Jack Hunter has submitted a petition for the vacation of a roadway easement located in the

Godsons Way plat. The petition has been duly presented to the City of Prior Lake, signed by
the owners of the property abutting the following described easement situated in the City of Prior
Lake, Scott County, Minnesota to wit:

Roadway Easement as identified in Scott County Document #A759983 filed on December 20,
2006 as follows:
A 50 foot wide strip over and across that part of the East Half of the West Half of the
Southeast Quarter of Section 12, Township 114, Range 22, Scott County, Minnesota,
described as follows: Commencing at the northwest comer of the South 1958.81 feet of said
East Half of the West Half; thence easterly along the north line of said South 1958.81 feet a
distance of 446.95 feet to the point of beginning of said strip to be described; thence deflecting
to the left 79 degrees 18 minutes 53 seconds a distance of 50.10 feet and there terminating;
Together with that part of said East Half which lies within the circumference of a 100 foot
diameter circle, the center of said circle is the terminus of the above described strip.
Notice of the hearing has been duly published and posted in accordance with the applicable

Minnesota Statutes, and
A Public Hearing was held on said petition on Monday, April 28th, 2014, in the Council Chambers

at City Hall, 4646 Dakota Street SE; and
The City Council then proceeded to hear all persons interested in said petition and persons

interested were afforded the opportunity to present their views and objections to the granting of
said petition; and
A new right-of-way will be dedicated as part of the final plat for Godsons Way, so the existing

roadway easement is no longer necessary for the maintenance of the public street.

1.The above recitals are herein fully incorporated herein as set forth above.
2.The City Council of Prior Lake has determined that the vacation of said easements would be in the public interest.
3.The following condition of approval is determined:
a)The approval resolution vacating the roadway easement shall be recorded with the Final Plat of Godsons
Way as approved by the City Council

4.Pursuant to Minnesota Statues 412.851, the following described roadway easement is hereby vacated:
