HomeMy WebLinkAbout14-116 No Wake Modified 4646 Dakota Street SE Prior Lake, MN 55372 RESOLUTION 14-116 A RESOLUTION ENACTING EMERGENCY TEMPORARY SLOW NO-WAKE RESTRICTIONS ON PRIOR AND SPRING LAKES Motion By: McGuire Second By: Keeney WHEREAS, The City of Prior Lake has the authority under Minnesota Statute 86B.205 to regulate the surface use of water bodies located entirely or partially in the City; and WHEREAS, The City of Prior Lake and Spring Lake Township have been granted authority by the Commissioner of the Department of Natural Resources under Minnesota Rule 6110.3700 to implement temporary emergency surface water restrictions; and WHEREAS, Spring Lake is located partially within the City of Prior Lake and partially within Spring Lake Township; and WHEREAS, The City Council adopted Resolution 14-112 and Spring Lake Township adopted Resolution 14-004 Enacting Emergency Temporary Slow No-Wake Restrictions on Spring Lake on July 15, 2014; and WHEREAS, Weather patterns have allowed draining of water from storage in the upper watershed, drying of soils and decrease of Spring Lake to a near normal level; and WHEREAS, A temporary dam was installed in the Spring Lake Outlet Channel to restrict the flow of water from Spring Lake. The dam has the potential for increasing the water level to an elevation of 912.7. Water at this level will saturated the shoreline again making it susceptible to more substantial erosion without continued protection from wave action. NOWTHEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA as follows: 1.The recitals set forth above are incorporated herein. 2.The Temporary slow-no-wake boating restriction in place for the entirety of Spring Lake is modified such that the slow no wake restriction is only within one hundred fifty feet (150’) from the shoreline. No watercraft towing a person on water skis, inner tube, aquaplane or similar device shall be operated at any time within one hundred fifty feet (150’) of shore provided however that any watercraft launching or landing a person on water skis, inner tube, aquaplane or similar device by the most direct and safe route to open water or shore shall be exempt from this provision. This modification shall be effective immediately upon the approval of both The City of Prior Lake and Spring Lake Township. The restriction will be lifted on August 14, 2014 or when the Spring Lake Outlet Channel dam is removed due to low water (Prior Lake is 903.00 or less) whichever occurs first unless the City and Spring Lake Township requests and the Minnesota Department of Natural Resources approves an extension. 3.Slow no-wake is defined as in Minnesota Statues 86B.005 as the operation of a watercraft at the slowest possible speed necessary to maintain steerage, but in no case greater than five miles per hour. 4.The primary enforcement agency is the County Sheriff’s office, however other licensed peace officers may also enforce the restrictions. 5.Any person who violates these emergency measures shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine of not more than five hundred dollars ($500.00). 6.The Public Works Director is directed to notify the public of these restrictions via the City website, posted notices at the public water access sites, press releases and other available means. 7.The Public Works Director is directed to notify the DNR Commissioner of this resolution through the DNR Boat and Water Safety Unit as soon as practicable.
