Brace I Subject of Policy: Abandonment ofUnder~ound Storage Tanks Title: Bureau Chief - Inspections Title: State Fire Marshal Date: 11/1/1999 Effective Date: 11/1/1999 APPLIES TO: All Inspection Personnel, Inspection Supervisors, Code/Plans Specialists. PURPOSE: To provide for uniform application of provisions relating to abandonment versus removal of underground storage tanks as covered in MUFC (98) Section 7902.1.7. POLICY: SECTION I - ABANDONMENT OF TANKS Underground tanks containing flammable or combustible liquids that have been removed from service for one year are considered abandoned. For the purposes of this policy, heating oil tanks are included [MUFC (98) Section 6102]. All underground tanks that are abandoned must be removed from the ground or abandoned in place in accordance with this policy. Code requirements can be found in the MUFC (98) Section 7902.1.7. Tank installations that are already equipped with an operational electronic leak detection monitoring system are considered to still be in service for up to 5 years since the tank was last used. Even with electronic leak detection, tanks that have been removed from service (last used) for a period greater than 5 years will require abandonment in place or removal according to this policy. 1.1 Removing tanks from the ground It is the policy of the State Fire Marshal to encourage the removal,of underground tanks that are no longer in service. Removal of underground tanks shall be in accordance with the following [MUFC (98) Section 7902.1.7.4]: I. Flammable and combustible liquids shall be removed from the tank and connected piping. When piping at tank openings is not to be used further, it shall be disconnected: 2. Piping shall be removed from the ground except when the piping is abandoned in place upon determination by the chief that removal is not practical. Abandoned piping shall be capped and safeguarded as required by the chief. 3. Tank openings shall be capped or plugged, leaving a 1/8" to 114" diameter opening for pressure equalization. 4. Tanks shall be purged of vapor and inected prior to removal. 5. Tanks shall be disposed of in accordance with federal, state and local regulations. Page I of2 /' / /,/ POLICY # INS 1999-39 November I, 1999 Page 2 of2 " 1:2 Abandonment in place ," Tanks abandoned in place shall be safeguarded in the following manner [MUFC (98) Section 7902.1.7.2.4]: I. All flammable or combustible liquids shall be removed from the tank and connected piping. 2. All tank openings, vents and pump connections shall be capped, plugged or otherwise secured to prevent vandalism and release of contents. Remaining underground piping shall be capped or plugged. 3. The tank shall be filled completely with an inert material that is designed to displace the contents and vapors. Acceptable materials include cement slurry and polyurethane;/' foam'(sand or water are not satisfactory materials). 4. The site shall be restored in a manner approved by the authority having jurisdiction. 5. The property owner is responsible for retaining a record of the tank size,location and date of abandonment. In addition, the property owner is also responsible for notifying the Minnesota Pollution Control Agency and local officials (when required) as to the presence of the abandoned tank. 1.3 Additional information The State Fire Marshal Division does not maintain records of installed, removed or abandoned tanks in the state of Minnesota.. It is not necessary to apply for a permit or report tank removal or abandonment to the State Fire Marshal Division. The local fire official (fire marshal or fire chief) must, however, be notified before a tank removal or abandonment is started. As stated above in Section 1.1, the State Fire Marshal encourages tank removal, although abandonment is permitted. It is not necessary to receive approval from the State Fire Marshal Division to abandon a tank in place. Once approval from the local fire chief for tank removal or abandonment is received, it is not necessary to contact or receive approval from the State Fire Marshal Division. The State Fire Marshal Division does not :license or certify underground tank contractors. Contact the Minn~sota Pollution Control Agency at (651) 297-8679 for a listing of certified/, underground storage tank contractor~l1~rmitted to conduct tank removal~i State Fire Marshal Division Inspectors do not witness or inspect underground tank removal or abandonment work. Minnesota Pollution Control Agency (MPCA) rules may apply to some abandoned tanks. Contact MPCA underground storage tank registration at (651) 297-8664 for additional information. This policy replaces and supercedes previous policies related to this issue.
