CONTRACT FOR CONSTRUCTION
FOR THE
STREET PAVING, STORM SEWER, AND APPURTENANT WORK
CITY OF PRIOR LAKE, MINNESOTA
PROJECT NO. 80-14
H.U.D. NO. B-78-SA-27-9003
TOWER STREET
THIS AGREEMENT, made and entered into as of the 11th day of
February, 1981, by and between the CITY OF PRIOR LAKE, MINNESOTA,
a municipal corporation under the laws of the State of Minnesota
(hereinafter called the "Owner") and ALEXANDER CONSTRUCTION CO.,
INC. (hereinafter called the "Contractor").
WIT N E SSE T H
That in consideration of their mutual covenants and
agreements as hereafter set forth, the Owner for itself and the
Contractor for itself, its successors and assigns, covenants and
agrees as follows:
TO WIT:
1. The Contractor agrees to furnish all the necessary
materials, labor, use of tools, equipment, plant and every other
thing necessary to perform the work designated and referred to in
this contract, including all Contractor's superintendence and to
furnish everything necessary for the completion of the improve-
ment which is the subject of this agreement (except such things
as the Owner has specifically agreed to provide, according to the
contract documents); and agrees under penalty of a public con-

tractor.'s corporate surety bond in the amount of (SEVENTY
THOUSAND TWO HUNDRED SEVENTY SEVEN DOLLARS AND FIFTY CENTS
($70,277.50) to perform and complete the work shown in the plans
and drawings, entitled "Street Paving, Storm Sewer and Ap-
purtenant Work" for the City of Prior Lake, Improvement No. .80-14
prepared by Orr-Schelen-Mayeron & Associates, Inc. of Min-
neapolis, Minnesota and dated October 6, 1980 and to conform in
all respects with the provisions and requirements of the general
conditions, general requirements and special provisions for said
improvement, which are entitled "Street Paving, Storm Sewer and
Appurtenant Work" for the City of Prior Lake prepared by said
Orr-Schelen-Mayeron & Associates, Inc., dated October 6, 1980.
2. The Contractor agrees that performance shall be in ac-
cordance with the terms, requirements and conditions of this
instrument, and laws of the State of Minnesota, and the following
documents:
Advertisement for Bids for said Improvement No. 80-14 for
the Owner.
Proposal by the Contractor, presented to the Council of the
Owner on January 21, 1981 and accepted by the Owner on February
2, 1981.
Contract Documents for said Improvement No. 80-14 referred to
in the preceding paragraph of this Agreement and made a part of
the aforementioned proposal.

Plans and Drawings for said Improvement No. 80-14 as
identified in the preceding paragraph of this Agreement and which
are dated October 6, 1980.
Any Addenda to the plans, drawings, general conditions and
specifications for said Improvement No. 80-14 which addenda were
prepared by Orr-Sche1en-Mayeron & Associates, Inc.
Public Contractor's Suret~ Bond in the principal sum of the
amount bid.
Each and all of the aforementioned contract documents are
hereby incorporated into this Agreement by specific reference and
the terms and provisions thereof are and constitute a part of
this Agreement as though attached hereto or fully set forth
herein.
3. The Owner agrees to pay the Contractor for the
performance of this Agreement and the Contractor agrees to accept
in full compensation therefor, the sums set forth within the
aforementioned proposal of the Contractor for each unit and each
type of unit of work to be performed. It is understood and
agreed that the said proposal is for the construction of said
Improvement No. 80-14 on a unit price basis in accordance with
the said proposal, and that sum of $70,277.50 as set out in said
proposal, is the sum of the unit prices, multiplied by the
estimated quantities of the respective units of work listed
therein.

CONTRACT BETWEEN THE CITY OF PRIOR LAKE
AND THE SCOTT COUNTY HOUSING AND REDEVELOPMENT AUTHORITY
WHEREAS, the City of Prior Lake, a public body under the laws of the State of
Minnesota, hereinafter referred to as "City", and the Scott County Housing and
Redevelopment Authority, a public body organized under the laws of the State of
Minnesota, hereinafter referred to as "HRA" are desirous of the entering into
this Agreement; and
WHEREAS, the united States Department of Housing and Urban Development has
agreed to fund an areawide bonus funds community development block grant program
hereinafter referred to as "C.D.B.G.", within the City of Prior Lake; and
WHEREAS, it is necessary for the City and HRA to enter into this Agreement
for the purpose of establishing their relative duties and obligations concerning
said C.D.B.G:
NOW THEREFORE, in consideration of the covenants and agreements hereinafter
set forth, the sufficiency of which is hereby acknowledged by both the City and
the HRA, it is hereby agreed to as follows:
1. The City is hereby designated as the C.D.B.G. recipient for the program
funded pu~suant to the 1978 bonus funds application. The City will agree to
adhere to all resolutions and agreements adopted and entered into by it as part
of the application for said program.
2. The HRA is hereby designated as the administering entity for said program
and shall be bound to administer the C.D.B.G. in a manner consistent with;
a.
Community Development Block Grant Regulations and Handbooks;
b.
The assurances assumed by the City as a part of the approved
application which assurances are marked as Appendix A, attached
hereto and made a part hereof;
The Grant Funding Agreement;
d.
The Tower Street Reconstruction Program, as described in the bonus
CDBG application to HUD.
3. The HRA shall be responsible for the following:

The administration of the C.D.B.G. and in particular the
Tower Street Reconstruction Program.

The maintenance of accurate financial and other records
respecting said programs, making said records available
to the City;

Compliance with all applicable Housing ~nd Urban Development
Rules and Regulations, City Assurances, and the Grant Funding
Agreement;
d. Submission of grantee performance report5 as requested by the
City or the Department of Housing and Urban Development;
e. The requesting of funds from the Department of Housing and
Urban Development through the city.
4. The City shall be responsible for the following:
a. For the maintenance of the Department of Housing and Urban
Development funds depository;

b. For the prompt processing of requests for said funds by HRA:
c. For the keeping of accurate, financial records;
d. For the payment of documented administrative costs incurred
by the HRA and payable pursuant to Paragraph 5 of this Agreement.
5. The City, under thee.D.B.G. , No. B-78-SA-27-9003 will receive from the
Department of Housing and Urban Development an amount up to $88,000.00.
An amount not to exceed $4,000.00 of the C.D.B.G. funds will be available to
pay necessary administrative expenditures of the HRA as approved by the Department
of Housing and Urban Development anfr in conformance with the regulations thereof.
The balance of the C.D.B.G. funds will be expended in conformance with the
Hun approved budget submitted as part of the application.
6. The City Council of the City of Prior Lake, the Board of Comnissoners_'ofthe Scott
County Housing and ~developmentAuthori ty, and all of the employees ther'eof, shall be
bound by the provisions of Minnesota statutes 462.431 entitled "Interest in Project'
Forbidden." Moreover, no member, officer or employee of the City or the HRA, or
their designees or agents, no member of the governing body of the locality in which
the program is situated, and no other public official of such locality or localities
who exercises any functions or responsibilities with respect to the program during
his tenure or for one year thereafter, shall have any interest, direct or indirect,
in any contract or subcontract, or the proceeds thereof, for work to be performed in
connection with the program administered under the terms of this Agreement.
7. Amendments to this contract or the program administered hereunder shall
be made by mutual agreement in writing by and between the City and the HRA.
8. This Agreement shall be effective retroactively to August 22,1980 when it-is
approved. by resolution by both governing bodies and executed by its authorized
officers. It shall terminate when the total grants received hereunder have been
expended and the grant close-out documents have been submitted to the Department
of Housing and Urban Development and approved thereby.

the Monthly Utilization Report is to be completed by each subject contractor (both prime. and sub) and signed by a
..esponsible official of the company. The reports are to be filed by the 5th day of each month during the term of the
contract, and they shall include the total work-hours for each employee classification in each trade in the covered area
for the monthly reporting period. The prime contractor shall submit a report for its aggregate work force and collect
and submit reports for each subcontractor's aggregate work force to the Federal compliance agency that has Executive
Order 11246 responsibility. (Additional copies of this form may be obtained from the U.S. Department of Labor,
