and return locations shown. HEAT LOSS CALCULATIONS, PAYMENT AND
APPLICATIONS MAY BE MAILED TO THE CITY OF PRIOR LAKE, 16200 EAGLE
CREEK AVE. S.E. PRIOR LAKE, MN 55372.

The Engineering Department does not have a comprehensive written policy regarding which uses of easements
by underlying property owners are allowed and which are not We hope to dev~lop one in the near future.
In the interim I will be responding to inquiries as follows unless directed otherwise.
1. No structures including retaining walls are allowed in any ~asement, with the exception that within the
Shoreland District. special consideration will be given to retaining walls. ,'_ -
2. Garden and flower bed areas, etc. which create a bare soil condition in easements tor drainage purposes are
not allowed. - -
- 3, Any landscaping t~ature. etc. which restricts the flow of stormwater within an easement tor drainage-purPoses
and/or deflects it onto neighboring properties is not allowed. Steep earthen slopes are not allowed to be created
within - easemen.ts for drainage punoses which force an inordinate amount of stotmwater flow onto a neighboring
property. The exception to this is t lose areas where a subdivision grading plan has beel) approved by the City to
allow thE!se slopes. -- ,
4. Fences,driveways,sprinkler$ystems and trees are allowed iftheydonot have an adverse impact on utility

Dear Property Owner:
The Engineering Department has reviewed the building permit for the subject property. The site
plan shows that a portion of the driveway is proposed to be constructed on a utility easement.
Watermain, sanitary sewer and storm sewer are locted in this easement. Typically the City does
not allow permanent structures or landscaping in utility easements. You will need to take one of
the following two options in order for us to approve your site plan as it is currently proposed.
The first option would be to locate the driveway outside of the easement. Your second option is
your agreement that in the event the City would disturb your driveway to complete repairs on
any of the utilities, you would be responsible for restoration of the driveway surface.
If you are in concurrence with this agreement (second option), please sign in the area indicated
below and return a copy of this letter to me in the enclosed envelope. If you have any questions

by the City of Prior Lake to be constructed at a lower elevation than that dictated by
Ordinance 94-05 which states that, "The garage slab shall be constructed at an elevation
that will permit a driveway with a minimum slope of eighteen (18) inches above the top
of curb." Therefore, you are reminded that the driveway must be constructed so that at a
point 10' horizontally from the street gutter line, the driveway is a minimum of 6"
vertically above the gutter line. If these conditions are not adhered to, you will be
required to reconstruct the driveway at your expense.
This statement serves as an administrative variance to item 4 of Ordinance 94-05. If you

and the Court having duly considered the application, the Report of Examiner of Titles
and the evidence adduced by the Applicant, finds:
1. Except as hereinafter provided, the facts and the opinion upon the title stated
in the Report of Examiner of Titles are true and correct.

amendments thereto have been complied with and all of the defendants in this
proceeding have been auly served with process as required by law or have consented to
the registration herein. It further appears that no answer has been filed or appearance
has been made by any defendant in this proceeding, except the City of Prior Lake has
appeared by Stipulation allowing the applicants to proceed by default.
3. Except as hereinafter provided, none of the defendants named in the .
summons and any amendments or supplements thereto have any right, title, estate, lien
or interest in the premises hereinafter described.

separately assessed and therefore have no independent market value apart from or in

Applicants James A. Tovsen and Janice L. Tovsen; and the Dornbush/McFall Parcel,
as hereinafter described, is constructively occupied by Charles H. McFall and Michele
K. McFall; and the Albers Parcel, as hereinafter described, is constructively occupied
by James G. Albers and Linda M. Albers.
6. The Applicants have made a due and diligent search for the addresses of John
N. Connelly, Abbie Connelly, John N. Connolly, Abbie Connolly, Ralph E. Lovett,
Marion D. Lovett, Realty Holding Company, Edna N. Southworth, W. N. Southworth,
Walter N. Southworth, Albert E. Dorn, Viola Dorn, and Barbara J. Dunn, named as
defendants herein, and have been unable to locate the same; that their whereabouts are
unknown; and- iliat said named defendants have been served in this proceeding by

7. Defendant Mac Dorn is deceased and is survived by his spouse and heir,
Florence M. Dorn, who has accepted service by mail of the Summons herein and has
not answered or otherwise appeared in this proceeding.
8. Defendant Bernice Laabs is deceased and is survived by her spouse and heir,
Melvin Laabs. James Laabs, who is the attorney-in-fact for Melvin Laabs has accepted
service by mail of the Summons herein and has not answered or otherwise appeared in
this proceeding.
9. The Applicants and their predecessors in title have been in actual, hostile,
open, continuous, notorious and adverse possession of all of the premises hereinafter
described for more than 15 years prior to the commencement of this proceeding and
have paid the real estate taxes thereon.
10. The owners of Lot 115, Northwood, Scott County, Minnesota, do not have,
or have, lost by abandonment or conveyance, all right, title and interest' that they may:
have or had in the premises herein described by virtue of possible landscaping and rock
wall encroachments along and over the easterly line of the Dornbush/McFall Parcel.
11. The parcels hereinafter described are each subject to recorded utility
easements in favor of the City of Prior Lake, which easements are the same as the
City's utility easements referred to in the City's Petition, dated June 30, 1993, filed
July 7, 1993, as document 64505; and therefore, the Petition filed as document 64505
should not be shown as a memorial on future certificates of title for the premises
hereinafter described.

1. A default as to each defendant named in the summons and any amendments
or supplements thereto and "all other persons or parties unknown claiming any right,

Beginning at the southwest corner of Lot 113, Northwood, Scott County,

intersection with the southerly extension of the easterly line of Lot 113, thence
northerly along said southerly extension to the southeast corner of Lot 113;

That said land is brought under the provisions and operations of
Minnesota Statutes Chapter 508, and that the title thereto is confirmed and registered as
