Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AUGUST 16, 2004 SF JANE KANSIER, PLANNING DIRECTOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE FINAL PLAT AND AUTHORIZING EXECUTION OF THE CITY'S STANDARD DEVELOPMENT CONTRACT FOR DEERFIELD INDUSTRIAL PARK AGENDA ITEM: DISCUSSION: Historv: On April 19, 2004, the City Council adopted Resolution 04-72 approving the preliminary plat for Deerfield Industrial Park. The preliminary plat consisted 60.93 acres to be subdivided into 6 outlots for future development. The final plat to be known as Deerfield Industrial Park encompasses all of the Deerfield Industrial Park development. This final plat creates 4 outlots for future development. Outlot A is zoned R-4 (High Density Residential) and is intended for future residential use. Outlot B is zoned C-5 (Business Office Park), and is intended for future business office park uses. Outlot C is zoned C-4 (General Business) and is intended for future commercial uses. Outlot D is zoned 1-1 (Industrial) and is intended for future industrial development. The plat also includes a 33.65 acre Park located south and west of the rest of the plat. Most of the dedicated park is wetland area; however, there is an upland area within the parcel. The staff has agreed to accept this land for park dedication as long as the developer provides an easement from the existing Deerfield residential area to access the land. This item was originally scheduled for the August 2,2004 City Council meeting. The item was removed from that agenda because the developer had not addressed all of the issues. Current Circumstances: The principal requirements for final plat approval include a signed Development Contract with surety for the installation of utilities and streets and the satisfactory completion of all preliminary plat conditions. Staff has reviewed the final plat and finds it to be in substantial compliance with the approved preliminary plat. There are still some conditions that must be met prior to final approval of the plat. An Army Corps of Engineers permit. The developer has indicated he is working on this permit, and that it will be complete prior to approval of the final plat. . A WCA wetland banking application. . The developer must provide an easement through the Deerfield development to the park. . The name of Deerfield Lane must be changed to a street name not already used within the City. The first 2 conditions must be met before the developer may commence any work on the site. The last 2 conditions must be satisfied before the City will sign the final plat. The final plat is also subject to six conditions that must be satisfied prior to the release of the final plat documents. The Issues: The Development Contract specifies the required improvements for this plat. Sanitary sewer and watermain trunk area charges and collector street fees are outlined in the Contract. The parkland dedication requirements for this plat will be satisfied by a land dedication. This subdivision is also subject to a $125,000 escrow for left turn lanes on CSAH 21. Because this final plat consists entirely of outlots, very few fees will be collected at this time. As each outlot is replatted for development, a new Development Contract will be required. The fees will be collected at that time. Another unusual aspect of this Development Contract relates to the construction of the street labeled as Deerfield Lane. The staff has agreed to allow the developer to phase this construction, as long as the right-of-way is platted. The Development Contract spells out the criteria for the construction of this street. Essentially, the Developer will be required to improve the street and extend the utilities when Outlot B and Outlot C are both 50% developed, or when either outlot is platted adjacent to the right-of-way. The developer has agreed to these terms. Conclusion: The staff has been working with the Developer to complete the Development Contract. This contract will be delivered to the City Council prior to the meeting on Monday. Staff will be available to discuss the details of this Contract with the Council. The Developer has agreed to sign the Development Contract prior to the City Council meeting. If the Contract is not signed, this item will be removed from the agenda. FISCAL IMPACT: Budaet Imoact: Approval of this final plat will allow construction of new commercial and industrial buildings, which will contribute to the City's tax base. The required development fees are deposited into the appropriate City accounts. ALTERNATIVES: The City Council has three alternatives: 1:\04 files\04 subdivisions\04 final plat\deerfield industrial park\cc report2.doc Page 2 1. Adopt the resolution approving the final plat and Development Contract for Deerfield Industrial Park. 2. Deny the resolution approving the final plat. 3. Defer this item and provide staff with specific direction. RECOMMENDED MOTION: Staff recommends Alternative #1. This requires the following motion: 1. A motion and second to adopt a resolution approving the final plat and Development Contract for Deerfield Industrial Park and authorizing the Mayor and Ci Manager to sign the Development Contract. MOTION BY: SECOND BY: WHEREAS: on April 19, 2004, the City Council approved the preliminary plat known as Deerfield Industrial Park, subject to conditions identified by Resolution 04-72; and WHEREAS: The City Council has found that the final plat of "Deerfield Industrial Park" is in substantial compliance with the approved preliminary plat for Deerfield; and WHEREAS: The City Council accepts the dedication of the parcel labeled as "Park" on the final plat of "Deerfield Industrial Park" to satisfy the parkland dedication requirements; and WHEREAS: The City Council has approved the final plat of "Deerfield Industrial Park." NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and recording of said plat: 1. The recitals set forth above are incorporated herein as if fully set forth. 2. The final plat of "Deerfield Industrial Park" is approved subject to the conditions set forth in this resolution. 3. The final plat of "Deerfield Industrial Park" is subject to the following conditions, which shall be met prior to release of and recording of the final plat: a. An Army Corps of Engineers permit must be submitted before any utility work may commence on the site. b. A WCA wetland banking application must be submitted before any utility work may commence on the site. c. The developer must provide an easement through the Deerfield development to the park. d. The name of Deerfield Lane must be changed to a street name not already used within the City. e. A current title opinion or commitment of title insurance must be submitted acceptable to the City Attorney. f. Payment of all fees prior to release of the final plat mylars. g. Reductions of the entire final plat be submitted, to the following scales: 1" = 200'; and one reduction at no scale which fits onto an 81/2" x 11" sheet of paper. h. Three mylar sets of the final plat with all required signatures must be submitted. i.
