HomeMy WebLinkAbout10 20 2014 EDA Report 8BPRIp\ U , 4646 Dakota Street SE Prior Lake, MN 55372 ECONOMIC DEVELOPMENT AUTHORITY AGENDA REPORT MEETING DATE: October 20, 2014 AGENDA #: 8B PREPARED BY: Casey McCabe, Community Development Specialist AGENDA ITEM: C-3 BUSINESS PARK ORDINANCE AMENDMENTS DISCUSSION: Introduction The purpose of this agenda item is to review and recommend amendments to Section 1102.1200, "C-3" Business Park Use District; Section 1102.1300 Com- mercial Restrictions and Performance Standards; and Section 1101.1000, Land Use Descriptions of the City of Prior Lake Zoning Ordinance. History As a result of public comments received during Business Retention and Expan- sion visits and events like the Business & Industry Forum related to restrictive zoning and development requirements in the City of Prior Lake, both the EDAC and EDA have attempted to identify opportunities to make the City of Prior Lake more "business friendly". The City of Prior Lake previously completed a comprehensive review and pro- posed multiple amendments to the Industrial Use District standards, which were approved by the City Council. The review of the C-3 Business Park Use District standards is the next step in the process to review and propose zoning ordinance amendments for all industrial and commercial use districts in Prior Lake. Current Circumstances Under the direction of the EDAC, Community and Economic Development staff researched the building standards and Business Park zoning ordinance require- ments from peer communities in the region. The results were used to determine if the City of Prior Lake's Business Park ordinance requirements are more or less restrictive than the zoning and use requirements of surrounding communi- ties. Staff has proposed multiple amendments to bring Prior Lake's Zoning Or- dinance in line with its surrounding communities. Below is a summary of proposed amendments to the Section 1102.1200 and 1102.1300 of the Prior Lake Zoning Ordinance: Permitted Uses. The following uses have been added as a permitted use in the "C-3" Business Park Use District: ➢ Convention and Exhibition Center ➢ Data Center ➢ Medical/Dental Office ➢ Medical/Dental Laboratory ➢ Showroom ➢ Studio ➢ Business/Trade School Uses Permitted With Conditions. The following uses have been added as a use permitted with conditions in the "C-3" Business Park Use District: ➢ Outdoor Storage (moved from CUP) ➢ Retail Sales, Limited (moved from CUP) • Use changed from Retail Sales or Services to the Public ➢ Storage or Parking of Vehicles (moved from CUP) ➢ Private Entertainment, Indoor (moved from CUP) Uses Permitted With Conditional Use Permit. The following uses have been added as a use allowed by conditional use permit in the "C-3" Business Park Use District: ➢ Outdoor Storage, Class II ➢ Self -Service Storage Facility ➢ Gun Range, Indoor The following uses have been moved from CUP to PUC in the "C-3" Business Park District. ➢ Outdoor Storage (less than 50% of principal structure area) ➢ Retail Sales or Services to the Public (now Retail Sales, Limited) ➢ Storage or Parking of Vehicles ➢ Private Entertainment, Indoor ➢ Gymnastics Schools (now included in definition of Private Entertainment, Indoor) Required Setbacks. The following minimum setbacks have been revised: ➢ Structure side yard setback decreased from 20' to 15' ➢ Structure rear yard setback decreased from 30' to 20' ➢ Structure abutting an "R" use district side yard setback decreased from 75' to 50' ➢ Structure abutting an "R" use district rear yard setback decreased from 75' to 50' Prohibition of Pole Buildings. Pole Buildings are proposed to be prohibited in the C-3 district. The following definitions have been added Section 1101.1000 of the Prior Lake Zoning Ordinance: ➢ Data Center ➢ Outdoor Storage, Class II ➢ Pole Building The following definitions have been amended in Section 110 1. 1000 of the Prior Lake Zoning Ordinance: ➢ Outdoor Storage ➢ Private Entertainment (Indoor) Conclusion EDA members should review and comment on the proposed amendments and provide direction to staff on any additional amendments that may be necessary. Final recommendations of the EDA will be sent to the Planning Commission and ultimately the City Council for final review and approval. The 2014 Prior Lake EDA Business Plan identifies evaluating city codes & fees as a key initiative of the EDA. One of the desired accomplishments of the EDA business plan is to make Prior Lake more business friendly by making changes to city codes, fees and/or processes that help achieve development in Prior Lake. The Economic & Community Development Strategic Initiative of the 2030 Vision and Strategic Plan also identifies the review of existing city code and zoning ordinance provisions to assess their impact on achieving economic development objectives. ISSUES: City staff and EDA members must ensure that any proposed amendment to the zoning ordinance will not have a negative effect on the health, safety, and wel- fare of surrounding properties or community residents. FINANCIAL Staff time dedicated to ordinance amendments. IMPACT: ALTERNATIVES: 1. Motion and a second to recommend that the City Council direct that the Plan- ning Commission conduct a public hearing to consider the adoption of the proposed amendments to Subsection 1102.1200, "C-3" Business Park Use District; Subsection 1102.1300 Commercial Restrictions and Performance Standards; and Subsection 1101.1000, Land Use Descriptions of the City of Prior Lake Zoning Ordinance, as proposed or with further amendments. 2.
