Prior Lake, MN 55372-1714 RESOLUTION 04-123 RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE REGISTERED LAND SURVEY FOR THE PROPERTY AT 14788 OAKLAND BEACH AVENUE SE MOTION BY: PETERSEN SECOND BY: LEMAIR The Prior Lake Planning Commission conducted a public hearing on July 12, 2004, to consider an application for the Registered Land Survey (RLS) for the property located at 14788 Oakland Beach Avenue SE, legally described as follows Leaal Description That part of Government Lot 7, Section 30, Township 115, Range 21, Scott County, Minnesota described as follows: Commencing at the corner of Lot 15, KNEAFSEY'S COVE, according to the recorded plat thereof in and for said county; thence on an assumed bearing of South 49 degrees 24 minutes 49 seconds East a distance of 300.39 feet along a line to the northeast corner of REGISTERED LAND SURVEY NO.1 00, as filed and of record in the Office of the Registrar of Titles, in and for said county; thence North 56 degrees 57 minutes 29 seconds West a distance of 100.00 feet to the northwest corner of said REGISTERED LAND SURVEY NO. 100 and the point of beginning of the land to be described; thence South 19 degrees 55 minutes 07 seconds West, along the westerly line thereof, a distance of 5.00 feet to a reference point marked by a Judicial Landmark; thence continuing South 19 degrees 55 minutes 07 seconds West a distance of 92.04 feet to a reference point marked by a Judicial Landmark; thence continuing South 19 degrees 55 minutes 07 seconds West a distance of 12 feet, more or less to the shoreline of Prior Lake; thence northwesterly, along said shoreline, to its intersection with the southerly extension of the east line of said Lot 15, KNEAFSEY'S COVE; thence North 0 degrees 02 minutes 57 seconds West, along said southerly extension, a distance of 19.00 feet, more or less, to a point on said line marked by an iron monument; thence continuing North 0 degrees 02 minutes 57 seconds West, along said east line a distance of 187.76 feet to said northeast corner of Lot 15; thence southeasterly a distance of 202.83 feet along a nontangential curve concave to the northeast having a radius of 514.84 feet, a central angle of 22 degrees34 minutes 20 seconds and the chord of said curve bears South 45 degrees 40 minutes 20 seconds East to the point of beginning. and Notice of the public hearing on said RLS has been duly published and posted in accordance with the applicable Minnesota Statutes and Prior Lake Ordinances; and All persons interested in this issue were afforded the opportunity to present their views and objections related to the RLS for the record at the Planning Commission hearing; and The Planning Commission and City Council have reviewed the RLS according to the applicable provisions of the Prior Lake Zoning and Subdivision Ordinances and found said RLS to be consistent with the provisions of said ordinances; and The Prior Lake City Council considered an application for approval of the RLS on August 2,2004; and 1:\04 files\04 subdivisions\04 final plat\gaida rls\resolution.doc www.cityofpriorlake.com Page 1 Phone 952.447.4230 / Fax 952.447.4245 WHEREAS: The City Council has approved the RLS for the property at 14788 Oakland Beach Avenue SE. NOW, THEREFORE, BE IT RESOL VEO BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The RLS for the above described property is approved. 3. The RLS and all pertinent documents must be filed with Scott County within 90 days from the date of final plat approval. Failure to record the documents by November 2,2004, will render the RLS null and void. Passed and adopted this 2nd day of August, 2004.
