HomeMy WebLinkAbout14-113 Berens Bus Garage Plat Waiver 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 14-113 A RESOLUTION WAIVING PLATTING REQUIREMENTS FOR THE COMBINATION OF PROPERTY LOCATED AT 16731 WELCOME AVE (BERENS BUS GARAGE SITE) Motion By: Morton Second By: Soukup WHEREAS, Berens Enterprises LLC is the owner of property located 16731 Welcome Avenue; and WHEREAS, The property owner has asked the City Council to waive the platting requirements for this property to allow for the combination of two parcels (PID 259010085 and 259010087) with a total combined area of 2.2 acres zoned I-1 General Industrial property; and WHEREAS, The City Council has found that compliance with the restrictions set forth in Subsection 1006.100 of the Subdivision Ordinance will create an unnecessary hardship, and failure to comply will not interfere with the purpose of the Subdivision Ordinance; and WHEREAS, The City Council has approved the conveyance of this property by metes and bounds. NOWTHEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1.The recitals set forth above are incorporated herein. 2. The platting requirements are hereby waived per Subsection 1006.106. 3.The property owners may convey the combination of Parcel A and Parcel B as shown on the survey attached as Exhibit A. 4.Conveyance of this property is subject to the condition that the property owners submit deeds describing the newly created parcels.
