AGENDA ITEM: CONSIDER APPROVAL OF A RESOLUTION APPROVING THE EAGLE
CREEK ESTATES SECOND FINAL PLAT
DISCUSSION: Introduction
KRB Development Inc. has submitted a request for approval of a Final Plat to be
known as "Eagle Creek Estates Second". This site is located between Credit
River Road and Fish Point Road.
History
The City Council approved the preliminary plat for Eagle Creek Estates on May
7, 2014 for a residential development consisting of 60 single family homes along
with a park and trails on a total of 45 acres. The final plat was subsequently
approved on July 8, 2013 with some outlots, including Outlot F, which is the pro-
posed Lot 1, Block 1 in the Second. The adjacent Outlot H will remain for a storm
water pond.
Current Circumstances
Eagle Creek Estates Second consists of one single family residential lot. The
street(Credit River Road)and all utilities are installed to serve this lot. A roadway
easement vacation was required by the Scott County Highway Dept. prior to the
platting of this lot area, which resulted in the outlot at the time of final platting.
The easement has since been vacated.
Conclusion
Staff has reviewed the final plat and finds it to be in substantial compliance with
the approved preliminary plat.
ISSUES: The principal requirements for this final plat approval include conformance with
all aspects of the preliminary plat and payment of development fees associated
with the plat. Since the fees are minor for this one lot, staff has included them in
the resolution rather than in a separate development contract.
FINANCIAL Approval of this final plat will allow construction of new dwelling units, which will
IMPACT: contribute to the City's tax base.
ALTERNATIVES: 1. Motion and a second, as part of the Consent Agenda, to approve a resolution
approving the Eagle Creek Estates Second Final Plat.
2. Motion and a second to deny the resolution.
3. Motion and a second to defer this item and provide staff with specific direc-
tion.

RESOLUTION 14-XXX
A RESOLUTION APPROVING THE "EAGLE CREEK ESTATES SECOND" FINAL PLAT
Motion By: Second By:
WHEREAS, On May 7, 2013, the City Council approved the preliminary plat for Eagle Creek Estates, subject
to conditions identified by Resolution 13-086; and
WHEREAS, On July 8, 2013, the City Council approved the final plat for Eagle Creek Estates; and
WHEREAS, KRB Development Inc. (the "Developer") has submitted an application to the City of Prior Lake for
approval of a Final Plat for the"Eagle Creek Estates Second"to include one single family residential
lot located within Outlot F of Eagle Creek Estates; and
WHEREAS, The City Council has found that the final plat of Eagle Creek Estates Second is in substantial
compliance with the approved preliminary plat for Eagle Creek Estates.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein as if fully set forth.
2. The final plat of "Eagle Creek Estates Second" is approved subject to the following conditions, which
shall be met prior to release of and recording of the final plat:
a. The Developer shall submit a current title opinion or commitment of title insurance acceptable to the
City Attorney.
b. The Developer shall pay all fees identified in the Development Contract.
c. The Developer shall provide reductions of the entire final plat be submitted, to the following scales:
1"=200'; and one reduction at no scale which fits onto an 81/2"x 11"sheet of paper.
d. The Developer shall submit three mylar sets of the final plat with all required signatures.
e. The Developer shall provide financial security, acceptable to the City Engineer.
3. Prior to recording of the Final Plat the Developer shall pay the following applicable Development Fees:
Park Dedication Fee - $3,750; Trunk Storm Water Acreage Charge - $937.00; Trunk Water Acreage
Charge - $1,848.00; Trunk Sewer Acreage Charge - $1,021.00; Street Oversize Acreage Charge -
$1,653.00.
4. The Developer shall file the final plat and all pertinent documents with Scott County within 60 days from
the date of final plat approval. Failure to record the documents by December 26, 2014, will render the
final plat null and void.
PASSED AND ADOPTED THIS 27TH DAY OF OCTOBER, 2014.
