Right of Way said works necessary to conform with said changes without cost to the State of Minnesota. Removal of trees or shrubs within the right-of-way requires prior approval of the Area Maintenance Engineer or his authorized representative. 7. 8. The State reserves the right to remove or repair, with its own forces but at the expense of the applicant, any tile outlet which is not maintained and causes damage to adjacent right-of-way. Applicant must obtain a permit to do maintenance work on the drainage system covered by this permit. 9. The applicant shall furnish, install and maintain an approved culvert maker post at outlet of drainage tile. The drainage work shall not interfere with any existing utility facilities on the trunk highway right of way. A deposit made payable to the Commissioner of Transportation may be required to insure proper restoration of highway right of way and to cover payment for any damage to State property. 10. 11. 12. MINNESOTA DEPARTMENT OF TRANSPORTATION fJ.g :aO~AY l'l!aUI:ATION SUPARVlS6:a Date 9- C?~- 79 GENERAL INFORMATION To minimize site plan changes, it is desirable that preliminary driveway layouts for proposed driveways at commercial sites be submitted by the applicant to the District Director prior to making the permit application. By this means, construction and maintenance plans for the portion of the trunk highway under consideration may suggest alternate or improved methods or standards of construction or reconstruction to the property owner and/or lessee. Commercial and industrial driveways should generally be wide enough for two-way operation on two-way streets. The use of design vehicle templates to check the plan layout is recommended. The driveway dimensions listed in Table I, Highway Regulation 36 should generally be adequate,Cbut variations in width of the buffer area, driveway angle; radii, and site char- acteristics suggest that careful attention be given to selecting the correct combinations of dimensions for the specific site. In- adequate width is hazardous to vehicular traffic; and excessive width is hazardous to pedestrian traffic. Generally, near left and near right corner driveways should be opposite each other. Where property corners on opposite sides of the street are located such that the corresponding corner driveways would not be located directly opposite each other (skewed intersections and/or varying R/W widths), the near right side property corner should ,be used for locating both driveways. REQUIREMENTS 1. No wor~ under this application is to be started until application is approved and the permit issued. 2. Where work on travelled roadway is necessary, traffic must be protected, and flags, flares and proper barricades must be placed in accordance with the standards of ihe Minnesota Department of Transportation. 3. No foreign material such as dirt, gravel, or bituminous material shall be left or deposited on the road during the construc- tion of driveway or installation of drainage facilities. 4. Roadside must be cleaned up after work is completed. 5. After driveway construction is completed the permittee shall notify the District Office that the work has been completed and is ready for final inspection and approval by the Minnesota Department of Transportation. 6. No changes or alterations in entrances may be made at any time without written permission from the Minnesota Depart- ment of Transportation. ' 7. Driveway fill slopes shall be constructed 6:1 (6' horizontal to l' vertical) where existing road side slopes are 4:1 or better and shall be hand finished and seeded. 8. Driveways shall be so constructed as to slope down and away from the shoulder line of the Trunk Highway for a distance of at least 15 feet with a fall of at least 3 inches. Permission is hereby granted for the construction of the driveway as described in the above application, said driveway to be constructed in accordance with MINNESOTA REGULATION HIG HW A Y 36 and subject to the above requirements and the special provisions. If the work is not completed by date given on this application then the cost of completing unfinished construction by State forces may be deducted from required deposit. In the event that the construction has not been started by this date, this permit becomes null and void and deposit refunded. SPECIAL PROVISIONS '2./7/79 1.) The applicant and/or property owner shall maintain the access from the shoulder or curb and gutter. of the roadway to his property line. 2.) The permit states whe.ther the state or the applicant shall furni~b a. culvert. and also the diameter and length of culvert required. The culvert shall be properly centered at the location of the approved access and placed ~n the' center of the ditch bottom with aprons attached, if required. The culvert shall have a mi~1~um_~!_~~~_(21 in~~~~ fall for drainage. After the culvert has been properly placed, sand and gravel material, free from large rocks and boulders, shall be placed over the culvert. Road accesses shall drain away from the highway shoulder for a minimum distance of twenty-five (25) feet with a fall of six (6) inches. All other accesses shall drain away frem the high- way shoulder for ~ minimum distance .of fifteen (15) feet with a f~ll of six (6) inches. 3.) Unless otherwise stated on the permit application or plans, the access shall be surfaced with a minimu~ of two (2) inches of 3/4 inch cr~~h~~ ~r ~creen~~ gravel, spread evenly over the entire surface of the access after which i~ shall be compacted. 4.) Side slopes of all accesses shall be 4:1 (4 feet horizontal to 1 foot verticle) unless otherwis~ stated on the permit application or plans. 'A minimum of three .(3) inches bftopsoil shall be placed uniformly ov~r both side slopes and other disturbed area~. for the full width of the State's Right-of-Way and seeded or sodded according to Number 5. 5.) The applic~nt may not ~emove or disturb ~raffic signs, sign post~, dummy p6sts, survey m~rkers or monuments, or guaidrail sections along the State Highway without written permisssion from the Department of Trans- portation. 8.) All disturbed bituminous, concrete, curb, gutter, and sidewalk, due to the construction authorized by the attached permit, shall be replaced, in kind, by the applicant. 9.) All work authorized by the attached permlT s~all be completed within one (1) year from the date the permit was approved and signed by the Department of Transportation. 10.) When the applicant has completed all the work authorized by the attached permit, and the state's Right-of-Way has been pro~erly restored, he must contact the Department of Transportation Permit Section at District 5 Headquarters at 545-3761, to request a final inspection. Allow at least two (2) weeks for a final inspection to be performed. If the work is unsatisfactory, the applicant will be required to make the necessary corrections within a time limit set by the Department of Transportation.
