Prior Lake, MN 55372-1714 MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: INTRODUCTION: OCTOBER 4, 2004 lOA DANETTE MOORE, PLANNING CONSIDER APPROVAL OF A ZONING ORDINANCE AMENDMENT PERTAINING TO THE PROCEDURES FOR THE COMBINED APPROVAL OF A COMPREHENSIVE PLAN AMENDMENT AND AN AMENDMENT TO THE ZONING MAP History: On September 13, 2004, the Planning Commission unanimously recommended approval of an amendment to allow the combined approval of a Comprehensive Plan Amendment and an Amendment to the Zoning Map. Back1[round: In 1999, the Planning Commission and City Council considered ways to provide a more systematic review of proposed land use changes, while increasing guidance to developers. At that time, it was determined that the objectives could best be accomplished by amending the Zoning Ordinance to allow the rezoning of a property only after the Council had taken final action on the approval of the Comprehensive Plan designation for the site. Since the time ofthe 1999 Zoning Ordinance amendment, staff has received numerous requests from developers wanting to submit simultaneous applications for Comprehensive Plan Amendments and rezonings. For this reason, and to further streamline the development process, the City Council may want to consider removing the following language from the Zoning Code: Section 11 08.808 Applications Awaitin1[ Action on a Comprehensive Plan Amendment. No request for a zoning change for property affected by a pending request for a Comprehensive Plan Map amendment shall be processed until the request has either received final action by the City Council or is withdrawn by the applicant. If the requested Comprehensive Plan amendment involves a land use or density change on a particular parcel of land, no request for a Conditional Use Permit or variance related to ]:\04 files\04 ordin amend\04 zoning\combined process\cc report.doc www.cityofpriorlake.com Page 1 Phone 952.447.4230 / Fax 952.447.4245 ANALYSIS: that parcel shall be accepted for processing until action of the Comprehensive Plan Amendment has been completed. The proposed amendment is responsive to concerns expressed to the City. Sequential comprehensive plan and rezoning applications cost developers and property owner's valuable time. The proposed amendment will streamline the approval process. In addition, the amendment will continue to provide an opportunity for the Planning Commission and City Council to fully review Comprehensive Plan Amendment and rezoning requests. Zoning Ordinance Amendment Findings Section 1108.600 of the Zoning Ordinance states that recommendations of the Planning Commission and final determinations of the City Council shall be supported by findings addressing the relationship of the proposed amendment to the following policies: 1. There is a public need for the amendment. There is a public need for the amendment. It will simplify the approval process, while still providing control over changes to site zoning and Comprehensive Plan designations. 2. The amendment will accomplish one or more ofthe purposes ofthis Ordinance, the Comprehensive Plan, or other adopted plans or policies ofthe City. Objectives and policies ofthe Comprehensive Plan include: . Determine and strive for a balance of commerce, industry and population; . Encourage a diversified economic base and a broad range of employment opportunities; . Promote sound land use; and . Maintain high standards in the promotion and development of commerce and industry. The 2020 Vision and Strategic Plan lists one ofthe vision elements as: . Streamline zoning approval and building permit processes and regulations without sacrificing quality and effectiveness. The proposed amendment strives to accomplish the objectives and policies of the Comprehensive Plan and the 2020 Vision and Strategic Plan by simplifying the approval process, and still providing an opportunity for necessary review. 1:\04 files\04 ordin amend\04 zoning\combined process\cc report.doc Page 2 3. The adoption of the amendment is consistent with State and/or Federal requirements. This amendment is consistent with federal and state laws. CONCLUSION: The proposed amendment is consistent with the goals and objectives of the Comprehensive Plan and the enabling legislation set forth in Minnesota Statutes. Based upon the analysis set forth in this report, staff recommends approval. FISCAL IMPACT: Approval of the project will facilitate development and increase the City tax base. ALTERNATIVES: The City Council has three alternatives: 1. Adopt an ordinance amending to amend Section 1108.808 ofthe Zoning Code to allow the simultaneous, rather than sequential, consideration of an application for a Comprehensive Guide Plan Amendment and Zoning Map Amendment. 2. Deny the ordinance amendment request to allow the simultaneous consideration of an application for a Comprehensive Guide Plan Amendment and Zoning Map Amendment. In this case, the Council should direct the staff to prepare a resolution with findings of fact based in the record for the denial of the request. 3. Defer consideration of this item and provide staff with specific direction. RECOMMENDED MOTION: The staff recommends Alternative #1. This action requires the following motion: A motion and second adopting an ordinance to amend Section 1108.808 of the Zoning Ordinance to allow the simultaneous consideration of an application for a Comprehensive Guide Plan Amendment and Zoning Map Amendment. Prior Lake, MN 55372-1714 CITY OF PRIOR lAKE ORDINANCE NO. 04- XX AN ORDINANCE AMENDING SECTION 1108.800 OF THE PRIOR lAKE CITY CODE The City Council of the City of Prior lake does hereby ordain that: 1. Section 1108.800 of the Prior Lake City Code is hereby amended to delete all of Section 1108.808. This ordinance shall become effective from and after its passage and publication.
