Prior Lake, MN 55372-1714 CITY COUNCIL AGENDA REPORT DATE: AGENDA #: PREPARED BY: AGENDA ITEM: July 19, 2004 9A STEVE ALBRECHT, CITY ENGINEER CONSIDER APPROVAL OF A RESOLUTION APPROVING THE PRELIMINARY DESIGN/ALIGNMENT FOR IMPROVEMENT OF CSAH 12 FROM TH13 TO CSAH 17, CITY PROJECT 04-02. DISCUSSION: History The County Highway 12 (CSAH 12) reconstruction from State TH 13 to County Highway 17 is scheduled for 2006 in both the City and County CIP's. The County as the lead agency for the project has contracted with Bolton-Menk, Inc. for the engineering design for the project. The City staff is part of the Project Management Team (PMT) for the project. There have been at least three full open house/ informational gathering meetings and numerous individual resident meetings that have specific design issues along the project corridor in the last year. City Council members and staff have also received resident comments in person, over the phone, bye-mail and letter. The schedule is to complete the design in the next several months and allow the county a full year to acquire the necessary permanent and temporary easements for the project. Current Circumstances During the public participation the PMT has listened and identified many issues with the proposed project. The purpose of this resolution is for the City Council to adopt a preferred design and alignment for the project. The preferred design and alignment was presented to the City Council at the June 21st Workshop. An open house was held on July 15, 2004 to update residents and discuss project issues. Residents have also been informed of this meeting and that the Council will be considering a resolution supporting a preferred design and alignment at their July 19th meeting and that they will have the opportunity to address the Council this evening. Upon adoption of a preferred design and alignment, the design process followed by easement/right-of-way acquisition will commence. On March 1, 2004 the Council passed a resolution supporting an application for Access Management Funds from MnDOT. Access Management Funds are given by MnDOT for use on specific portions of projects that will help limit or reduce unneeded connections to the state road system. This access management proposal provides guidance for future development of roads south ofTH 13 and the future extension of Elm Avenue to the Monnens property. In return for adoption of the access management strategy MnDOT has allocated $860K from the access management program for the project. A portion of the funding ($170K) is allocated for the extension of Elm Avenue (Figure 2). Figure 1 attached to this report shows the conceptual access management plan the City has provided to MnDOT. The proposed CSAH 12 design/alignment is divided into three segments for discussion purposes. Attached for your review are the typical street sections for each segment. Sef!ment 1 is from TH 13 to just west of Sunset Trail. This segment is proposed to have an east and westbound lane with a center left turn lane and shoulders. The road width for this section is 40 feet, widening to as much as 70 feet at turn lanes and intersections. This section also includes an 8- foot bituminous trail and 5- foot concrete sidewalk on the north and south sides respectively. Sef!ment 2 is from just west of Sunset Trail to Spring Lake Regional Park. This segment is proposed to have an east and westbound lane with no turn lanes and a 6-foot shoulder on each side. The road width for this segment is proposed to be 36 feet wide, which is the minimum road width staff considers acceptable to meet safety requirements for a collector road. This section includes 5-foot concrete sidewalks on each side. Sef!ment 3 is from the eastern edge of Spring Lake Regional Park to CSAH 17. This segment proposes to have an east and westbound lane with an intermittent center left turn lane. The road width for this segment is 40 feet, widening to as much as 60 feet at turn lanes and intersections. This section also includes an 8-foot bituminous trail and 5- foot concrete sidewalk on the north and south sides respectively. A 28 foot frontage road immediately east of Sunset Avenue is proposed along this segment. Issues The following is a discussion of the major issues associated with the design and alignment and concerns of residents: TH 13 Intersection: The PMT has recommended that the new intersection of TH 13 and CSAH 12 be moved to the southwest on TH 13 so that CSAH 12 aligns between the car wash and the recently remodeled lawn mower sales building (Bendzick). This realignment and the storm water ponding requirements will require the acquisition of a majority of the present property. In addition, MnDOT is providing the county with Access Management Funds for this project. Part of our access management responsibility is to provide alternative access to the Monnens property to the west of the Bendzick property. The PMT is proposing to provide this access off of CSAH 12 at Elm Avenue, which will require purchase of a parcel in this area. Currently the Monnnens parcel is zoned C1. Staff is recommending that this parcel be rezoned as part of the Comprehensive Plan update to LowIMedium density residential. This zoning much better reflects the surrounding uses once the two existing commercial parcels are removed for storm water ponding and road construction. Additionally through the access management agreement with MnDOT this property would access Elm Avenue not TH 13 which is much more conducive to residential development. The attached figure 2 shows a conceptual extension of Elm Avenue. As part of the Access Management Fund approval the City is also being requested to formally adopt