DISCUSSION:
HISTORY
The City uses the Five Year Capital Improvement Program
to plan its infrastructure improvements and the financing for
capital improvements, The proposed 2005 street
reconstruction program includes several street and utility
improvement projects, The purpose of this Agenda item is
to initiate the process for local improvements set forth in the
2005 portion of the 2005-2009 Capital Improvement
Program in accordance with Minnesota Statutes (M,S,),
Chapter 429,
This process applies to all projects that will be financed in
whole or part through special assessments or bond
proceeds, The first step in the process is for the Council to
order preparation of a Feasibility Report for the improvement
projects,
The Feasibility Report will address street reconstruction for
Fish Point Road (north of Highway 13), Centennial Street,
Fairlawn Shores Trail, Ferndale (from CR 42 to Hampton
Street), and Candy Cove Trail (from Highway 13 to CSAH
44) (see attached location map)(collectively "project"), This
may be too expensive a project to construct in one
construction season, but we will review the costs and make
recommendations to the Council regarding project size
based on information ascertained from the feasibility report,

CURRENT CIRCUMSTANCES
This Project is in the 2005 Capital Improvement Program.
Attached is a page from the C.I.P. which provides additional
information on the Project. The Project requires special
assessments and financing through bond proceeds,
therefore requires the City to follow the requirements of M,S.
Chapter 429.
ISSUES
The City is required to assess a minimum of 20% of the cost
of a public improvement project completed through the
Chapter 429 process and financed through G.O. bonds, The
City will meet the minimum assessment requirement. The
Feasibility Report will determine the estimated costs of the
improvements and methods of financing. This 2005 Project
is expected to involve 40% assessments for all benefited
parcels.
The preparation of the Feasibility Report is only the first step
in the public improvement process. Following receipt of the
Feasibility Report, the Council can schedule a Public
Hearing to move forward. Following a Public Hearing, the
Council may consider authorizing the preparation of plans
and specifications. Once completed, the City Council would
be asked to approve the plans and specifications, and
authorize advertisement for bids and finally, award a
contract. The City is not committed to doing the projects at
any of the steps outlined above prior to awarding the
contract. The following schedule outlines an approach to
complete this 2004 Project:

Council members have expressed a desire to award a bid as
soon as possible in the spring, assuming the bids are
favorable. The sooner the feasibility report is initiated the
earlier other steps in the project can be accomplished.
Beyond the Engineering staff time required to prepare the
Feasibility Report and complete surveying, we will also
complete soil borings which are needed to determine the
estimated costs of the Project. This cost will be taken from
the Construction Fund.
There are three alternatives for the City Council to consider:
1. Approve a resolution ordering preparation of a Feasibility
Report for: Street reconstruction for Fish Point Road
(north of Highway 13), Centennial Street, Fairlawn
Shores Trail, Ferndale (from CR 42 to Hampton Street),
and Candy Cove Trail (from Highway 13 to CSAH 44)
2. Deny this item for a specific reason and provide staff with
direction.
3. Table this item until some date in the future.

ORDERING PREPARATION OF FEASIBILITY REPORT
FOR THE 2005 RECONSTRUCTION IMPROVEMENT PROJECT

WHEREAS, it is proposed to construct improvements for Fish Point Road (north of Highway 13),
Centennial Street, Fairlawn Shores Trail, Ferndale (from CR 42 to Hampton Street),
and Candy Cove Trail (from Highway 13 to CSAH 44), including the construction of
storm sewer, sanitary sewer and watermain repairs, aggregate base, concrete curb
and gutter, bituminous surfacing, street lights, and appurtenant work; and
WHEREAS, it is proposed to assess the benefited property for all or a portion of the cost of the
improvements, pursuant to Minnesota Statutes, Chapter 429,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
that the proposed improvements be referred to the City Engineer for study and that he is instructed to
report to the Council with all convenient speed advising the Council in a preliminary way as to whether
the proposed improvements are necessary, cost-effective and feasible and as to whether they should
best be made as proposed or in connection with other improvements, and the estimated costs for the
improvements as recommended.
