CONSIDER APPROVAL OF A RESOLUTION APPROVING
AN AMENDMENT TO THE CRYSTAL BAY PUD TO
CHANGE THE STYLE OF THE TOWNHOUSE UNITS
DISCUSSION:
Historv: The Crystal Bay Planned Unit Development (PUD) was approved
by the City Council on December 1,2003. The approved PUD Plan included
24 townhouse units in 12 buildings. The proposed townhouses were a 3-
story walkout, attached single family style dwelling with an attached garage.
Each of the units in these buildings included a 3-car garage, rear yard decks,
and approximately 4,610 square feet of floor area. The buildings are 34'
high at the front, with exteriors consisting of a combination of brick and
stucco. Building elevations and sample floor plans for each of these
buildings are attached to this report.
Current Circumstances: 212 Development Group and Manley Brothers
Construction are proposing a minor amendment to the approved PUD. The
proposed amendment affects the style, size and exterior elevations of the
proposed townhouse units. The 3-story walkout buildings are proposed to be
replaced with a rambler style unit, with a 3-car attached garage, a rear yard
deck and a four season porch. The exterior of the building will consist of
Hardie Board siding and shakes, rather than stucco and brick. The ground
floor area of the units remains the same, and the units will fit into the
existing envelope lots.
The Planning Commission considered this amendment on September 27,
2004. The Planning Commission recommended approval of the amendment.
Section 1106.607 of the Zoning Ordinance allows the City Council to
approve minor amendments to an approved PUD Plan by resolution
following notification of all owners of property within the PUD. A minor
amendment includes "changes that increase conformity with Ordinance
requirements; decreases in residential density, leasable floor area, building
height, impervious surface and/or required parking provided such decreases
have a minimal impact on the overall character of the approved Final PUD
Plan as determined by the Zoning Administrator; minor building additions
and floor plan modifications that do not increase parking requirements or
reduce useable open space; and changes that are specified as minor
amendments in the approved Development Contract. "

The Issues: The major issue is whether or not the proposed amendment will
change the character of the PUD. The amendment does not change the
number of units or the ground floor area of the buildings. The proposed
amendment does decrease the amount of floor area and the height of the
buildings. The amendment also changes the look ofthe buildings. The
major change is the price point of the buildings.
The applicants conducted a neighborhood meeting to discuss the proposed
changes to the PUD plan. Notes from this meeting are attached to this
report.
Conclusion: The proposed amendment is minor, and will not alter the
character of the PUD.
Budf!et Imoact: There is no immediate budget impact as a result of this
request. The construction of new dwellings will provide additional tax base
to the City.
The City Council has three alternatives:
1. Adopt a resolution approving the minor amendment to Crystal Bay PUD
Plan as proposed.
2. Deny the proposed amendment. In this case, the Council should direct
the staffto prepare a resolution with findings off act for the denial of
these requests.
3. Defer consideration of this item for specific reasons.
Staff recommends alternative # I. A motion and second adopting a
resolution approving the minor amendment to the Crystal Bay PUD Plan is
appropriate.

212 Development Group and Manley Brothers Construction have submitted an application for a minor
amendment to the approved development plan for the Crystal Bay Planned Unit Development Plan by
changing the style of the buildings approved with the original approved PUD plan; and
The Prior Lake Planning Commission considered the proposed minor amendment on September 27,
2004; and
The Prior Lake City Council considered the proposed minor amendment to the approved development
plan for the Crystal Bay PUD on October 4, 2004; and
Owners of property within the Crystal Bay PUD have been notified of the proposed minor amendment in
accordance with Section 1106.607 (2) b of the Zoning Ordinance; and
The City Council finds the minor amendment to the Crystal Bay PUD consistent with certain elements of
the Comprehensive Plan and the Zoning Ordinance; and
The City Council finds the minor amendment is in harmony with both existing and proposed development
in the area; and
The City Council finds the minor amendment does not affect the approved overall density of the PUD; and
The City Council finds the minor amendment is compatible with the stated purposes and intent of the
Section 1106 Planned Unit Developments of the Zoning Ordinance; and
The City Council finds the proposed minor amendment adequately provides for internal organization,
uses, circulation, public facilities, recreation areas and open space.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, MINNESOTA,
1. The above recitals are incorporated herein as if fully set forth.
2. The Crystal Bay PUD Final Plan is amended to revise the style of the townhouse units as shown on Exhibit A to this
resolution
Passed and adopted this 4fu day of October, 2004.

about 16 people showed up, mostly couples
- 2 different families to the East - right behind the proj ect
- neighbor to the Southeast
- couple from across the street in the townhomes to the West
people had very few questions on the new design
they liked that we made it a rambler
they were anxious to get is started so it would get done
they said it has been dragging on way too long
they had general qllestions about how the unit was placed, I told them that
land had not changed
they wanted answers to development questions like:
- when is the dirt getting hauled off
- are we putting a fence in
they seemed a little unhappy with the developer, which is very common, but
they were glad we were starting
most people didn't talk much or have very many questions
there were two or three people that asked several questions
I handed out the drawing for our model to all people that showed up
one other question they asked was about the widening of the road, I told them
I didn't know anything about it
Overall, the meeting was very positive and they were ready for someone to get started.

CYRSTAL BAY TOWNHOME CHANGES
- Exterior Elevation Changes
- Overall look changed I cleaner I sharper look
- Hardie Bd. Siding & shakes - 4 sides I wi stone; changed from stucco & stone
- Overall Ground Cover is less
- Clients are only allowed to make design same size as previous design or less
- Using the previous ground cover, we changed the design to have more options,
all of which will be less in ground cover .
- With having options, the floor plan will change, but elevations will remain the
same with small changes
- All designs will be less in ground cover
- Rambler Style Living (not 2-story)
- Floor Plan Layout changed
- Square footage differs between buildings! never goes over previous
- Moved kitchen to back...... to change views to the lake ground coverage
- Added 4-season porch...... to help with views to lake
- Added office to main floor
- Price point changed...... to help with views to lake
- Complexity of construction (much easier) ...... with floor plan & elevations changing for
ease of construction and cleaner look
- Took off wrap around front porch...... to add more of the available ground cover into unit