the conceptual access plan shown in figure 1 for areas south ofTH13. Sidewalks: As you are aware through numerous petitions, letters, and emails, there is considerable discussion regarding the need for sidewalks on both side ofCSAH 12. The area of particular concern is Segment 2 where existing houses are close to the right of way. Both City and County Staff have recommended that a sidewalk or trail be placed on both sides of the roadway for safety purposes. It is also a City policy to place a sidewalk or trail on both sides of collector streets. Trails and sidewalks are our most used parks amenity. For most ofthe eastern and western segments ofthe project there is plenty of room to construct a trail on one side and a sidewalk on the other. The issue is the narrow central segment of the project which we has numerous driveways and narrow right of way. For this segment we have removed the trail and are recommending sidewalks on both sides of the road. Many homeowners do not want the sidewalk as they feel it is too close to their homes. Furthermore they feel it diminishes the limited off-street parking they have. Staff feels that there are safety considerations that make it worthwhile. a) CSAH 12 functions as a collector street with current ADT's of 4,100. 2020 County projections of ADT's are 7,000. This estimate was made prior to the orderly annexation agreement and is expected to increase. b) The existing regional park will have a lakeside picnic and recreation area that will increase pedestrian traffic. This pedestrian traffic is in addition to the parks located at Walnut Avenue and Sunset Trail. c) Location of the trail on one side ofCSAH 12 will result in an increase of pedestrian crossings. d) The additional cost for sidewalk on both sides on CSAH 12 in segment 2 is estimated to be $65,000. If the Council were to request that sidewalk only be located on one side ofCSAH 12 staff recommends placement of the sidewalk on the north side of the road for segment 2. Currently more residents live north of CSAH 12. There are five streets that connect to CSAH 12 from the north in segment 2. No streets connect to CSAH 12 from the south in segment 2. Frontaf!e Road: At the west end of CSAH 12, but east of Sunset A venue, there are numerous homes that have direct driveway access to CSAH 12. Again for safety purposes, the PMT has recommended that a frontage road be constructed and a new CSAH 12 be constructed adjacent to this so that these direct driveway access are removed. This change will remove 11 driveway accesses from CSAH 12. Minimum site distances for these driveways can not be met if they remain connected to CSAH 12 creating additional safety issues. The additional project costs for construction of the frontage road is estimated to be $200,000. The City's share of this cost is $100,000. The County has indicated that the cost for additional right of way for the frontage road would be their cost with the City participating in the cost of any additional ponding easements needed for the modification. It should be noted that the resident north of CSAH 12 who will end up having the majority of additional right-of-way purchased from their property is opposed to the frontage road. They feel the additional right-of-way costs do not justify the safety gains and that modifications to the existing road could be made to help reduce safety concerns. Additionally they feel the frontage road south of CSAH 12 will increase property values on that side of the road while decreasing theirs. Water Resources: City and County staff have been working with the watershed to minimize impacts to Spring and Prior Lakes from the project. The project will utilize a large infiltration basin, water quality structures and several water quality ponds. In addition the project will restore large wetland basins that will provide improved water quality for Spring Lake. Staff feels that they have minimized the road section impervious area based on safety requirements. Overhead Utility Line Burial: Staff has heard from a number of residents about the possibility of burying the overhead lines down CSAH 12. Similar to the utility service connections with our downtown project this will increase costs to each resident. If the Council wishes to have staff pursue this issue we recommend that the City contract with an outside consultant complete this work, as it will be a very time consuming and complicated process. Conclusion Staff recommends that the City Council approve the design and alignment for CSAH 12 with the sidewalks on both sides of segment 2 and the frontage road in segment 3. ALTERNATIVES: The alternatives are as follows: 1. Adopt the attached resolution that approves the Preliminary Design/Alignment for Improvement of CSAH 12 from TH 13 to CSAH 17, City Project 04-02. 2. Adopt the attached resolution that approves the Preliminary Design/Alignment for Improvement of CSAH 12 from TH 13 to CSAH 17, City Project 04-02 with sidewalk only on the north side for segment 2. 3. Deny this item for a specific reason and provide staff with direction. 4. Table this item for specific reason. The Consultant, Bolton & Menk, Inc. will proceed with preparation of construction plans based on the preliminary design/alignment for the project and the County will begin easement and right of way acquisition for the project. The City supports the conceptual street plan for areas south of TH 13 near the CSAH 12 intersection for use of Access Management Funds as stipulated by MnDOT. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCil OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein. 2. The preliminary design/alignment for CSAH 12 is approved as recommended by staff.
