NOTICE OF HEARING ON PROPOSED ASSESSMENT
City of Prior Lake, Scott County, Minnesota
Street & Storm Sewer Improvements
Jordan Avenue
(Co. Rd. No. 44 to S.T.H. No. 13)
Notice is hereby given that the City Council of the City of Prior
Lake will meet at 8:45 P.M. on Tuesday, September 2, 1980, at the
Prior Lake City Hall, 4629 Dakota Street S.E., Prior Lake, Min-
nesota, to act upon the proposed assessment for the construction
of street and storm sewer improvements for Jordan Avenue.
The area proposed to be assessed for such improvement is de-
scribed as follows: All that property abutting Jordan Avenue
between County Road No. 44 and State Trunk Highway No. 13.
The proposed assessment is on file for public inspection in the
office of the City Clerk.
Written or oral objections will be considered at the hearing.
Appeals as to the amount of the special assessment may not be
taken unless a written objection signed by the affected property
owner is filed with the Municipal Clerk prior to the assessment
hearing.
Notification of the provisions of Minnesota Statutes sections
435.193 to 435.195 are also a part of this notice of assessment.

AGREEMENT
WHEREAS, the City of Prior Lake, Minnesota, at the present time has
contracted for certain paving on the streets of said City of Prior Lake,
Minnesota,
WHEREAS, certain citizens within the City of Prior Lake are desirous
of making certain paving improvements to this portion of said City,
AND WHEREAS, said citizens are desirous of having said paving
improvements done immediately, and therefore certain notices required
by law in order to assess said improvements have not been. duly complied
with, and,
WHEREAS, said citizens hereby desire to waive any and all legal
rights insofar as said notices and legal proceedings are concerned
and have said improvements assessed against their property as if said
notices had been legally given,
WHEREAS, said citizens fully realize there will be a paving
assessment on each parcel,
THE UNDERSIGNED THEREFORE AGREE that they hereby waive all legal
rights insofar as any proceedings are concerned for assessment of
paving improvements against their property as made by Orr-Schelen-Mayeron,
and Associates, of Minneapolis, Minnesota; and they hereby consent that
said paving improvements be assessed at such time and place as are
designed by the laws and the statutes of the State of Minnesota.

The aforementioned and foregoing agreement is hereby accepted by the
City of Prior Lake, Minnesota, and said City hereby acknowledges that
the aforementioned parties have waived all legal rights insofar as any
proceedings are concerned in connection with the assessment against
their property for paving improvements.

Dear Mr. McGuire,
We the undersigned, being owners or contract purchasers of
property either in or abutting the above referenced Subdivision,
do hereby respectfully request the City of Prior Lake to proceed
with the road improvements to Jordan and Gateway Avenues, at
that Subdivision.
It is quite important to the development of the shopping center
project in this subdivision to have the improvement to Jordan
Avenue completed as soon as possible.
