RE: Connection Permit Application to MWCC Facilities
Dear Mr. Raaen:
The Metropolitan Waste Control commission has reviewed your
application to connect to our Metropolitan Interceptor 71-20-02 at
3960 - 140th Street in the City of Prior Lake. Our review of your
application indicates the property to be served by this proposed
connection is outside of the Metropolitan Urban Service Area
(MUSA) .
Metropolitan sanitary sewer service can only be provided to
property determined to be within the MUSA as consistent with an
approved local Comprehensive sewer plan (CSP). The Commission,
therefore, cannot issue a permit for this connection at this time.
The City will need to first submit a comprehensive plan amendment
to the Metropolitan Council to include the project within the MUSA
in order for the Commission to further consider your connection
application.
The connection application indicates the property is to be served
via a 4-inch sewer connection to an existing 12" stub. The City
should indicate in any re-submittal of this application how future
development will be served and connected at this location.

PERMIT
It has been determined that Applicant has adopted a comprehens i ve
sewer plan, has submitted it to commission as required by law, and
that the proposed connection to, or use of, commission facilities'
conforms to the adopted comprehensive plan or adopted revisions
thereof. .
Permission is hereby granted to Applicant for connection to, or use
of, Commission facilities in accordance with the description provided
by Applicant. This permit is issued under the following terms and
condi tions :

Minnesota Pollution Control Agency or the necessity of securing other
permits and fulfilling requirements of other governmental units.
3. The Commission's issuance of this permit does not constitute
a certification that the project design and construction proposed by
Applicant meet engineering standards. Applicant remains responsible
for design and construction, including safety, for the project.
Applicant's attention is specifically directed to the confined space
rules adopted by the Minnesota Department of Labor and Industry, OSHA
Regulations, Parts 5202.100 through 5205.1040 and 5207.0300.
4. This permit shall be null and void if the connection
proposed by Applicant is not made within 90 days from the date of
issuance.
5. This permit is subject to modification or revocation and may
be suspended at any time for failure to comply with its terms.

Donald and Terry Johnston have petitioned the City and the MWCC
to allow connection to the interceptor because their septic
system has failed. The connection fee for the 9.69 acre tract
shall be based upon the 330' of frontage abutting CSAH 42. The
acreage rate shall be applied to the area measured at the 150'
depth of the property.
The Johnstons have requested the connection fee to be assessed
against their property over a period of 10 ~ears subject to an
interest rate of 8.0%. The amount and distr1bution have been
determined as follows:
