Call to Order: Chairman Stamson called the July 12, 2004, Planning Commission meeting to order at 6:30 p.m. Those present were Commissioners Lemke, Perez and Stamson, Planning Director Jane Kansier, Planning Coordinator Danette Moore, Assistant City Engineer Larry Poppler and Recording Secretary Connie Carlson. 2. Approval of Minutes: The Minutes from the June 28, 2004, Planning Commission meeting were approved as presented. 4. Consent: 5. Public Hearings: Commissioner Stamson read the Public Hearing Statement and opened the meeting. A. Case #04-84 Edmund and Helen Gaida submitted an application for a RLS to create a single lot for the property located at 14788 Oakland Beach Avenue SE. Planning Director Jane Kansier presented the Planning Report dated July 12, 2004, on file in the office of the City Planning Department. The purpose of this public hearing is to consider an application for a Registered Land Survey (RLS) of the unplatted property located at 14788 Oakland Beach Avenue SE. The purpose of the RLS is to create a single lot and simplifY the legal description for the existing parcel. The proposed RLS does not create any additional lots and includes one tract, Tract A, which is the site of the existing dwelling. The proposed RLS generally meets the standards of the Subdivision Ordinance and Zoning Ordinance. The Planning staff recommended approval of this RLS subject to conditions. Stamson questioned if the property extended to the lake. Kansier responded it did. Dale also stated the original property did in fact go down to the lake. The public hearing was closed at 6:36 p.m. Comments from the Commissioners: Lemke/PerezlStamson: . Agreed with staff and their recommendations to approve. . It meets the requirements and is an appropriate way to handle this issue. MOTION BY LEMKE, SECOND BY PEREZ, RECOMMENDING CITY COUNCIL APPROVE THE REGISTERED LAND SURVEY. Vote taken indicated ayes by all. MOTION CARRIED. This item will go to the City Council on August 2, 2004. B. Case #04-86 Deerfield Development is requesting an amendment to Section 1107.2202 of the Zoning Ordinance to allow cast-in-place or precast concrete panels as Class I materials in the 1-1 (Industrial) district. Planning Director Jane Kansier presented the Planning Report dated July 12, 2004, on file in the office of the City Planning Department. Deerfield Development has filed an application to amend Section 1107.2202 of the Zoning Ordinance to allow cast-in-place or precast concrete panels as a Class I material in the 1-1 (Industrial) district. Although the applicant has applied for this amendment in order to develop the Deerfield Industrial Park, the amendment will apply to all Industrial districts. The proposed amendment is consistent with the architectural standards in the C- 5 district, which is intended to have a higher standard of construction and design. The Planning Commission may want to consider including additional design standards with the expanded use of materials. This might involve the use of contrasting bands, colors or materials. The purpose of this would be to avoid the appearance oflarge, blank concrete walls. If the Planning Commission wants to add this option, it should be included as part of the criteria in the C-5 district to be consistent. The proposed amendment is consistent with the goals and objectives of the Comprehensive Plan and the enabling legislation set forth in Minnesota statutes. Based upon the findings set forth in this report, staff recommended approval. Kansier responded a pole bam would not meet the definition. There are some products that have interlocking panels that do. It might be something that should be looked at again in the ordinance, especially with the progression of the precast concrete. Stamson said it did seem lower quality than required in the CS District. Comments from the Public: None Comments from the Commissioners: Perez: . Agreed with staff, it makes sense. . Community Development Director, John Sullivan notes this was an oversight. . Agreed with the staff's Findings to maintain high standards. . Approve. Lemke: . Agreed with staff's findings. It is a higher standard. . I like the colored panels, it is very attractive and durable. . Support. Stamson: . Agreed - the precast panels would be very attractive in the II District. They also provide a reasonably priced alternative for construction. That can be important in the II District where the buildings are more industrial in use than an office showroom in the CS. . Support. MOTION BY LEMKE, SECOND BY PEREZ, RECOMMENDING APPROVAL OF THE PROPOSED AMENDMENT. Vote taken indicated ayes by all. MOTION CARRIED. This item will go before the City Council on August 2, 2004. 6. Old Business: A. Case #04-82 & 04-83 Tradition Development has applied for approval of a Planned Unit Development Final Plan for the property located south of 170th Street and north of Crystal Lake. The proposal calls for a townhouse development consisting of 33 dwelling units on 11 acres. Planning Director Jane Kansier presented the Planning Report dated July 12, 2004, on file in the office of the City Planning Department. L:104 F1LESI04 PLAN COMMlS\04 pc MinuteslMN071204.doc 3 Planning Commission Meeting July J 2, 2004 Tradition Development has applied for apfroval of a Planned Unit Development Final Plan for the property located south of 170 Street and north of Crystal Lake. The proposal calls for a townhouse development consisting of33 dwelling units on 11 acres. The development also proposes a public park and private open space. On May 17, 2004, the City Council adopted Resolution #04-89 approving a Planned Unit Development Preliminary Plan for this site, as well as a preliminary plat. The resolution listed the following conditions of approval: I. The landscaping plan should be revised to meet all ordinance requirements. Replacement trees must be included on the landscaping plan. 2. The private streets must be platted as outlots. A 13' wide drainage and utility easements must be provided on either side of the outlot. 3. The developer must provide easements for the storm water pond. 4. Provide full-scale building elevations and floor plans, including height and building materials. 5. Provide the required calculations for impervious surface and floor area ratio. 6. Include Outlot A as parkland. Also, revise the configuration of the proposed park so the west boundary is an extension ofthe easterly lot line for Unit 9. Include calculations of the net area (less wetlands) to be dedicated as park. Parkland must be identified as Park on the final plat. 7. Address the listed Engineering issues. The staff suggested the following findings: I. The Final PUD Plan is consistent with the approved preliminary plan. 2. The Final PUD Plan is consistent with the criteria for a PUD listed in Section 1106.100 and 1106.300 of the Zoning Ordinance. This plan is also consistent with the City Council findings listed in City Council Resolution #03-185. The staff also recommended approval of the Final PUD Plan subject to the following conditions: 1. The Final Plat and Development Contract must be approved by the City Council. 2. A signed PUD agreement must be approved by the City Council. Stamson questioned the stormwater pond system. Kansier and Poppler explained the applicant has been working extensively with the City Staff and Watershed District to try to reduce or eliminate the ponding as much as possible. There is a trench infiltration system waiting to be approved by the Watershed District. The applicants are concerned about timing at this stage. They can go back to the original pond. It does not affect the design. They have explored many options. There were minor changes. Overall the development will be an asset to the community. . Support. Lemke: . Staff did a great job of laying out the Findings. . Impressed 100% of the shoreline is undisturbed. In favor of this in the preliminary stage. . Support. Perez: . Agree the conditions have been met. No issues. . Feel comfortable sending this to the City Council. . Approve MOTION BY PEREZ, SECOND BY LEMKE, RECOMMENDING APPROVAL OF THE FINAL PUD PLAN SUBJECT TO THE LISTED CONDITIONS. Vote taken indicated ayes by all. MOTION CARRIED. This item will tentatively go before the City Council July 19. 7. New Business: None 8. Announcements and Correspondence: Staff presented the St. Paul Pioneer Press article on Prior Lake. Danette Moore was officially introduced as the new Planning Coordinator. 9.
