Prior Lake, MN 55372-1714 RESOLUTION 04-138 (C-CC) RESOLUTION APPROVING A PROPOSED AMENDMENT TO THE 2020 COMPREHENSIVE PLAN LAND USE MAP FOR THE PROPERTY LOCATED NORTH OF CSAH 42, WEST OF PIKE LAKE TRAIL, AND SOUTH OF PIKE LAKE MOTION BY: PETERSEN SECOND BY: BLOMBERG RECITALS WHEREAS, Arima Real Estate Development submitted an application for an amendment to the City of Prior Lake 2020 Comprehensive Plan Land Use Map to change the designation of the following described property from the R-HD (High Density Residential) designation to the C-CC (Commercial Retail Shopping) designation: Legal Description (C-CC): 'T'hatpartofthe herein after described property which lies south and west of the following descrioeclline: Commencing at the southeast corner of said Southeast Quarter of the Southwest Quarter; thence on an assumed bearing of North 00 degrees 00 minutes 00 seconds East along the east line of said Southeast Quarter of the Southwest Quarter 544.30 feet to the point of beginning for the line to be described; thence North 82 degrees 00 minutes 00. seconds West 181.53 feet; thence 156.91 feet along a tangential curve concave to the. northeast, having a . radius of 326.12 feet; thence North. 54 degrees 26 minutes 00 seconds West 189.92 feet; thence North 90 degrees 00 minutes 00 seconds West 14.03 feet; thence North 00 degrees 00 minutes 00 seconds East parallel with said east line of the Southeast Quarter of the Southwest Quarter 15.29 feet to the point of beginning of the herein after described second exception; thence continuing North 00 degrees 00 minutes 00 seconds East 564.55 feet along the east line of the second herein .. after described exception to the north line of said Southwest Quarter of the Southeast Quarter of Section 23 and said line there terminating. EXCEPT: the West 400 feet of the Southeast % of the Southwest % of Section 23, Township 115 North, Range 22 West, said 400 feet to be measured along the North and South lines of said Southeast % of the Southwest %, according to the recorded plat thereof on file and of record in the office of the Register of Deeds in and for the County of Scott, Minnesota. and WHEREAS, Legal notice of the public hearing was duly published and mailed in accordance with Minnesota Statutes and Prior Lake City Code; and WHEREAS, The Planning Commission conducted a public hearing on August 23, 2004, for those interested in this request to present their views; and WHEREAS, On August 23, 2004, the Planning Commission recommended approval of the proposed amendment to the Comprehensive Plan on the basis the C-CC designation is consistent with the goals and objectives of the Comprehensive Plan; and WHEREAS, On September 7,2004, the Prior Lake City Council considered the proposed amendment to the 2020 Comprehensive Plan Land Use Map to designate the above described property to the C-CC designation and; WHEREAS, The City Council received the recommendation of the Planning Commission to approve the proposed Comprehensive Plan amendment along with the staff reports; and WHEREAS, The City Council has carefully considered the testimony, staff reports and other pertinent information contained in the record of decision of this case. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA, that: 1. The above recitals are herein fully incorporated herein as set forth above. 2.
