The City Council approved the vacation of certain public road and waterfront property within

the Butternut Beach Plat at a regular Council meeting on May 23, 1977; and
A letter recorded with Scott County from the City Manager of Prior Lake dated May 27, 1977

certified the City Council’s actions to vacate such property; and
Due to pending quiet title action and a need to confirm the previous City Council’s intent and

action to vacate public road and waterfront property; and
Based on file research, City staff concludes that the 1977 vacation includes both the waterfront
;,)6)%7
and road lying southerly of Lots 1, 2, and 3, as well as a roadway which is used to access the
vacated waterfront immediately west of Lot 1.

1.The recitals set forth above are incorporated herein.
2.The City Council confirms the 1977 decision by the City Council to vacate both the waterfront and road
lying southerly of Lots 1, 2, and 3, as well as a roadway which is used to access the vacated waterfront
immediately west of Lot 1.
3.The City Council authorizes the City Attorney to execute a Stipulation for Entry of Order related to Mary
Wendt and PennyMac Loan Services, LLC as Plaintiffs in Court File No. 70-CV-13-17744.
PASSED AND ADOPTED THIS 14TH DAY OF APRIL 2014.
