DISCUSSION: Introduction
The Shakopee Mdewakanton Sioux Community has applied for the approval
of a registered land survey on approximately 41 acres of land to define the
limits of Torrens designated property under fee ownership. The property is
located north of County Highway 82 and east of Highway 17.

History
The Planning Commission held a public hearing on March 3, 2014 regarding
the registered land survey request. At its meeting, the Commission
recommended approval of the request on the basis that the proposed
registered land survey will comply with all relevant City ordinance provisions
and City standards.
Current Circumstances
The applicant proposes to designate two tracts of land under a registered land
survey. Both are shown on the attached graphic.
The following paragraphs outline the physical characteristics of the existing site,
the Comprehensive Plan and zoning designations, and a description of some of
the specifics of the site.
PHYSICAL SITE CHARACTERISTICS:
Total Site Area: The total site area consists of approximately 41 acres. The
current properties contain vacant areas as well as areas that encompass the
western portions of the Meadows Golf Course and a residential house site at
15279 Howard Lake Road.
Wetlands: Wetlands are located on in the northern part of the property.
Access: Access to the property is currently from County Highway 82 (Howard
Lake Road).

2030 Comprehensive Plan Designation: The property is designated R-RD
(Rural Density) and C-NR (Neighborhood Retail Shopping) uses on the 2030
Comprehensive Plan Land Use Map.
Zoning: The property is located within "A" Zoning District (Agricultural).
Shoreland: The properties are located within the Shoreland District of Howard
Lake and are subject to the City's Shoreland Ordinance.
Conclusion
The applicant has proposed to combine the various properties into two tracts of
land (Tract A and Tract B) under a registered land survey. The proposed
registered land survey will comply with all relevant ordinance provisions and
City standards, provided all the conditions of approval are met. Therefore, staff
recommends that the City Council approve of registered land survey subject to
the following conditions:
• The registered land survey shall be recorded at Scott County within 60
days of approval by the City Council.
ISSUES: In cooperation with a Scott County District Court case to issue a decree of
Registration, the Shakopee Mdewakanton Sioux Community has been
requested to file a registered land survey (RLS). This registered land survey is
intended the delineate the limits of the Torrens property owned in fee title in the
City of Prior Lake in a 41 acre which includes a portion of the Meadows Golf
Course property and areas west of the golf course.
ALTERNATIVES: 1. Motion and a second, as part of the consent agenda, to approve a resolution
approving the SMSC registered land survey subject to conditions.
2. Motion and a second to table this item to a date specific, and provide the
applicant with direction on the issues that have been discussed.
3. Motion and a second to deny the registered land survey request.

RESOLUTION 14-XXX
A RESOLUTION APPROVING A REGISTERED LAND SURVEY FOR PROPERTY LOCATED AT COUNTY
HIGHWAYS 17 AND 82
Motion By: Second By:
WHEREAS, The Prior Lake Planning Commission conducted a public hearing on March 3, 2014, to consider
a registered land survey application from the Shakopee Mdewakanton Sioux Community; and
WHEREAS, Notice of the public hearing on said registered land survey has been duly published and posted
in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and
WHEREAS, All persons interested in this issue were afforded the opportunity to present their views and
objections related to the registered land survey for the record at the public hearing conducted by
the Planning Commission; and
WHEREAS, The Planning Commission and City Council have reviewed the registered land survey according
to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said
registered land survey to be consistent with the provisions of said ordinances; and
WHEREAS, The Prior Lake City Council considered an application for such registered land survey on June 9,
2014; and
WHEREAS, The City Council has the authority to impose reasonable conditions on a registered land survey.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as
follows:
1. The recitals set forth above are incorporated herein.
2. The registered land survey is approved at the property located north of Hwy 82 and east of Hwy 17(PID 25-
932-006-0, 25-932-008-1, 25-932-012-0, 25-932-008-2) subject to the conditions set forth in this resolution:
3. The registered land survey is subject to the following conditions:
a) The registered land survey shall be recorded at Scott County within 60 days of approval by the City Council.
Failure to record the documents by August 8, 2014 will render the registered land survey null and void.
