The city's zoning ordinance requires that 40 square feet of outdoor play area be provided for • each pupil, which resulted in a 50 x 120 feet area (6,000 square feet) for up to 150 pupils. Based on information provided by the owner of the daycare business (see enclosed letter from Heather McCaustlin), the newly leased space will remain separate from the existing space and designated for "drop-in and school age child care", as defined in Minnesota Stat- utes 245A.14. It is my decision,as the Prior Lake Zoning Administrator, that additional outdoor play area is not necessary based on the following factors: 1. State statutes restrict the mixing of age groups to no more than a 36-month range in age among children (9503.0040, Subp. 3), resulting in a program restriction that im- pacts the number of children in the play area at any one time. 2. The newly leased space will be completely separate from the existing leased space, dedicated for drop-in and school age child care, which will not typically have those children using the outdoor play area before and/or after school. 3.
