CONSIDER APPROVAL OF A RESOLUTION APPROVING THE
PRELIMINARY DESIGN PLAN FOR THE REALIGNMENT OF
CSAH 12 FROM TH 13 TO CSAH 17
DISCUSSION:

At the July 19th Council Meeting several issues were identified by
the Council with regards to approving the proposed CSAH 12
alignment from TH 13 to CSAH 17. The Council requested
additional information from staff on 3 specific issues prior to making
any decisions on the proposed alignment.
Issues
1. Proposed Sidewalk Desifln
Council asked staff to investigate alternatives to the staff
recommendation of 5' concrete sidewalks on both sides of
segment 2. Attached for your review is a design matrix that
discusses the pros and cons for 6 alternative sidewalk designs in
segment 2. Questions regarding sidewalk and trail design on
segments 1 and 3 and for crossing locations are contingent on
Council directive for segment 2.
2. Additional Drivewav Access at 3582 Basswood Circle
The resident at this address has an additional driveway access to
CSAH 12 for a car storage area located on his lower level. This
access is proposed to be closed by the County as the resident has
access to Basswood Circle. Council requested that staff review
the resident's concern and report back on access options.
The County will consider a special driveway permit for this
access. The permit will contain specific stipulations regarding
use of the driveway to be agreed upon by the County and
resident. Because the property owner is requesting the access
onto CSAH 12 they will most likely be subject to an assessment
to be determined for the reconstruction of CSAH 12.

3. Sailer Propertv Green Acres
A question regarding the status of green acres for the Sailer
property located northeast of the CSAH 12/17 intersection was
posed at the previous meeting.
The County has reviewed the green acres status for this property
and determined that the two 10 acres parcels at his location are
currently enrolled as a single 19.9-acre parcel in the program.
Any County land acquisition from this parcel (estimated to be up
to 1.6 acres) would not affect the green acres status of the parcel
as it still exceeds the 10-acre minimum.
Additional questions of staff related to burial of utilities and
assessments will be answered as the project proceeds. These
questions are not pertinent to the decision regarding the design
alignment.
Conclusion
Staff believes the only outstanding issue for determination of the
design alignment is a decision as to sidewalk design for segment 2.
ALTERNATIVES:
The alternatives are as follows:
1. Adopt the attached resolution that approves the Preliminary
Design/Alignment for Improvement of CSAH 12 from TH 13 to
CSAH 17, City Project 04-02 with a preferred sidewalk design
for segment 2 and direction on sidewalk design on segments 1
and 3.
3. Deny this item for a specific reason and provide staff with
direction.
4. Table this item for specific reason.
RECOMMENDED
MOTION:
Alternative 1 above. If the Council elects a sidewalk design other
than #1 in the attache matrix, the resolution should be modified to
reflect that decision.

The City has planned the CSAH 12 Improvement Project, City Project No. 04 - 02,
and identified this project for construction in the Capital Improvement Program in
2006, and
A preliminary design/alignment for the improvement of CSAH 12 from TH 13 to
CSAH 17 has been completed by City and County staff for City Council approval.
The Consultant, Bolton & Menk, Inc. will proceed with preparation of construction
plans based on the preliminary design/alignment for the project and the County will
begin easement and right of way acquisition for the project.
The City supports the conceptual street plan for areas south of TH 13 near the
CSAH 12 intersection for use of Access Management Funds as stipulated by
MnDOT.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The preliminary design/alignment for CSAH 12 is approved as recommended by staff.

RE: C.R. 12 Preliminary Design & Alignment Approval
Please note that the consultant has notified us of a clarification on the sidewalk selection design
matrix. Underoption 6 - Property Impacts, the addresses should read" 3031 or 3044" not "3031 and
3034". The County would only need to consider a total take for 3044 if the road shifted North and for
3031 if the road shifted south. This option will only result in 1-total take and not 2 as stated in the
matrix.
Also please be aware that some of the residents on CR 12 have petitioned the Environmental Quality
Board (EQB) for preparation of an Environmental Assessment Worksheet (EAW) for the project. The
project does not fall under any mandatory EAW categories, but residents may request an EAW if valid
environmental concerns are raised. The EQB has forwarded the request to Scott County for
determination as to whether the request is valid and an EAW is required. The County previously
reviewed the project for compli~rnce with EQB standards and determined that an EAW was not
required. The details of this request have not been provided to the City at this time.
John Larson of the EQB indicated to me on Friday that the decision regarding alignment can still be
made by the City prior to determination of the EAW status as long as final design and any Right-of-
Way acquisition aren't undertaken prior to that determination. If an EAW is required it is preferable to
have the preliminary alignment details for preparation of the document.
