ORDINANCE NO. 94-0~
AN ORDINANCE AMENDING PRIOR LAKE CITY CODE TITLE 9, CHAPTERS 4
AND 5.
The City Council of the City of Prior Lake does hereby ordain:
The first sentence of Section 9-4-4(C) of the Prior Lake City
Code is hereby amended to read as follows:
(C) A connection fee of four hUndred fifty dollars (~A~n.~=~.00)
shall be charged per unit connected subject to an adjustment
as determined by the City Council.
II.
Section 9-4-10(B) of the Prior Lake City Code is hereby amended
to read as follows:
(B) Water Tower Charge:
The water tower charge shall be determined on an annual
basis in accordance with a fee schedule effective
January 1 of each year as determined by the City
Council. The following fee schedule is effective
through calendar year 1994:
$150.00 for 1973

150.00 for 1975
150.00 for 1976
150.00 for 1977
150.00 for 1978
150.00 for 1/1/79 - 7/31/79
200.00 for 8/1/79 - 12/31/79

Said fees shall be placed in a fund maintained by the
City to accumulate funds for the construction of future
water storage facilities and needed future wells.
III.
The second paragraph of Section 9-4-10(C) of the Prior Lake City
Code is hereby amended to read as follows:
If water service is terminated by the City for delinquency
in the payment of a water usage bill or for any other
reason, a fee of twenty-five dollars ($25.00) will be made
for turning on said water service, payable in advance. If
said water service is turned on during a time other than
normal business hours, a fee of fifty dollars ($50.00) shall
be charged to cover the City's expense for call-back time.
IV.
The first sentence of Section 9-5-5(B) of the Prior Lake City
Code is hereby amended to read as follows:
(B) A connection fee of four hundred fifty dollars ($450.00)
shall be charged per unit connected subject to an adjustment
as determined by the City Council.
V.
The first sentence of Section 9-5-9(A) of the Prior Lake City
Code is hereby amended to read as follows:
(A) Rates: Effective February 1, 1994, a billing charge of two
dollars thirty cents ($2.30) per one thousand (1,000)
gallons of water consumption.
VI.
Section 9-5-10(B) of the Prior Lake City Code is hereby amended
to read as follows:
(B) Establishment of Charges: For the purpose of paying costs of
reserve capacity allocated to the City each year by the
Metropolitan Sewer Board, there is hereby established a
charge for:

The availability of treatment works and interceptors
comprising the metropolitan disposal system; and
·
Connections, direct and indirect, to the metropolitan
disposal system.
The charge imposed on each building or structure in the
City, and each connection to the metropolitan disposal
system directly or through the City's system, inside
any sewer service area established by the Metropolitan
Sewer Board, construction of which commenced on or
after January 1, 1973. The charge shall be payable upon
the issuance of a building permit or a connection
permit, as the case may be, but no charge shall be due
upon the issuance of a connection permit if a charge
was paid upon issuance of a building permit. The charge
for each building or structure shall be equal to the

feet a distance of 369.07 feet, more or less, to the actual point of beginning.
All in Scott County, Minnesota. All subject to easements, if any.
PROPOSED REZONING OF APPROXIMATELY 16 ACRES FROM C-1 CONSERVATION TO B-3
GENERAL BUSINESS.
That part of the Southwest Quarter of the Southeast Quarter of Section 28, Township 115, Range 22, Scott County,
Minnesota, described as follows:
Commencing at the Southwest comer of said Southwest Quarter of the Southeast Quarter of Section 28; thence on
an assumed bearing of N 00 degrees 00 minutes 03 seconds W along the west line thereof a distance of 30.00 feet;
thence N 89 degrees 15 minutes 42 seconds E a distance of 75.01 feet to the actual point of beginning of the parcel
to be described; thence N 00 degrees 00 minutes 03 seconds W a distance of 1225.05; thence S 57 degrees 18
minutes 39 seconds E a distance of 569.29 feet; thence S 29 degrees 16 minutes 45 seconds E a distance of 650.36
feet; thence S 01 degrees 20 minutes 58 seconds W a distance of 340.24 feet; thence S 89 degrees 15 minutes 42
seconds W a distance of 789.23 feet, more or less, to the actual point of beginning. Subject to easements, if any.
PROPOSED REZONING OF ABOUT 17 ACRES FROM A-1 AGRICULTURAL TO B-3, GENERAL
BUSINESS.
Those parts of the North Half of the Southwest Quarter and the Southwest Quarter of the Southwest Quarter of
Section 27, Township 115, Range 22, Scott County, Minnesota, described as follows:
Commencing at the Southwest corner of said Southwest Quarter of Section 27; thence on an assumed bearing of N
00 degrees 25 minutes 56 seconds E along the west line thereof a distance of 1328.09 feet; thence S 89 degrees 34
minutes 04 seconds E a distance of 97.93 feet to the actual point of beginning of the parcel to be described; thence N
49 degrees 34 minutes 10 seconds E a distance of 243.74 feet; thence N 08 degrees 52 minutes 40 seconds E a
distance of 1038.02 feet; thence N 36 degrees 10 minutes 11 seconds E a distance of 84.84 feet; thence along a
non-tangential curve concave to the North having a radius of 286.53 feet, a delta angle of 62 degrees 00 minutes 22
seconds, a chord bearing of S 86 degrees 45 minutes 37 seconds E, a distance of 310.09 feet; thence S 32 degrees 46
minutes 07 seconds E a distance of 415.93 feet; thence along a tangential curve, concave to the Northeast, having a
radius of 1137.61 feet for a distance of 345.66 feet; thence S 40 degrees 45 minutes 36 seconds W a distance of
269.12 feet; thence N 90 degrees 00 minutes 00 seconds W a distance of 320.42 feet; thence S 42 degrees 52
minutes 15 seconds W a distance of 394.14 feet; thence S 08 degrees 24 minutes 53 seconds W a distance of 605.50
feet; thence N 73 degrees 19 minutes 59 seconds W a distance of 280.21 feet; thence N 26 degrees 46 minutes 30
seconds E a distance of 42.32 feet; thence along a tangential curve, concave to the West, having a radius of 314.65
feet a distance of 369.07 feet, more or less, to the actual point of beginning. Subject to easements, if any.
This ordinance shah become effective from and after its passage and publication.
