LANGHORST and DELORES LANGHORST, husband and wife, being equitable owners of certain real property located in The City of Prior Lake, County of Scott, State of Minnesota, which is described in Appendix A, attached hereto, made a part hereof, and incorporated herein by reference, hereinafter referred to as "Langhorsts," and the CITY OF PRIOR LAKE, a municipal corporation under the laws of the State of Minnesota, located in the County of Scott, hereinafter referred to as "City," being desirous of entering into an Agreement with respect to certain property located within the corporate limits of the City, do hereby agree as follows: WHEREAS, the Langhorsts are the equitable owners of the property described on Appendix A, and desire to plat said property in accordance with the Subdivision Ordinance of the City; and WHEREAS, the City desires to have a certain portion of the property described on Appendix A designated and dedicated as Pleasant and Walker Avenues; and WHEREAS, the City is desirous of having the Langhorsts grant the City a storm sewer easement over that portion of the north ten (10) feet of Lot 3, Block 14, original town site of Prior Lake, which is included in the property described in Appendix A; and WHEREAS, it was the intent of the Langhorsts to plat the property described on Appendix A without a dedication of Pleasant Avenue, Walker Avenue, or granting of the above-described storm sewer easement; and WHEREAS, it is the desire of the City that the Langhorsts dedicate a triangular roadway easement at the intersection of Pleasant Avenue and Walker Avenue to provide a more orderly inter- section; and WHEREAS, proper road engineering requires that Pleasant Avenue intersect Walker Avenue and State Highway #13 at the perpendicular; NOW THEREFORE, it is agreed by and between the parties in consideration of the covenants and agreements contained herein, which consideration is acknowledged sufficient by all parties, as follows: 1. That the City shall approve the preliminary plat presented by the Langhorsts to the City Planning Commission on December 16, 1976, subject to the Langhorsts granting the above-described storm sewer easement and the triangular easement above mentioned at the intersection of Walker and Pleasant Avenues, and further subject to correc- tions of the north and south lines of Pleasant Avenue, straightening the arc of said lines, and rezoning to B-2, if necessary, the affected portion along the south line of Lot 3 of the proposed plat, to make it homogeneous with the remainder of Lot 3; said plat including the dedication of Walker and Pleasant Avenues; 2. The City agrees to assess only 50% of the cost of Pleasant Avenue lying within the proposed plat to the abutting landowners (save and except any portion assessed to the abutting landowners due to assess- ments levied against the entire city or the downtown development area); said assessments to be accomplished in the fOllowing manner: a. The property to the north of Pleasant Avenue lying within the proposed plat will be assessed 25% of the cost of the Pleasant Avenue extension lying within the plat, the payments for said assessment to commence no sooner than five years after the date of this Agreement. b. The property adjacent to and southerly of the Pleasant Avenue extension lying within the proposed plat shall be assessed 25% of the costs of the Pleasant Avenue Extension lying within the plat, and the assessments there- fore shall be deferred until the property adjacent to and southerly of the Pleasant Avenue extension lying within the proposed plat shall be developed. 3. The City agrees to assess only 50% of the normal assess- ment, for the costs of Walker Avenue, to the abutting landowners (save and except any portion assessed to the abutting landowners due to assessments levied against the entire city or the downtown development area); 4. The City agrees to provide and authorize that there shall be public parking allowed on both the north and south sides of Pleasant Avenue between Main Street and Minnesota State Highway No. 13. 2 5. The City agrees that the parking authorized by Para- graph 4 on Pleasant Avenue shall be considered and counted as parking on Lot 3 of the proposed plat, in order to help satisfy the minimum parking stall requirements for any improvements on Lot 3 of the proposed plat. 6. Due to the large amount of land being dedicated to the public for roadways, the City agrees to require no more than $1,400.00 as and for park dedication fee for the property described as Appendix A. 7. The City agrees to authorize and allow construction of a building with a zero setback on the westline of Lot 2 of the proposed plat. THIS AGREEMENT shall continue and be binding on the City and all its successors, councils and agents, and on the Langhorsts, their successors, heirs and assigns.
