CONSIDER APPROVAL OF A RESOLUTION APPROVING THE FINAL PLAT
AND AUTHORIZING EXECUTION OF THE CITY'S STANDARD
DEVELOPMENT CONTRACT FOR DEERFIELD INDUSTRIAL PARK SECOND
ADDITION

DISCUSSION:
Historv: On April 19, 2004, the City Council adopted Resolution 04-72 approving
the preliminary plat for Deerfield Industrial Park. The preliminary pi at consisted of
60.93 acres that were subdivided into 6 outlots for future development. The final
plat was approved on August 16, 2004 with the adoption of Resolution 04-125.
The final plat created 4 outlots for future development.
The Deerfield Industrial Park 2nd Addition Final Plat is proposed as the following:
· Lots 1-2, Block 1 will provide sites for C-5 (Business Office Park)
uses. Outlot A is zoned C-5 and is intended for future business
office park uses.
. Lots 1-2, Block 2 will provide sites for C-4 (General Business) uses.
Outlot B is zoned C-4 and is intended for future commercial uses.
· Lots 1-5, Block 3 and Lot 1, Block 4 will provide for 1-1 (Industrial)
uses. Outlots C, D, and E are zoned 1-1 and are intended for future
industrial uses.
The plat also includes a 33.65 acre park located south and west of the rest of the
plat.
Current Circumstances: The principal requirements for final plat approval
include a signed Development Contract with surety for the installation of utilities
and streets and the satisfactory completion of all preliminary plat conditions.
Staff has reviewed the final plat and finds it to be in substantial compliance with
the approved preliminary plat.
The Issues: The Development Contract specifies the required improvements for
this plat. Applicable fees are outlined in the Contract. The parkland dedication
requirements for this plat will be satisfied by a land dedication. The first addition
plat approval required the developer to provide an access easement for the park,

prior to the release of the final plat. The applicant has not yet submitted this
necessary easement and will be required to as a condition of approval.
The staff has agreed to allow the developer to phase the construction 01 Industrial
Lane, as long as the right-ol-way is platted. The Developer is required to improve
the street and extend the utilities when Outlot B and Outlot C are both 50%
developed, or when either outlot is platted adjacent to the right-of-way. The
developer has agreed to these terms.
The lot dimensions of Outlot D have been established by the configuration of the
neighboring lots. Outlot D cannot be further subdivided. For that reason, staff
recommends that Outlot D be platted as Lot 2, Block 4 at this time. The Scott
County Surveyor has assured staff that this change will be viewed as minor and
will not cause significant delay lor the developer. The development contract
distributed to the developer will need to be revised to reflect this change.
Conclusion: This contract will be delivered to the City Council prior to the
meeting on Monday. Staff will be available to discuss the details of this Contract
with the Council.
FISCAL IMPACT:
Budaet ImD8ct: Approval of this final plat will allow construction of new business
establishments, which will contribute to the City's tax base. The required
development fees are deposited into the appropriate City accounts.
AL TERNA TIVES:
The City Council has three alternatives:
1. Adopt the resolution with conditions approving the final plat and Development
Contract for Deerfield Industrial Park 2nd Addition.
2. Deny the resolution approving the final plat.
3. Defer this item and provide staff with specific direction.
RECOMMENDED
MOTION:
Staff recommends Alternative #1. This requires the following motion:
1. A motion and sec d to adopt a resolution approving the final plat and
Development Co ract for Deerfield Industrial Park 2nd Addition and
utho in he yor and City Manager to sign the Development Contract.

RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE FINAL PLAT OF
"DEERFIELD INDUSTRIAL PARK 2ND ADDITION" AND DEVELOPMENT CONTRACT AND
SETTING FORTH CONDITIONS TO BE MET PRIOR TO RELEASE OF THE FINAL PLAT.

WHEREAS: On April 19, 2004, the City Council approved the preliminary plat known as
Deerfield Industrial Park, subject to conditions identified by Resolution 04-72;
and
WHEREAS: The City Council has found that the final plat of "Deerfield Industrial Park 2nd
Addition" is in substantial compliance with the approved preliminary plat for
Deerfield Industrial Park; and
WHEREAS: The City Council has approved the final plat of "Deerfield Industrial Park 2nd
Addition."
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to
be met, prior to release of, and recording of said plat:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. The final plat of "Deerfield Industrial Park 2nd Addition" is approved subject to the conditions
set forth in this resolution.
3. The final plat of "Deerfield Industrial Park 2nd Addition" is subject to the following conditions,
which shall be met prior to release of and recording of the final plat:
a. A current title opinion or commitment of title insurance must be submitted acceptable to
the City Attorney.
b. Payment of all fees prior to release of the final plat mylars.
c. Reductions of the entire final plat be submitted, to the following scales: 1" = 200'; and
one reduction at no scale which fits onto an 81/2" x 11" sheet of paper.
d. Four mylar sets of the final plat with all required signatures must be submitted.
e. The developer must provide financial security, acceptable to the City Engineer prior to
release of the final plat mylars.
f. The developer must provide and record an access easement to the dedicated parkland
area.
g. The final plat of "Deerfield Industrial Park 2nd Addition" shall be revised to plat Outlot 0 as
Lot 2, Block 4.

h. The final plat and all pertinent documents must be filed with Scott County within 90 days
from the date of final plat approval. Failure to record the documents by February 7,
2005, will render the final plat null and void.
4. The Mayor and City Manager are hereby authorized to execute the Development Contract
on behalf of the City.
