CONSIDER APPROVAL OF A RESOLUTION INITIATING THE
VACATION OF AN EASEMENT ON THE MADER'S PROPERTY IN
CONNECTION WITH THE 2003-04 LIFT STATION IMPROVEMENT
PROJECT
HISTORY: The 2003-2004 lift station improvement project is nearly complete. The
project included updating seven (7) lift stations around the city. The Sycamore lift
station, which is mostly on Wes and Charlotte Mader's property, was one of the lift
stations rehabilitated. T he purpose 0 f t his agenda item is to consider a resolution
initiating the vacation of an existing easement which no longer serves a public
purpose and should be vacated by the City.
CURRENT CIRCUMSTANCES:
The purpose of the lift station rehabilitation is to provide dependable operation of
each lift station to the houses it serves. To complete the updates to the Sycamore lift
station, it was necessary to obtain new utility easements for the realignment of the
equipment. Also due to the realignment, the City is able to vacate an existing
easement along the Mader's property which is no longer required. The proposed
vacation is shown on the attached drawing.
The City Attorney, Public Works Director and Public Works Coordinator have met
with the Mader's several times over the last year to describe the project and its
parameters. The Mader's have been very cooperative with the design process and
construction. Staff recommends the City vacate the existing easement on the Mader's
property as described on the attached sheet.
ISSUES:
With the lift station project nearly completed, the old easement is no longer needed
by the city, so staff recommends that the City Council initiate the process of vacating
the existing easement along the Mader's property. State Statutes require that a
public hearing be held after proper notification to the adjacent properties. We
recommend that a public hearing be scheduled for January 3rd, 2005.
Any fiscal impacts of this agreement are already contemplated in the lift station
rehabili tation proj ect.

The alternatives for the City Council to consider are as follows:
1. A motion to approve a Resolution Initiating the vacation of the existing
easement along the Mader's property, and setting a public Hearing to consider
such vacation on January 3rd, 2005.
2. Table the resolution for a specific reason.
3. Deny the Resolution.
Alternative 1. Staff recommends that the City Council initiate the vacation of the
existing easement.

MADER'S PROPERTY IN CONNECTION WITH THE 2003-04 LIFT STATION
IMPROVEMENT PROJECT

The City has identified seven (7) lift stations for rehabilitation in the City's
Capital Improvement Program, and
The purpose of the lift station project was to provide dependable operation
of the City's lift stations to its residents, and
A City Project to rehabilitate seven lift stations was awarded to Bolander
and Sons (the Contractor) on February 17,2004 and construction is now
substantially complete, and
With the construction of the Sycamore lift station, City staff has identified
an existing easement that no longer serves a public purpose and should be
vacated.
NOW THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The City Council directs staff to take the required legal action to initiate the vacation of an
existing easement along Wes and Charlotte Mader's property and sets a Public Hearing date of
January 3rd, 2005 to hear all persons interested in the proposed vacation.
