RE: Front Elevation Iron Balcony
Situation:
Bob and Katy Welsh have remodeled their house at 6424 Conroy Street NE to include a new
second-story door to the front, which includes an exterior iron balcony with a dimension of
1.33 feet (width) by 5.0 feet (length). Based on the dimensions, this balcony is more decora-
tive in nature rather than as usable outside space.
Question:
Does the city's Zoning Ordinance allow this type of structure to be a permitted encroachment
into the front yard setback area?
Response:
Subsection 1101.304, Effect, of the Prior Lake Zoning Ordinance, states that, "When the
words of this Ordinance are not explicit, the following factors may be considered:
> The object to be attained.
➢ The consequences of a particular interpretation."
These factors represent two of seven listed. When reviewing other permitted front yard en-
croachments in Subsection 1101.503, a balcony is not identified. However, vestibules are
permitted that extend 5 feet or less into the front yard and do not exceed 30 square feet. ll
this type of enclosed vestibule is permitted, then certainly an open balcony with a dimension
noted above would not have a negative consequence to the property or neighborhood. In
addition, the object to be attained is closer to be more decorative in nature on the house due
to its dimensions.
Therefore, as Zoning Administrator, I make the determination that this second-story iron bal-
cony at the above-referenced address, is permitted without a variance.
