Under Minnesota Statues §471.59, the city is empowered to enter in agreements with other

governmental units to jointly or cooperatively exercise any power common to the
contracting powers or similar powers, as deemed necessary; and
The City of Prior Lake entered into a Joint Powers Agreement to utilize the Minnesota

Department of Commerce’s Guaranteed Energy Savings Program (GESP) under
Minnesota Statue §16C.144 as a contracting option for guaranteed energy savings
projects; and
The Department of Commerce has provided the GESP Master Contract, Lease Purchase
;,)6)%7
Agreement, and the Site Specific Request for Proposals (RFP) and has reviewed the
terms; and
The City issued a Site Specific Request for Proposal to the eleven Energy Services
;,)6)%7
Companies under the Master Contract with the State of Minnesota; and
The City received six proposals and evaluated them based on the criteria set forth in the
;,)6)%7
Site Specific RFP and the scoring system established for procurement by the State; and
Honeywell received the highest score.

1.The recitals set forth above are incorporated herein.
2.The City Council hereby approves the Work Order Contract with Honeywell for the Investment Grade
Audit.
3.The Mayor and City Manager are hereby authorized to sign the above mentioned Work Order Contract
on behalf of the City of Prior Lake.
4.In the event the City decides not to move forward with energy projects, the IGA will be invoiced to the
City and funded with the Facilities Management Fund and staff is authorized to amend the budget as
appropriate.
