History The City Code provides that the City Council may approve the renewal of annual on-sale intoxicating, Sunday liquor, off-sale intoxicating, on-sale wine, off-sale 3.2 malt liquor, on-sale 3.2 malt liquor, and club licenses. State statute requires that all licenses must expire on the same date, June 30 of each year. Current Circumstances All applicants have submitted the required documentation to renew their licenses. They have provided proof of liquor liability insurance. Prior Lake City Ordinance 301.600 states that no license shall be granted for operation on any premises for which taxes, assessments or other financial claims of the City are delinquent or unpaid. The Scott County Treasurer's records and City records show that all property taxes and money owed to the City are current. Perron's Sul Lago will not be renewing their Sunday On-Sale license as they are no longer open on Sundays and do not need the special license. Conclusion The Prior Lake Police Department has conducted an investigation and has reported that in the past five years the following establishments have been cited with selling alcohol to minors: 2013— MGM Wine & Spirits, The Pointe 2012 - None 2011 - None 2010 — Basement Bar& Grill, Prior Lake VFW, MGM Liquor 2009 — Prior Lake Amateur Baseball Association The Prior Lake Police Department conducts alcohol compliance checks two times each year. http:llsplashlteamslam/October4 2010/06 09 201412014 Liquor License Renewal Agenda.docx 1 ISSUES: The Prior Lake City Code sets forth a process and penalties associated with various types of liquor related sales violations. In the case of MGM and The Pointe, the clerk will be prosecuted in the criminal courts and if found guilty the first time presumptive penalty of three days license suspension will be invoked because these violations occurred befor the city council modified the ordinance. The Pointe has already served its three day suspension. MGM is in the process of selecting the days of suspension. Neither has elected to appeal the penalty. These violations should not prejudice the city council with respect to license renewal for any party as the penalties set forth in the ordinance are progressive ending in license revocation in the event of the third violations. In our interactions with the managers of these facilities it is clear that they desire to eliminate any sort of violation in the future. FINANCIAL Included in this agenda report is Exhibit A which details the license type IMPACT: and fees for the applicants who have paid a total of$70,270.00 for their licenses. ALTERNATIVES: 1. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1. The recitals set forth above are incorporated herein. 2. Exhibit A referenced above, which includes Artisan Coffee Bistro, Captain Jack's, The Cove, Extra Innings Saloon, Fong's Chinese Cuisine, Holiday Stationstore, Memories on Main, MGM Wine & Spirits, Perron's Sul Lago, The Pointe, Prior Lake Amateur Baseball Association, Prior Lake VFW, TJ Hooligan's, Viking Liquor Barrel, Village Liquor, and The Wilds Golf Club, is incorporated herein if fully set forth, 3. The liquor licenses for the premises set forth in Exhibit A are hereby approved for the period July 1, 2014 to June 30, 2015 and, 4.
