CONSIDER APPROVAL OF A RESOLUTION APPROVING
THE PURCHASE OF STREET LIGHTS FOR THE
VILLAGE LAKE DRIVE PROJECT, CITY PROJECT NO.
02-06.
DISCUSSION:
HISTORY
The second and third phases of the Village Lake Drive (formerly
the Ring Road), CH 23, TH 13, Five Hawks improvement project
are now substantially complete. The street lights were installed
prior to the opening of the new road in November. The purpose of
this item is for the City Council to consider payment for the street
lights for the Village Lake Drive project.
CURRENT CIRCUMSTANCES:
The first phase of the ring road, named Park Nicollet Avenue, was
installed in 2003 with the construction of the Keystone elderly care
facility. The developer was responsible for the lights in this
segment. The lights installed were the 30 feet high, shoe-box style,
which the City requires on collector streets. The lights installed on
the second and third phases of Village Lake Drive and on CH 23
were also the same 30 ft., shoe-box style lights.
The installation of the lights was discussed in the feasibility report
and the final declaration of costs for the assessment roll preparation
for the proj ect. Funding for the lights has already been transferred
from the Collector Street fund to the project fund for the payment.
FINANCIAL IMPACT:
The lighting cost for Phase 2 was $20,335 and for Phase 3 it was
$63,500, for a total of $83,835. These costs are eligible for
Municipal State Aid reimbursement.
Under Minnesota Statutes purchases in excess of $50,000 are
typically accomplished through competitive bidding. However,
under Minnesota Statutes 471.36, Non-competitive Supplies and
Equipment, the statute provides that, "the provision of Section
471.35 to 471.37 shall not apply. ..."

The Council will recall that the city has previously acquired
streetlights for the downtown and Lakefront Park through Excel
Energy and now its successor Infrasource. By taking such action
there are two benefits to the tax payer. The lights are maintained
by Infrasource a nd a preferred energy charge i s extended tot he
City. Both are critical as the annual energy and maintenance costs
for streetlighting throughout the City is almost $120,000 for 2005.
These lights are non-competitive supplies and equipment for the
following reasons: 1) Private sector vendors can provide the bid for
the equipment but will not provide a bid for maintenance or
energy. 2) Other utilities could provide bids which include
equipment, installation or maintenance, but such action would
require changes to the franchise service areas for the 3 private
power companies which provide service to the City.
ALTERNATIVES:
The alternatives are as follows:
1. Approve a Resolution authorizing the payment of the
invoice to Infrasource for the street lights in the amount of
$83,835.00.
2. Deny the Resolutions for a specific reason and provide staff
with direction.
3. Table this item for a specific reason.

RESOLUTION 04-XX
A RESOLUTION APPROVING THE PURCHASE OF STREET LIGHTS FOR
THE VILLAGE LAKE DRIVE PHASE 2 & 3/ CH 23/ TH 13/ FIVE HAWKS
IMPROVEMENT PROJECT, CITY PROJECT 02-06
MOTION BY:

WHEREAS, The recently completed Village Lake Drive (formerly known as the Ring Road)
Phases 2 & 3, CH 23, TH 13, Five Hawks street and utility improvements were a
priority for the City; and
WHEREAS, Street lights are known to provide improved safety to the traveling public at
intersections and along city streets.
WHEREAS, The City Council finds that the acquisition of street lights to be a non-competitive
supplies and equipment purchase pursuant to Minnesota Statutes 471.35 to
471.37.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. The recitals set forth above are incorporated herein.
2. The payment to Infrasource for the purchase and installation of the lights in the amount of
$83,835.00 is approved.
3. The funding is to come from the Project Account No. 503 - 80203 - 530.
